Austin Fire Safety and Cemetery Expansion Plans

Fire Safety Improvements: The Fire Department Chief reported nine recent fire alarms caused by inferior lamp oil and requested multiple new water cisterns around the city, including one on Market Hill holding 2,000 barrels. The Board of Underwriters also requested passage of an oil quality ordinance (minimum 110° standard) and stricter chimney requirements to prevent fires.

Cemetery Expansion Approved: City Council authorized purchasing 4.5 acres of land adjacent to the current cemetery from C.W. Shands for $300 per acre to accommodate the high demand for burial plots, with the added benefit of creating a new street access route through the cemetery.

Fire Company Loan Repayment: Council approved issuing $2,800 in warrants to repay a loan from Washington Steam Fire Engine Company No. 1, made in 1871 with interest, allowing the company to build its own engine house and meeting room.

Street Improvements: The council increased the street lamp lighter's salary to $60/month and authorized installation of three additional oil street lamps in Wards 1 and 3 to improve nighttime safety and visibility.

Liquor and Business Licenses: Several petitioners received license exemptions or approvals, including a boat operator exempted from liquor tax and a merchant relieved from license fees during temporary business closure.

The following petition was then read, towit: To the Honorable City Council, Gentlemen: On account of the great demand for choice blocks in the City Cemetery, and scarcity of ground left in the same to furnish the demand, I think it would be much to the interest of the city as well as a measure of economy to purchase some tract adjoining the present Cemetery, which can be cut up in suitable blocks and sold at once at a large advance on the purchased price, thus providing for the present and future needs of the city. C. L. Nitschke On motion, the City Sexton. petition was received and referred to Cemetery Committee forthwith instructions to investigate and examine some ground offered for sale by W.E. Shands which adjoins the cemetery, and make their report by next meeting. On motion Council adjourned Fred Starring Recorder. Regular Meeting of City Council Austin Texas August 3rd/73 Mayor T. B. Hopkins, praying to be released from paying city license tax for the sale of liquors on board the steam boat "Sun Beam" now afloat --- Page break --- 566 on the Colorado river. Granted. Carl Frank, asking for the issuance of a license to retail liquors in quantities less than one quart, on Pecan Street in Ward No. 2. Granted with the provision, that the petitioner has complied with the ordinance conditions thereto. M. G. Barrow, asking permission to inclose the two vacant stalls in the north west corner of the vegetable shed attached to the Market House, and when finished, he promises to pay seventy dollars per month for the use of the same. Laid on the table. Morris Ash, asking to be relieved from payment of license tax as merchant for the months of August and September, he being compelled to vacate his stand in the old Cook Building and being thereby forced to suspend business until next fall. Granted. James P. McKinney, President and C. S. Eggleston, Secretary, in behalf of the Board of Underwriters of the City of Austin, requesting the speedy erection of six moore cisterns for fire purposes, and the passage of an ordinance to prohibit the sale of oil for illuminating purposes of a standard notless than 110° Fahrenheit, to require all stove pipes to enter into brick or stone chimneys or flues, within the fire district, &c. Christian, J.M. Litten, J.W. Sampson, Radkey & Cavett, Youell & Walker and Mrs. D. A. Hillyer, asking for the adoption of the following resolution, to wit: Whereas, An accurate survey of Block No. 110 has been made at the instance of the owners of the east half of said block, and whereas, by said survey the boundaries of the lots in said half block, and the corners of said block as well as the location of the streets immediately north and south have been fixed, to the satisfaction of said owners, and without any detriment to the city of Austin, therefore Be it resolved by the City Council of the city of Austin. Sec. 1st That the north east corner of said block No. 110, shall be fixed and established at a point seventy nine feet and two inches distant from the south wall of Krohn's brick building, on the west line of Congress Avenue, the south east corner of said block No. 110 shall be and is hereby fixed and established at a point on the west line of Congress Avenue two hundred and seventy six feet from the said north east corner of said block No. 110 as herein established; Each of the lots in said block to wit: No. 1,2,3,4,5 and 6 having a front on Congress Avenue of forty six feet, but the fixing of the corners of this block shall have nothing to do with fixing the corners or location of any other block in the city. Sec. 2nd That the City Attorney be and he is hereby authorized and required to represent the City of Austin in a certain suit instituted in the District Court of Travis County, at the June term, 1875, in which suit a judgment and decree was rendered on the 28th day of June 1875, and to do and perform such acts for and in behalf of the City of Austin, as may be necessary and proper to secure the setting aside the decree rendered as aforesaid, and --- Page break --- 568 to have a judgment rendered in said Court in lieu thereof, in accordance with the foregoing resolution. On motion the yeas and nays were called: and the resolution was adopted by the following vote: Yeas- Aldermen Boardman, Bruggerhoff, Christian, Dohme, Mitchell, Robinson and Todd. Nays none. E.C. Eggleston and M.A. Ryan, in behalf of Washington Steam Fire Engine Company No 1, submitting claim for cash advanced, and loaned in the year 1871, by said Fire Company, to the City of Austin, for part purchase money on steam fire engine, to the amount of $2000. with 10 percent interest $2,800; asking that the said amount of loaned money, with 10 percent interest, be refunded to said Washington Steam Fire Engine Company No 1, and stating also that said Fire Company have in view to purchase a site and erect thereon there own engine- house and meeting room, and that the city would thereby save a large amount for rents. Whereupon Ald. Wm Bruggerhoff introduced the following resolution, to wit: Be it resolved by the City Council of the City of Austin: That the Mayor and Recorder are hereby authorized and required to issue four (4) warrants of the city of Austin of an even date in amounts of seven hundred dollars each- total twenty eight hundred dollars bearing interest at the rate of ten per cent per annum, and payable by the city in three, six nine and twelve months respectively; and said warrants shall be made payable to the trustees of Washington Steam Fire Engine Company, in full liquidation of a loan to the city by said Company, said loan being two thousand dollars in cash, and four years interest on same at, ten per cent per annum from June 8th 1871. On motion, the rules were suspended, the resolution read the second time. On motion the --- Page break --- 569 rules were further suspended: the resolution read the third time and passed by the following vote: Yeas - Aldermen Boardman, Buggerhoff, Christian, Dohme, Mitchell Robinson and Todd. Nays - none. Jos. A. Nagle, Chief of Fire Department, stated that the Fire Department had been called out nine times since last report. They were mostly alarms caused from the explosion of lamps, said explosions being caused from the use of an inferior and cheap oil, lately introduced into the city. He also called attention to the necessity of more water for fire purposes, and suggested the building of one cistern on Market Hill, said cistern to be capable of holding two thousand barrels of water to be filled from the roof of the Market House; and one on the hill near the Episcopal church, to be filled from the roof of said church, and six more cisterns about the city. He thinks with these improvements we can feel reasonable safe against fire this winter, but without them he would not be responsible for consequences. Nagle calls attention to the great necessity of a large Alarm bell in the rear of the Capital, - says that the Truck of Hose No. 2 will be ready about the 15th of next month and it was his intention to place her at some point north of the Capitol. He asks for an appropriation of $200 for the purchase of buckets for the Trucks and acid bottles for the Champion Extinguisher. He heartily endorses the communication from the local board of Underwriters and asks that some action be taken in the matter. Referred to Fire Committee with instructions to report at the next meeting. The Cemetery Committee, who were instructed to examine four & a half acres of land offered for sale by C. W. Shands, made the following report: to wit: To the Hon. City Council. --- Page break --- 570 The Committee, to whom the investigation of the ground offered for sale by C. W. Shands, for the enlargement of the City Cemetery, have fully and carefully examined said ground, and find it to be well suited for such extension; It being covered with live-oak trees furnishing a fine shade to nearly every Cemetery Block; and we would also state that by purchasing this tract, the City can have access from East Avenue through the Cemetery to San Saba street. We think it is offered at as low a price as any ground can be purchased within or near the City limits and therefor recommend the purchase, and request that the accompanying ordinance do pass. Committee { C. Christian, F. Dohme, N. B. Mitchell, C. Bremond, The following ordinance was then introduced to wit: Ordinance No. 62. Be it ordained by the city Council of the City of Austin: That the Mayor, be and is hereby authorized and empowered to purchase four and a half acres of land, belonging to C. W. Shands, lying on the east side of the present Cemetery, described as follows: Part of out-lot No. 38 in Division "B" of the outlots adjoining the City of Austin, Travis County, Texas; Beginning at the North-East corner of out-lot No. 38, in Division "B"; thence South 9° East 330 feet to a stake; thence South 81° West 587 feet to South-East corner of Cemetery; thence 9° West 330 feet to a stake and North-West corner of this tract; thence North 81° East 587 feet to place of beginning, at a price not greater than $300 per acre, payable in City Warrants due from and after the first day of January 1876. The ordinance was read, On motion the rules were suspended, the ordinance read the second time, On motion the rules were further suspended, the ordinance read the third time and passed by the following vote, Yeas- Aldermen Boardman, Brueggerhoff, Christian, Dohme, Mitchell, Robinson and Todd, Nays— none. --- Page break --- 571 Ald. Brueggerhoff introduced the following resolution towit: Be it resolved by the City Council of the City of Austin. That the salary of the street lamp lighter be increased to the amount of sixty dollars per month, provided that he pays out of his own salary his assistance. The yeas and nays being called, the resolution passed by the following vote. Yeas- Aldermen Boardman Brueggerhoff, Christian, Dohme, Mitchell, Robinson and Todd. The following resolution was unanimously adopted towit: Be it resolved by the City Council of the City of Austin; That the street Committee be and is hereby authorized to have put up two more oil lamps in Ward No 1. at such points as may be designated by Alderman Cullen of said Ward, and also one in the 3rd Ward to be placed where the street Committee may deem necessary. Ald. Brueggerhoff introduced the following resolution towit: Be it resolved by the City Council of the City of Austin; That the sum of one hundred and one and 69/100 dollars be and is hereby appropriated out of any money not otherwise appro= priated to pay two accounts one in favor of S. W. Erwin for filling fire cisterns, and one one in favor of Jo's Hendrick for work on public streets. The yeas and nays being called, the resolution was adopted by the following vote: Yeas Aldermen Boardman, Brueggerhoff, Christian, Dohme, Mitchell, Robinson and Todd. Nays none. An account of C.E.
