City Council Room Austin Texas April 17th 73 Regular meeting continued His Honor T.B. Wheeler called the Council to order Present: Ald. F.C. Sneed, C. Bremond, A. Scholz, Wm Brueggerhoff, J.H. Robinson J.W. Hannig Absent: Geo. Shipmann, Ed. Christian Petition of David Pearson asking the privilege to sell butchers meat on East Avenue in the house formerly occupied by Mr. L. Blumontritt was read and granted. Petition of Stransebuck and Clark asking a continuation to sell butchers meat on East Avenue opposite the Iron Bridge over Waller Creek was read and granted. Petition of T. Massek praying to rent the old City Jail in the city Market House for the sum of one hundred currency dollars per annum. On motion of Ald. Hannig the petition was granted. Petition of C.D. Anderson praying to be appointed City Engineer was read; Ald. Brueggerhoff moved that the Council go into an election for a City Surveyor which motion was carried. R.W. Ford and C.D. Anderson were announced as candidates. On first ballot R.W. Ford received 3 votes C.D. Anderson received 3 votes. Second ballot R.W. Ford received 3 votes C.D. Anderson received 3 votes. Ald. Bremond then moved the election for City Surveyor be postponed until next meeting which motion was unanimously carried. Petitions of Wm. Hurlbert, C. Marshall, C. Fisher, and W.W. Fletcher praying to be appointed Market Master were read; Ald. Robinson moved that the Council go into an election for a city Market Master which motion was unanimously carried. The above named petitioners were announced as candidates, on the first ballot C. Marshall received six (6) votes and was declared elected city Market Master. Petition of the Merchants of this city asking an amendment to an ordinance passed in the year 1856 to be so amended as to give them the right to occupy their bridges over the drains in front of their Stores or Shops except the width of six feet etc. as set forth in the same. On motion of Ald. Bremond the petition was referred to the Committee on Streets, and make report on the same

by next meeting. The resignation of Ed. Christian as Alderman of the third Ward was read. Ald. Bruggehoff moved that the resignation of Alderman Ed. Christian be accepted, which motion was unanimously carried. An invitation to the Honorable Mayor and Board of Aldermen to participate in the anniversary celebration of the Fire Department on Monday next, was read, and on motion of Ald. Hannig, the invitation was accepted. Ald. Brueggerhoff moved that the petitioners J. Pepler and John Delfs, the relief asked by them to have credit for the amount of license paid by them on [illegible] tables be granted. On motion of Ald. Robinson the rules were suspended, the motion passed its second, and third reading the yeas and nays being called it passed, be the following vote. Yeas Ald. Sneed, Bumond, Bruggehoff " " Robinson, Scholz, Hannig. Nays none Ald. Scholz offered the following ordinance. Be it ordained by the city Council of the city of Austin, That any person riding or driving more rapidly than in a walk over any bridge in the city of Austin, shall be deemed guilty of a misdemeanor And any person convicted of said offense shall be fined five dollars. Any person giving information of the violation of this ordinance shall be entitled to one half of the fine imposed, and that this ordinance take effect and be in force from and after its passage. On motion of Ald. Robinson the rules were suspended the ordinance read second time, on motion of Ald. Hannig the rules were further suspended the ordinance read third time, the yeas and nays being called it passed by the following vote. Yeas Ald. Sneed offered the following ordinance, An Ordinance to regulate the Collection of the taxes of the City of Austin and to provide for the exchange of liabiliities against the same for City Bonds. Be it ordained by the City Council of the City of Austin Sec. 1. That hereafter all warrants drawn on the City treasurer bearing date since the 18th day of November 1872 shall be received in payment of all taxes and City dues, except rents of Market stalls, and that no warrant issued or bearing date prior of said 18th day of November 1872 shall be recei- ved in payment of City taxes, unless the holders of such warrants shall before the first day of June 1873 present such warrants to the City Recorder and cause the same to be registered. Sec. 2. That when any warrant of the City issued or bearing date prior to the 18th day of November 1872 shall be presented to the City Recorder to be registered, he shall at once register the same in a book to be kept by him for that purpose, in which shall be noted the date of registration the date of warrant, by whom and in favor of whom drawn and the amount due on the same, and the City Recorder shall also endorse across the face of each warrant registered by him in red ink the word "Registered" with the date of registration and sign his name officially to such endorsment. Sec. 3. That no audited claim, or other demand against the City except warrants issued since 18th day of November 1872 and warrants issued prior to said date and registered as provided in the preceeding section shall be received in payment of taxes, but the holder or owner of any audited claim or account against the City duly approved may present such claim or account to the Mayor

any time before the first day of June 1873 and have a warrant issued to such holder or owner by the Mayor in lieu of such claim or account, and that the warrant so issued shall be received for all City dues and taxesexcept for rent of Market stalls. Sec. 4. That any person or persons holding any warrants of the City or any audited Claim or account duly approved against the City may exchange the same for Bonds the City of One hundred dollars each, payable in ten years from the first day of June 1873 or at any time sooner at the option of the City drawing ten per cent interest per annum from date thereof the interest payable semi-an- nually with interest Coupons attached, the Coupons on which shall be received in payment of all taxes and City dues after such Coupons shall fall due, except ent of Market stalls, and any person holding any such warrants or claims who shall be willing to exchange the same for bonds under this ordinance, shall be allowed interest at the rate of ten per cent per annum on his claims after maturity and Bond issued to him accordingly. Sec. 5. That should any persons holding claims against the city desire to exchange the same for City Bonds, such as are mentioned in the preceeding section, then the Mayor be and he is hereby authorized and directed, to issue such Bonds said Bonds shall be signed by the Mayor and attested by the City Recorder and the City Recorder shall keep a registry of all Bonds issued under this ordinance giving an accurate description of the same. Sec. 6. That such a per cent of the General Revenues of the city of Austin for the year 1873 and for each year thereafter for ten years as shall amount to twenty per cent on the amount of the Bonds issued under this ordinance, be and the same is hereby set apart as a sinking fund for the payment of the interest and for the redemption of said Bonds at maturity; and that the Mayor of the city be and he is hereby authorized and required, as said fund shall accumulate in sums of five hundred dollars to purchase for the city and retire said Bonds to the best advantage for the City; for which purpose he is authorized on his warrants to draw said fund as the same accumulates in the city Treasury; and that the sinking fund here-

in set apart for the payment of the interest on said Bonds and for the redemption of the principal shall under no circumstances be applied or converted to any other purpose. Sec. 7. That all ordinances, or parts of ordinances, in conflict with the provisions of this ordinance, are hereby repealed, and that this ordinance take effect and be in force from and after its passage. The ordinance was read first time. On motion of Ald. Sneed the rules were suspended, the ordinance read second time. On motion of Ald. Brueggerhoff the rules were further suspended the ordinance read by caption, the yeas and nays being then called it passed be the following vote. Yeas: Alds. Sneed, S. Bremond, J. H. Robinson J. W. Hannig, Wm. Brueggerhoff, A. Scholz. Nays none Ald. Brueggerhoff offered the following ordinance. An Ordinance extending the fire limits of the City of Austin Be it ordained by the City Council of the City of Austin. Sec. 1st. That the fire limits of the City of Austin be and they are hereby extended to read as follows: On Pecan Street from East Avenue to Lavacca Street on Pine Street from Sabine Street to Lavacca Street on Congress Avenue from Water Street to Mesquite Street Sec. 2nd. No building or addition to a building the outer walls of which are in whole or part constructed of wood shall be erected upon any Block fronting on either Pine Street Pecan Street or Congress Avenue between the points mentioned in the preceding section Sec. 3rd. That whoever shall violate any part of the preceding section shall be guilty of a misdemeanor and punished accordingly, and the Mayor on conviction shall cause the person convicted, to be prevented further prosecuting the work constructing the offense of which he was convicted, and to cause the Structure to be demolished. Sec. 4th. That this ordinance shall be in force from and after its passage. On motion of Ald. Robinson the rules were suspended the ordinance read second time. On motion of Ald. Sneed the rules were further suspended the ordinance read third time, the yeas and nays being called it passed by the following vote. Yeas: Ald.
