The Committee to whom was referred the Petition of N G James of Bastrop asking for One thousand dollars in aid of the Military Institute beg leave report as follows Viz Believing it to be for the best interest of the City to foster all reasonable plans for the public welfare and believing that the location of the Military Institute will be of great financial advantage to Austin, we recommend that the sum of One thousand dollars U. S. Currency Appropriated out of any moneys not otherwise appropriated, which amount shall be donated to said Military Institute in four equal payments, viz Two hundred and fifty dollars when the building is begun, and Two hundred and fifty dollars severally in Six, twelve and eighteen months thereafter, Provided that should the building to be erected at any future time ceased to be used for the purpose above specified, namely that of a Military School, or should the property be alienated or sold by the said James, the above sum of One thousand dollars, shall be a lien upon the property and shall revert to the City of Austin. Resolved that the City Council do unanimously request the General Commanding to remove from Office John W. Farr who has heretofore been appointed City Marshall, Our reasons are that the said J. W. Farr has never performed the duties of City Marshal, and is totally unfit for the Office. We believe that until an election for City Officers takes place, the Police force of the City will be entirely adequate to maintain the peace of the City without a City Marshall; and that the salary of the said Officer can as well be saved to the City. We also respectfully beg leave to refer to a former petition for this object which was forwarded to the General Commanding about four months since, but which has not been responded to . The following resolution passed unanimously at a regular meeting of the City Council held March 7th 1876 Resolved, that so much of section five of an Ordinance in regard to Market bonds passed February 7, 1876 as related to the time of the payment of the said bonds, be, and is hereby repealed, and the following substituted therefor Two thousand ($2000) dollars in one year from date of issue. Austin March the 11th 1876 City Council Called together by the His Honor Leander Brown, Present Aldermen; Bennett, Baker, Collins, Fox and Hounsike The following Ordinance was then intro- duced and unanimously passed, then by a Suspension of the rules it was passed to its Second and Third reading and Signed by the Mayor
1 Be it Ordained by the City Council of the of the City of Austin. That Section 1 of Article 2 the City Ordinance be, and is hereby repealed and the following substituted in its place; Viz, Article 2nd Section 1 Be it Ordained & That no building or part of a building shall hereafter be erected upon any lot or part of a lot fronting on Congress Avenue City of Austin, unless the outer walls of the same shall be constructed of rock, brick, concrete or cast iron; and the roof of the same, shall be of slate, metal or other fire proof substance 2 Section 2 The City Council, upon being informed that any person is erecting a building in violation of this ordinance, shall forthwith require the City Marshall to raze the same, which officer shall execute said order, and collect the expense incident thereto from the person owning or erecting the same.
