7 Regular Meeting of the City Council. Council Chamber. Austin Texas October 04, 1875. Present: Mayor J. B. Wheeler in the chair; Aldermen – J. C. Boardman, Wm. Bregelhoff, O. H. Cullen, W. R. Mitchell, J. H. Robinson, E. Bremond and S. H. Todd. Absent: Aldermen, Ed. Christian, F. Dotime and S. Piper. The minutes were read and approved from June 9th to September 29th inclusive 1875. Petitions read and disposed of. The voters of the fourth ward, praying that a poll be opened within the limits of saidward, at the city election in November next. Laid on the table. F. Harthoft, praying for the issuance of a license to retail Spirituous and malt liquors in quantities than one quart in Ward 8. Granted. C. C. Johnson, praying for the issuance of a license to retail liquors in quantitiesless than one quart in Ward 9. Granted. J. W. Green, praying to be allowed the amount of one [illegible] dollars per week for sprinkling the street in front of the Mayor’s Court rooms. Laid upon the table. H. S. Wiley, praying to be refunded the amount of $12.50 for a license taken out by him and not having used the same. Granted. Charles Wickland, praying for the assurance of a license to retail liquors (malt and spirituous) in quantities less than one quart in Ward 9. Granted. Joseph Brunet, praying for the conformation of a resolution passed on the ninth day of December, 1874. authorizing the Mayor to enter into a contract and lease to Joseph Brunet a portion of the river-walk for the purpose of erecting an ice factory. The Major under the resolution, aforesaid, which lease is, recorded in the lease book of the City on pages three and four, be and is hereby In all things confirmed. That consent is hereby given to the transfer by Joseph Brunet to R. J. Swanscoat of a third interest in said ice factory and lease. On motion the rules were suspended, the ordinance read the second time. On motion the rules were further suspended, and read the third time and passed by the following vote; Yeas Alderman Boardman, Bremond, Bruegggerhoff, Cullen, Mitchell, Robinson, and Todd, Nays—none. Reports of Officers read and disposed of. City Marshall for the month of September 1875 Referred to Police Committee. City Physicians, for the month of September 1875 Received. City Sextons for the month of September 1875 Referred to Cemetery Committee. Claims against the City presented and disposed of. Mrs. F. A. Duffau, showing a balance of $26.13 issued in favor of F. J. Duffau for $600. on January 31, 1871 by Ed. O. Horner, a former Recorder. On motion the same was laid on the table. Mrs. M. A. Hall, by W. A. Ryan, asking to be refunded the amount of $37.75 for an excess of taxes paid by error for the year 1875. On motion the same was allowed by the following vote: Yeas Alderman Boardman, Bremond, Bruegggerhoff, Cullen, Mitchell, Robinson and Todd, Nays—none. Brush, and White, for repairing Street lamps, etc. from July 5th to September 28th inclusive, amounting to $10.75. On motion the same was ordered to be paid. Alderman Brueggerhoff offered the following: Be it resolved by the City Council of the City of Austin, That the sum of four hundred dollars be and is hereby appropriated out of any money not otherwise appropriated towards purchasing supplies or the Fire department, and that the Fire Committee and chief Engineer be authorized

9! to purchase such articles, as are asked for by the Chief of the Fire Department. Adopted by the following vote: Yeas— Aldermen Boardman, Bremond, Brueggerhoff, Cullen, Seilers, [illegible], Robinson and Todd. Nays — none, Alderman Brueggerhoff introduced the following Be it resolved by the City Council of the City of Austin; That the proceeds of the lots sold to citizens of the new addition of the City Cemetery, be and are hereby set aside, as a special fund to pay and reimburse the general fund of the city for for the amount to be paid for the purchase of said ground. And it is provided further That after said amount has been paid into the general fund of the City Treasury, amounting to the purchase money of said ground, That all funds received in excess of said amounts from the sale of said lots, shall be expended on said ground to improve, and beautify the same, and shall not be used for, any other purpose. On motion the resolution, was adopted by the following vote; Yeas— Aldermen Boardman, Bremond, Brueg= gerhoff, Cullen, Mitchell, Robinson and Todd Nays — none, Alderman Brueggerhoff introduced the following, which was adopted; Be it resolved by the City Council of the City of Austin; That the Fire Committee and the Chief of the Fire Department be and are hereby authorized to locate the new Truck of Hofste and ladder Company No. 2, to rent a suitable building for said Truck, or lease suita= ble ground for same, and report location and cost of building for said Truck, if to be built by the City by next regular meeting. Alderman Brueggerhoff offered the following which was unanimously adopted: Be it resolved by the City Council of the City of Austin, That the City Marshal be hereby authorized, to have repaired, a street lamp situated on the cross of Mulberry

10 Street and Congress Avenue, and do have put up under the direction of the Street Committee, one street lamp near the Presbyterian Church, and one on the corner of Ash and Guadalupe Streets Alderman Brueggerhoff introduced the following, Be it resolved by the City Council of the City of Austin; That the penalty of ten per cent for the nonpayment of the city tax for the year 1875. be and is hereby extended to the first day of November 1875. Carried by the following vote: Yeas—Aldermen Boardman, Bremond, Brueggerhoff, Cullen, Mitchell, Robinson and Todd. Nays—none. Alderman Brueggerhoff introduced the following, Be it resolved by the City Council of the City of Austin; That the sum of eight hundred dollars or so much thereof, as may be necessary, be and is hereby appropriated out of any money in the City Treasury, not otherwise appropriated, to pay for the work on which bids have been let, for excavation of a ditch on Magnolia Avenue, and the building of a culvert on Robertson Hill.” Adopted by the following vote, Yeas—Aldermen Boardman, Bremond, Brueggerhoff, Cullen, Mitchell, Robinson and Todd, Nays—none. The following was offered by Alderman Brueggerhoff and unanimously adopted: Be it resolved by the City Council of the City of Austin; That the sum of seventy-five dollars or so much thereof as may be necessary, be and is hereby appropriated, out of any money in the City Treasury, not otherwise appropriated, for filling the fire cistern with water, on the cropping of Congress Avenue and Mulberry street. Alderman Cullen offered the following which was unanimously adopted: Be it resolved by the City Council of the City of Austin; That no person shall be permitted to vote in the next City election unless he shall have been duly registered, as a voter in said city, and that the registration office shall be kept open at the Mayor’s office until 9 o’clock P.M. on

11 The 30th. day of October, 1875. Alderman Cullen suggested the improvement of a gulley running down Lavaca Street across Live Oak Street, west of block (4), and that the matter be referred to the Street Commillee and Mayor. It was so referred. On motion of Alderman Robinson a resolu- tion passed, at a former meeting authorizing the Street Commillee to contract with Mr. A. H. Cook, Sr. for dirt to be placed, at the foot of Congress Avenue, and the amount so contracted to be placed to his credit on his taxes for the year 1875, was unanimously reconsidered, and the following resolution thereup- on, adopted to wit: Be it resolved by the City Council of the City of Austin, That the City Marshal be authorized to receive from A. H. Cook 1216. loads of gravel at 18 cents per load, in payment of certain fines, due the Mayor's Court, on Said Cook. Alderman Brueggerhoff stated That Washington Steam Fire Engine Company No 1. were contemplating to erect an Engine House and meeting rooms, at their own expense if the City would aid them, and purchase a site upon which to erect said, building; he thereupon moved that a special commillee of three be appointed to confer with Lake commillee from Washington Steam Fire Engine Co. No 1. with regards purchasing a site on which to erect said, building. Carried. Alderman Brueggerhoff, Boardman and Brueggerhoff Mitchell were appointed said, committee. Alderman Boardman moved that permission be granted to Mr. James Brown to change the Coffee Stand (on the east side) in the City Market House into a butchers Stall and that he be permitted to rent butchers meat therein up to March 1st 1876. by paying the minmum price for butcher stalls. Carried. On motion an ordinance to amend an ordinan-

12 defining the fire limits; Entitled 'An Ordinance to amend an ordinance, an ordinance defining the fire limits of the City of Austin N(64) was then up. On motion of Alderman Seamon was read the second time, On motion the rules were suspended, the ordinance read the third time, and passed by the following vote. Yeas - Aldermen Boardman, Bremond, Bruegger, Hoff, Cullen, Mitchell, Robinson and Todd Nays - none. On motion of Alderman Bremond the words "or appointment" were unanimously stricken out of the (45-t) power of the City Council of the published, amendments to the City Charter, which are, to be, submitted at the next city election. The Mayors report was, submitted, whereupon Alderman Boardman introduced the following resolution, which was unanimously adopted; Be it resolved by the City Council of the City of Austin; That the Mayor be authorized and requested, to appoint, a committee of three citizens to act in conjunction with the finance Committee, in examining the vouchers - and report of the Mayor - and that one thousand copies of said report be printed for general use, and that the amount of fifty dollars or so much thereof as may be necessary, be appropriated for printing said report.
