62 City Council Room Austin, April 06, 1871 The City Council met pursuant to adjournment. Roll called. Present: His Honor, The Mayor; Aldermen Thos. Adams, J. L. Barcus, C. Eggleston, Henry Marion, J. Truscott, J. H. Robison; - absent J. Burmester.
Alderman C. Eggleston presented the report of the City Sexton for the month of March, which was read and adopted. Thereupon Alderman C. Eggleston presented the following Resolution authorizing the Mayor of Austin to procure a Steam Fire Engine "Be it Resolved, by the City Council of the City of Austin, That the Mayor be, and hereby is, authorized to order of the Silsby Manufacturing Company, one of their First Class Steam Fire Engines, together with (600) Six hundred feet of Hose, whenever the Washington Fire Company No. 1 of this City, in accordance with their proposition, shall have paid into the City Treasury, for said Steam Fire Engine the sum of Two Thousand Dollars, over and above the Two Thousand Dollars above mentioned. And be it further Resolved, that the Mayor be authorized to execute to the said Silsby Manufacturing Company, on the terms as he may agree, with said said Company, the warrants of the City for that amount which may be necessary to pay for the said Engine over and above the Two Thousand Dollars above mentioned." On motion of Alderman Truscott, the rules were suspended, the resolution passed its second and third reading, and was finally adopted by the following vote:Yeas: Thos. Adams, J. L. Barcus, C. Eggleston, Henry Marion, J. Truscott, J. H. Robison. Nays: none.
Alderman J. H. Robison presented the following Resolution:"Be it Resolved by the City Council of the City of Austin, That a special Committee of Three be appointed to audit and adjust all accounts between the Contractors for building the New Market House and the City." On motion of Alderman Truscott, the rules were suspended, the Resolution passed its second and third reading, and was then unanimously adopted. Thereupon His Honor, the Mayor, appointed Thos. Adams, J. L. Barcus, and Henry Marion as the aforesaid Committee of Three, to report at the next regular meeting. Alderman J. H. Robison presented the following Ordinance amendatory of an Ordinance approved March 10, 1856.

63 Be it ordained by the City Council of the City of Austin, that S.11 of the ordinance defining Misdemeanors shall hereafter read as follows, to-wit: "Whoever shall bathe, wash or swim in the Colorado river, or in any other water course, pond or pool, in this city, during the hours of Daylight, being naked or insufficiently clothed to provide improper exposure of their person, shall be Proved guilty of a misdemeanor." On motion of Alderman S. C. Eggleston, the rules were suspended, the ordinance passed its second and third reading and was then unanimously adopted. Alderman C. C. Dewey praying for leave to erect a stairway of 30 inches in width in the alley side of his office building on Pecan street, was received and read, and on motion of J. L. Messner, said prayer was temporary granted, subject to further action of the Council in the premises at any time hereafter. Alderman J. H. Robinson presented a petition of Peter Matthews; petition praying for leave to exhibit a magneto-electric battery in the streets of the city. Alderman I. Messner offered a resolution to grant his prayer, on the payment of a license tax of ten dollars to the city, limiting the hours of the exhibition of said machine to three months. Alderman S. C. Eggleston moved to suspend the rules, the ordinance was passed upon its second and third reading and finally the yeas and nays were taken resulting as follows: Yeas: Mayor, F. M. West, J. L. Russ, S. C. Eggleston, Henry Madison, I. Messner, J. H. Robinson. Nays – none. Then the resolution was unanimously adopted. Alderman S. C. Eggleston presented a resolution to request the Senator and Representatives of this county to procure an appropriation by the present Legislature to improve the expenses of paving the sidewalks and street gutters in front of the Government Blocks Fronting Congress Avenue. The City Council unanimously resolved to authorize the Mayor to act upon said resolution and in conformity therewith. Alderman S. C. Eggleston offered the following Resolution for the sale of Eighteen Market House Bonds: Be it resolved by the City Council of the City of Austin, that the Mayor be, and hereby is authorized to issue Eighteen Bonds of the City of Austin, of the denomination of One Hundred Dollars each, to meet the payment of the Bonds of the City falling due on the 15th Day of April 1871. On motion of Alderman Messner, the rules were suspended the resolution passed its second and third reading and was then under a call of the Yeas and Nays unanimously adopted to-wit: Yeas: Mayor, F. Motion adopted. This House further presented the following receipt for consideration and approval of the City Council: Received March 25th, 1871 from Joka H. Shaw, Mayor of the city of Austin the following notes; viz: 3 notes of Josiph Luxinger 225.00 3 " " A.
