308 repealed, and that this, ordinance to take effect and be in force from and after the first day of February 1873. On motion of Aldm. Bremond the Rules were suspended by two thirds majority, and after proping the second, and third reading the yeas and nays being called it passed by the following votes Yeas Aldermen Speir Bremond " " Christian Sussmann " " Brugerhoff Hannig " " Seelig Robinson Nays " None. On motion of Alderman Robinson the Council adjourned until its regular monthly meeting. Fred Steizing Recorder City Council Room Austin Tex. February 5th 1873. City Council met at its monthly meeting. His Hon. the Mayor in the Chair. The Roll being called the following Aldermen, answered to their names. Aldermen S. B. Speir, G. Bremond, Ed. Christian, Geo. Sussmann J. H. Robinson, F. W. Hannig There being a quorum present the Council proceed to business. Petition of Dr. J. W. Strutnaker asking the appointment as City Physician was read, and refered to a Committee of three, whereupon His Hon. the Mayor appointed Aldm. Hannig, Sussmann and Bremond Petition of F. Pfeffer and J. Selff praying to have refunded the Licenses paid by them on Jenny Lind Billet was read, and refered to Committee on Ordinances. Aldm. Speir moved that the City Sexton be instructed not to bury the bodies of persons that had died by smallpox within the City Cemetery, which motion was carried. Petition of Messrs. Clark & Stranslinback asking the privilege to open a meat market on Pecan Street was read, and on motion of Aldm. Hannig actions was defered until next meeting. Petition of Weed & Bro. asking to be released from --- Page break --- 309 The lease of the Market Hall was read, and on motion of Aldm. Bremond the petition was referred to Committee on Market House. Committee on investigation of the legality of Mr. W. J. Speer, praying a License for keeping bar in the Turner Hall made the following report. That they have had the same under consideration and that upon an investigation of the question involved they find that under the act of incorporation of said Turner verein association said association is exempt from the payment of the special Tax referred to, but that any other person pursuing the business or occupation of retailer of spiritous liquors, at, in, or about said Turner Hall on his own account and for his own benefit is not exempt, they therefor recommend that the relief asked by Mr. W. J. Speer be not granted. On motion of Aldm. Hannig, the report was adopted. Committee to whom was referred, to look into the necessity of an Assistant in the office of Assessor and Collector, made the following report. That upon examination of the receipts of the Assessor and Collector they find that the commission thereon at this time is not enough to employ a clerk at his expence and that the work in the Assessors, and Collectors office has increased to make it necessary to employ a clerk. Therefore beg leave to offer the following Resolution Be it resolved by the City Council of the city of Austin, That the city Recorder be allowed to employ a clerk who shall receive from the city treas= ury the sum of seventy five coin, dollars per month, commencing from the time such clerk shall have been in actual employ. That this resolution shall be in force only so long as the city Council may deem necessary. Aldm. Robinson moved that the rules be suspended, whereup=on the yeas and nays were then called and the same resulted as follows Yeas Aldm. Bremond, Christian " " Brueggaroff, Robinson Nays " " Sneed, Hannig The suspension of rules not having received a --- Page break --- 310 majority of two-thirds, it was therefore suspended. Quarterly Reports of Cheaper, and Collector & Mayor, Treasurer and Sexton were then presented, which on motion were referred to Committee on Finance Aldm. Hannig moved that the Cemetery Committee be empowered to dispose of the surplus ground in the old Cemetery as they shall see proper. On motion of Aldm. Robinson the same was carried. Aldm. Brueggerhoff offered the following Ordinance Sec 1st Be it ordained by the city Council of the city of Austin. That the sum of three hundred and fifty dollars in currency or so much thereof as may be necessary be, and the same is hereby appropriated out of any money in the city Treasury not otherwise appropriated for the purpose of paying off, and discharging a certain judgment recovered by Stewart & Fitch as against John W. Glean and W.C. Evans in the district Court of Travis County at the June Term of said, Robert 1872. and that a Warrant be issued to the said, Stewart & Fitch or to their Attorneys of Record in said suit for the amount required to discharge said judgment and costs of suit. Sec 2nd That all ordinances in conflict with the provisions of this, are hereby repealed, and that this ordinance take effect and be in force from and after its passage. On motion of Aldm. Bremond the rules were suspended, and after passing its second and third reading the ayes and nays being called it passed by the following vote- Yeas Aldm. Nays None Bills of Mr. Long against the City amounting to five dollars cash, advanced by him for washing and burying Mr. Hamilton, a pauper. was presented. Aldm. Brueggerhoff moved said bills to be paid out of Fines which was carried Aldm. Brueggerhoff offered the following Resolution. Be it resolved by the City Council of the city of Austin. That the sum of one hundred and fifty dollars in currency is hereby appropriated for --- Page break --- 311 for the month of February 1878 to defray necessary expenses pertaining to the different city Offices. On motion of Aldm. Bremond the rules were suspended and, after passing its second, and third reading the yeas and nays being called it passed by the following vote. Yeas Aldm. Sneed introduced an Ordinance al= lowing butchers to vend meat anywhere in the city, by paying the minimum sum fixed for the rent of stall in the Market House etc. as set forth in the Ordinance. On motion the ordinance was laid over until next meeting. On motion the Council, adjourned until the regular monthly meeting. Evans His Honor the Mayor announced to the Council that the meeting was called to inform them that he had vetoed the ordinance, appropriating the sum of three hundred and fifty dollars in currency in the case of Steward and Fitch against J. W. Glenn and W. B. Evans. Alderman Christian
