Called meeting of the City Council.
His Honor Mayor J. B. Wheeler in the chair called the Council to order, the roll was called and the following Aldermen answered to their names, to wit: Th. M. Mealy, C. Bromond, G. S. Boundsman, S. H. Todd, A. Scholz, Wm. Brueggerhoff, J. H. Robinson, N. B. Mitchell. Absent: Aldermen Ed. Christiman and F. Dohme. His Honor J. B. Wheeler stated that this meeting was called for the purpose of receiving the report of the committee appointed to investigate the validity of the election of Alderman Th. M. Mealy of the first ward and N. B. Whitehall of the tenth ward, whereupon Ald. Brueggerhoff offered the following resolution which passed unanimously. Be it resolved by the City Council of the City of Austin that after the report of the committee has been received in the contested election cases of wards numbers one and ten, the testimony for and against the contestants shall then be heard, then the Attorneys if they desire shall discuss the facts and law before the Council. The Attorneys for the contestant having the right to open and close the argument. After the argument is closed, then the City Council shall proceed to take action on the report of the committee of investigation. The vote on said report shall be taken by calling the roll, all in favor of said report shall answer yes. and those opposed shall answer no, when their names are called. In each of said cases a majority of the Aldermen voting either way shall decide the matter in issue. The committee appointed to investigate the validity of the election of Alderman N. B. Mitchell of the 10th ward then made the following report: We the committee to whom were referred the examination of evidence pertaining to the alleged illegal elec- tion of Alderman N. B. Mitchell of ward No. 10 report the following: That N. B. Mitchell is qualified for such position, there being no testimony to

disprove him, as having been a citizen of ward No 10 thirty days prior to the city election. G. J. Boardman Chairman Wm Brueggerhoff, J. H. Robinson Coms The testimony taken by said committee was then read to the Council, the matter discussed. Whereupon after discussion Alderman Bremond moved that the report of the committee be adopted, carried. The yeas and nays being called the report was adopted by the following vote: Yeas: Aldermen H. M. Metz, C. Bremond G. J. Boardman, S. H. Todd, A. Schulz, Wm Brueggerhoff John H. Robinson. Nays: none The same committee then made their report on the investigation of the validity of the election of Alderman H. M. Metz of the first ward to-wit: We the committee to whom were referred the examination of evidence pertaining to the alleged illegal election of Alderman H. M. Metz of the first ward, beg leave to report: That H. M. Metz Alderman of the first ward, is disqualified for such position, from the fact of not living in ward No 1, thirty days prior to the late city election. It being the opinion of this committee, that the home of said Metz was with his family who lived in a different ward within the time necessary to constitute him as qualified for the position. G. J. to wit: Be it resolved by the City Council of the City of Austin. That His Honor the Mayor be and is hereby authorized to order an election in conformity with the City Charter for Aldermen of the firstward, and issue his proclamation therefore. The resolution passed unanimously. Petition of A. R. Brush asking permission to erect a frame house with tin roof on lot 8 in block 110 was read, received and referred to Fire Committee. Petition of H. G. Buddington & Joseph Lugkenger praying for a privilege to open a meat market in ward No 2. was read, received and referred to Market House Committee. Petition of R. H. Hunter praying for a release of two months license on ten-pin Alley, was read and on motion laid on the table. Petition of Joseph Hallam asking to be released from paying the balance of the term of his liquor license for this present quarter, was read and on motion laid upon the table. Petition of F. Reichman praying to lease a portion of the river walk for the purpose of erecting a steam foundry, was read and referred to the Street Committee. Petition of Christian Fisher making application for the position of policeman. was read and referred to Police Committee. Petition of A. Gorment C. Hornberger and others asking that the proceedings of the City Council and the ordinances of the city be published in the German language and to constitute the Texas Staats Zeitung as the official German paper of the city of Austin. was read and on motion laid upon the table. Ald. Brueggerhoff introduced the following resolution which passed unanimously. Be it resolved by the city Council of the city of Austin. That when the council adjourns it does so to meet in executive session on Friday night 7:30 P.M. November 28th 1873 for the purpose of going into the election of city officers for the term of two years A report of Ald. cistern on the corner of Hickory Street and Congress Avenue and the filling up of all the fire cisterns with clean water and the enforcement of the fire ordinance, was the read and unanimously adopted. On motion of Ald. Bremond the Council adjourned to Friday evening Nov. 28th 1873.

The City Council met in executive session pursuant to adjournment. His Hon. S. B. Wheeler in the chair called the Council to order. The roll was called and the following named Aldermen answered to their names: C. Bremond, G. D. Brawlenson, F. Dohme, S. H. Todd, A. Nichols, Wm. Brueggerhoff, J. H. Robinson, N. B. Mitchell. Absent Alderman Ed. Christian His Hon. S. B. Wheeler stated that the meeting was for the purpose of electing and appoin= ting the different officers as provided for by the ordinances of the city. Whereupon the Council proceeded to ballot for the different offices viz. City Attorney: resulting in the election of W. G. Thomas. Assessor & Collector: resulting in the election of Fred Sterzing City Physician: resulting in the election of J. W. Stalnaker. City Sexton: resulting in the election of C. L. Nitschke. motion of Ald. Brueggerhoff declared duly elected to their respective positions for the ensuing two years. On motion of Ald. Brueggerhoff the executive meeting then adjourned. The Council was then again called to order by His Hon. T. B. Wheeler, the roll called. Present: Aldermen C. Bremond, G. T. Boardman, F. Doheny, S. H. Todel, A. Scholz, Wm. Brueggerhoff, J. H. Robinson N. B. Wittsell. Absent. Ed. Christian. Ald. Wm. Brueggerhoff offered the following resolution which was adopted: Resolved, that the Cemetery Committee be requested to be present when the cemetery is turned over to the new Sexton elect and to give the officers elect will call at the Mayors office tomorrow to be sworn in, and take charge of their respective offices, except the City Sexton elect who will be sworn in on next Monday next December 8th 1873, to give the old Sexton time to get everything ready to turn over the Cemetery to the new Sexton elect on that day, and that the Cemetery Committee be requested to be present when the Cemetery is turned over to the new Sexton elect, and to give him the necessary instruction.
