291 City Council Room. Austin Tex. December 2d 1872. City Council met at its regular monthly meeting Present: His Honor T.B. Wheeler, in the Chair. The Roll being called, the following Aldermen answered to their Names. Aldermen W. Brueggerhoff. E.S. Bremond. E. Christian J. W. Hannig. J. H. Robinson T. C. Sneed. A. Scholz Geo. Sussman. Alderman Sneed offered the following Resolution: Be it resolved by the City Council of the City of Austin, That the Mayor and Marshall be instructed to enforce with Strictness all Ordinances prohibiting the placing of Obstructions on the Sidewalks & Streets, Thoroughfares and in the other public places of the City. The Resolution was adopted by an una- nimous vote. A Petition of Mess. Clark & Stransombeck to open a Meat Market in the 8th Ward of the City was read and on Motion of Alderman Suss- man, referred to Market House Committee. Petition of Mr. Thomas McGehee was read, asking the privilege of grading Street West of Mrs. Collins Residence, as set forth in the Petition. On Motion of Alderman Christian, the Petition was referred to Street Committee. Alderman J. H. Robinson offered the following Resolution: Be it resolved by the City Council of the City of Austin, That the Mess. Weed & Holmes be permitted to use the City Hall for a Skating Rink for three Months from December 1872 at Fifty Dollars per Month to be paid in advance, the Council claiming the right to retain the use of the Hall for the Citizens of Austin, when the Hall is not in use as Skating Rink. Alderman W. Brueggerhoff offered the following --- Page break --- 292 Resolution. Be it resolved by the City Council of the City of Austin, That, the Mayor be requested to appoint a Committee to investigate in reference to the Sale of Real Estate of the City by a former Administration and to take such Measures for for the recovery of the same to the City, as they may deem advisable. His Honor the Mayor appointed as said Committee: Aldermen Robinson & Sneed. with the request, that the City Attorney be solicited to assist said Committee. The Resolution was adopted unanimously. Alderman Hannig offered the following Reso lution. Be it resolved by the City Council of the City of Austin, That the Cemetery Committee be instructed, to investigate, in reference to any infringements in and around the Cemetery Grounds, and if any such, to have the Ordinances regulating the same, enforced to their fullest extent. The Resolution was adopted by an una- nimous vote. City Sexton Report for Month of November 1872 was presented to the Council, read and adopted. Alderman Brueggerhoff offered the following Resolution. Be it resolved by the City Council of the City of Austin, that the Finance Committee be requested to examine into the Condition of the finances of the City, and that the said Committee be instructed to employ a competent person to assist in examining the Records, and Report to the Council at the earliest opportunity, the Condition of the same. The Resolution was adopted unanimously. Alderman Bremond offered the following Resolu- --- Page break --- lution: Be it resolved by the City Council of the City of Austin, That the Committee on Streets be requested to instruct the City Marshal, to examine into the Condition of the Bridges of the City also the Streets, and to make all necessary immediate repairs of the same, and that the Committee approve all or any improvements so ordered. The Resolution was adopted by an un- animous vote. Alderman Brueggerhoff offered the following Resolution: Be it resolved by the City Council of the City of Austin, That the City Marshall be instructed, to light the Streets, and to purchase the necessary material, and employ help, and pledge the City for payment. The Resolution was adopted by an un- animous vote. Alderman J. W. Hanning offered the following Resolution: Be it resolved by the City Council of the City of Austin, That the City Marshal be instructed, to purchase a suitable Quantity of Blankets, for the present use of the Prisoners in the Calaboose. The Resolution was adopted by an un- animous vote. Alderman Robinson offered the following Resolution: Be it resolved by the City Council of the City of Austin, That the Fire Committee be instructed, to examine the Condition of the Fire Cisterns and if deemed advisable to erect others, and if the present subscriptions uncollected, are not sufficient to defray expenses to solicit subscriptions, as they may deem advisable, sufficient to place the Cisterns in proper Condition. The Resolution was unanimously adopted. --- Page break --- 294 Alderman W. Bruggerhaff offered the following Res olution: Be it resolved by the City Council of the City of Austin; That the Mayor and City Marshal be instructed, to have the Ordinances of Dog Law republished and enforced to its fullest extent. The Resolution was adopted by an una nimous Vote. Alderman W. Bruggerhaff offered the following Resolution: Be it resolved by the City Council of the City of Austin, That hereafter all Fines of Mayor Court be required to be paid in money The Resolution was unanimously adopted. Alderman Bremond offered the following Reso lution: Be it resolved by the City Council of the City of Austin, That, the Market House Com mittee have full Control, to rent the Calaboose and Coffeestand, and be authorized, to make all present needed repairs of Doors, Windows or as they may deem advisable for the Interest of the City. The Resolution was unanimously adopted. Alderman Sneed offered the following Resolution: Be it resolved by the City Council of the City of Austin, That so much of Section 13. of an Ordinance of said City passed on the 10th [illegible]day of March 1856. being Article 225. of the City [illegible]: Code, which reads as follows: [illegible] and it shall be the duty of the Mayor on re [illegible], ceiving satisfactory information of any such [illegible]. table or devices, being set up and used, to issue [illegible], his warrant to the City Marshal, commanding [illegible]. him to destroy the same, which warrant [illegible]. shall be immediately executed be and the [illegible]. same is hereby repealed. [illegible] On Motion of Alderman Bremond, the Reso lution was [illegible] unanimously adopted after suspending the Rules by the [illegible] --- Page break --- 295 Report of Committee on Ordinances was read, which is as follows: To the Mayor & Board of Alderman of the City of Austin: The Committee on Ordinances, to whom was refered the Communication of Reuben I Lord, Esqr: asking to be appointed Surveyor of said City, beg leave to report, that they have had the same under consideration and upon examination they find that there is no such officer recognizable by any provision of the City Charter or any Ordinances of the City. They should also state, that the financial Condition of the City is such, that the City Council would not be justified in erecting any office not absolutely required for the public good of the City and that they are of opinion, that no necessity now exists for such an Office as a City Surveyor. They are also of opinion in the event, that the services of a Surveyor, should at any time be required, a competent surveyor, can be employed for the said occasion, wherein his services may so be required. Respectfully submitted: Ineed Chairman C. R. Johnson Ca, Bill of account Current against John W. Glenn, Mayor of the City, was presented to the Council, read and on Motion of Alderman Robinson, refered to Financial Committee. Mr. G. W. Ervins bill for watering Streets from Septer 28th to Novbr: 30th 1872. was presented to the Council for payment and on Motion of Alderman W. Hannig refered to Finance Committee. The bonds of Mr. Stertzing and Long were then presented to the Council and on Motion of Alderman Hannig, the following Resolution was adopted. --- Page break --- 296 Be it Resolved by the City Council of the City of Austin, That the bonds of City Assessor, Collector & Recorder and also the bond of City Marshal be approved by the Mayor. Mr. Stertzing, Assessor, Collector & Recorder was than by his Honor the Mayor sworn into Office. Alderman T. E.
