493 investigation, the charges were read. Officer Hopkins filed not guilty.— Mr. Monroe Pratt was sworn and examined.— Officer Metz was sworn and examined.— Mr. Musgrove was sworn and examined. The Court was then cleared and the following resolution offered and unanimously adopted, To wit: Be it resolved by the City Council of the City of Austin, That in the charges made against Officer F.L. Hopkins for disorderly conduct not becoming an Officer – this being the first complaint made an Officer of this City. That the Mayor is hereby ordered to reprimand him for the same; That however he be retained on the Police Force of this City. On motion of Ald. Robinson the Mayor was authorized to purchase matting for the Mayor’s Office and Stairway. On motion of Ald. Bruggerhoff, the Street Committee was authorized to purchase a horse and cart for city, provided they can buy the same on Three months time at cash rates. On motion Council adjourned. Frosh and other butchers, was read, praying for the laying of gas pipes to the city market house at the expense of the city. Day and many others was read, praying for the opening of Cypress street from East Avenue to the East boundary line of the Corporate limits; also asking water drains be made in and around the freight depot. On motion the petition was referred to Street Committee to report at next meeting. Petition of Elizabeth Swisher was read, praying to be released from payment of license tax on ferry, on account of heavy expenses in keeping a good road to same. On motion, Elizabeth Swisher and Gunningham & Thompson, Keepers of ferry, were exempted from payment of said license tax to the first day of January 1875. and all past licenses that may be due on said ferries. Petition of J. J. Moore was read, asking the amount of $83. be allowed him for entertaining delegates to the Baptist convention on or about the 15th of May 1874. On motion, the same was allowed. Petition of Wm. Hurlcher and others was read, praying for measures to be taken in regard to fixing a ditch between block Nos. 154. and 155. to keep the same from overflowing said blocks. On motion, the same was referred to Street Committee with power to act in the premises. Petition of J. S. Swisher, H. C. Dewey and others, was read, praying for the passage of an ordinance fully ratifying and confirming the provisions of the charter of the Austin City Rail Road Company. On motion the petition was granted. and an ordinance N. 53., entitled, An Ordinance granting the right of way within the corporate limits of the City of Austin, to the Austin City Rail Road Company was introduced and read the first time. On motion the rules were suspended, the ordinance read the second time, On motion the rules were further suspended the ordinance read the third time and passed by the follow= ing vote: Ayes Ald. J. T. Brannan, Wm. Bruggershoff, F. J. Brannan, F. Dohme, H. H. Henty, N. B. Mitchell, J. H. Robinson and J. H. Todd. Nays, none. 495 Report of City Sexton for the month of August 1874. was read received and referred to Cemetery Committee. Report of City Physician for the month of August 1874. was received. Committee reported adversely on proposition of Dr. A. H. Baylor in regard taking care of sick paupers at $1.50 per day. On motion the report was received, adopted and Committee discharged. Ald. Mitchell introduced the following resolution which was unanimously passed. Be it resolved by the City Council of the City of Austin in Council assembled, that the Cemetery Committee Mayor and Sexton be and the same are hereby authorized and empowered to have constructed, a suitable building in the City of Austin Cemetery, for the reception of bodies of deceased paupers, until such time as the same can be properly interred; also to have a cistern built in connection. Ald. Robinson introduced the following resolution which was unanimously adopted: Be it resolved by the City Council of the City of Austin, in Council assembled, that the same style and pattern of uniform as that now worn by the Police of the City of Galveston be and the same is hereby adopted for the Police force of the City of Austin. The caps, belts buttons, baton and badges are to be the property of the City of Austin. The coat and pants are to be purchased by the city and the price of the same to be deducted from the pay of each Policeman. Ald. Doane offered the following resolution which was unanimously adopted: Be it resolved by the City Council of the City of Austin that our Mayor be and he is hereby authorized to offer a reward of twenty five cents for for all dogs running at large in the City of Austin, which when found, have no collar upon their necks, and upon which the license Tax required by ordinance has not been paid. And for all hogs running at large in the city; provided said hogs be delivered at the city dog pound between the hours of 10 to 11 A. M. and 3 to 4 P. M. and for=

496 vided further that said troops be either delivered to the Chief of Police, or placed at some accessible place in the City limits, and that the resolution be to the effect and be in force from and after its passage. An ordinance was introduced. No. 54, to be entitled: "An Ordinance relative to the grading and paving of certain side-walks in the City of Austin." The ordinance was read the first time. On motion the rules were suspended, the ordinance read the second time. On motion the rules were further suspended, the ordinance read the third time and passed by the following vote: Yeas, Ald. G. T. Boardman Wm. Brueggerhoff, Coll Ingersoll, Christiam, H. Dohne, H. Schutze, S. A. Mitt-hull, J. A. Robinson and S. B. Mays. Nays - none. The Chief of Police offered for the approval of the Board of Aldermen "Rules and regulations governing the Police force of the City of Austin." They were read and, on motion, unanimously adopted. Alderman Mealy offered the following resolution, towit: "Be it resolved by the City Council of the City of Austin That the following real estate assessment for the year 1874 be changed as follows: Block 3, lot 6, to five hundred dollars, improvements thereon one thousand dollars; Block 3, lot 7 + 8 to five hundred dollars, improvements thereon eight hundred dollars; Block 137, lots 7 + 8, $1500 improvements thereon fifteen hundred dollars, and that said owners of same be released from payment of the ten per cent. for delinquents, provided, they pay their taxes within ten days." The resolution was unanimously adopted. The following resolution was introduced and unanimously passed. "Be it resolved by the City Council of the City of Austin That privilege is hereby granted to Paul Peck him to erect and maintain a shooting gallery upon his premises, he paying a license therefor; and also privilege to operate & maintain the same on any day of the week, he having erected said shooting gallery at the extreme border of the City limits." 497 To Neil McCaslin. On motion of Ald. Mitchell the Street Committee was authorized to have opened and put in a passable condition the crossing of Wall Street on the Central Rail Road near the old stand of Davis & Maddox. Ald. Mitchell moved that the Mayor & Street Committee be authorized to make all necessary arrange- ments for the filling up the ditches at the foot of the Avenue. Carried.
A bill from Johns & Steffox of $50.00 for making an iron door to city workhouse, was presented and on motion ordered to be paid. A bill from Dr. J. M. Litton of $6.75 for medical services rendered to one Joe. Bittle whilst an Officer of this city with affidavit from W. Marshall W. C.
