Sneed moved that the Assesment of James P. McKinney be raised from 4700 dollars to 5500 dollars which was carried. Ald. Brueggerhoff moved that the improvements on Mr Tifes Lot 2 in Block 111 be raised from 300 dollars to 600 dollars, which motion was unanimously carried. On motion of Ald. Regular meeting. His Honor T.B. Wheeler called the meeting to order, the roll was called. Present: Ald. T.C. Sneed, C. Breemond " Geo. Susmann, A. Scholz " Wm Brueggerhoff, J. H. Robinson, J. W. Hannig. Minutes of last month were read, and adopted. His Honor T.B. Wheeler read the report of the judges of special election for Alderman of the Third Ward. G.T. Boardman having received the majority of votes cast in said election G.T. Boardman was therefore on motion of Ald. Sneed declared duly elected Alderman of the Third Ward. Petition of Dr. C.M. Worthington & Alf. H. Robinson praying to have opened the West Avenue between Pecan Street and Cedar Street was read, whereupon Ald. Sneed offered the following Resolution. Be it resolved by the City Council of the City of Austin That the Mayor required to cause a survey to be made of West Avenue of said City and ascertain who have obstructed said Avenue by the erection of fencing, houses or oth- erwise, and the extent of such obstructions; and that in the event that any person or persons who have so obstructed said Avenue shall fail neglect or refuse to remove such obstruction for five days after the service of written notice requiring the removal thereof, the Mayor shall cause such obstructions to be removed at the expense of the City. being the candidates, on first ballot C. D. Anderson received five(5) votes B. W. Ford received two (2) votes. C. D. Anderson. having received a majority of two thirds vote was declared duly Elected City Surveyor Report and Bill of J W Shoemaker was read, and referred to Finance Committee. Ald. Sneed moved that a Committee of three, be appointed to confer with the County Commissioners in regard to establish a City and County Hospital for the better accommodation of the poor, which motion was carried. His Honor the Mayor appointed on that Committee Ald. Sneed, Bremond, and Hannig. On motion of Ald. Robinson, Geo. Susmann was added to the Committee Ald. Sneed moved that the appointment of W.B.Spingle and Ed. Millican as policemen be approved by the Council, which motion was carried Petition of H. G. Madison praying to be appointed a Policeman in the Eastern part of the City was read. On motion of Ald. Brueggerhoff the Mayor was requested to appoint him without compensation except the fee of which a Policeman is entitled to. Ald. Bremond that should Marshal Long require another Policeman he be requested to appoint Louis Blumentritt, which motion was carried. Committee on Ordinances to whom was referred "An Ordinance" to regulate the fees to be allowed the City Attorney reported that they have had carefully considered the same and recommend its passage. Be it ordained by the City Council of the City of Austin Sec. 1st That it shall be the duty of the City Attorney to prepare and draw up all complaints for misdemeanors; and to cause all necessary witnesses to be summoned on the part of the prosecution. Sec. 2nd That in cases of misdemeanor brought before the Mayor, when the party pleads guilty the City Attorney shall be entitled to a fee of two Dollars, to be taxed in the bill of costs. Sec 3d That in all cases of misdemeanor when the party accused pleads not guilty, the City Attorney shall pros- ecute the case on trial either before the Mayor, or a jury, the City Attorney shall be paid a fee of five dollars to be taxed in the Bill of costs.

Sec 4th It shall be the duty of the City Attorney to attend daily, Sundays excepted, at the Mayors Office from 9 o'clock A.M. until the Mayors Court shall adjourn for such day, for the purpose of preparing complaints and prosecuting cases before the Mayor. Sec 5th That all ordinances or parts of ordinances conflicting with the provisions of this ordinance be and the same are hereby repealed, and that this ordinance take effect from its passage On motion of Ald. That the City Marshal be and is hereby instructed to have the Fire Cisterns of the City of Austin constantly filled with water and that the Mayor is authorized to draw his Warrant upon the City Treasurer for such amounts as may be necessary from time to time to pay for the filling of the above Cisterns, and in absence of any money in the City Treasury the Recorder will sell Warrants of the City to furnish the City Marshal the necessary amount. On motion of Ald. Hannig the rules were suspended the resolution read second time, On motion of Ald.
