90 Regular Meeting Council Chamber Austin Texas April 3" 1876 Council called to order at 8:45 P. M. Mayor Mailer in the chair Roll called and the following members answered. Aldermen Bremond, Cook, James, Robinson and Sheeks. Absent, Aldermen, Chandler Soffenbaugh, Hombale, Darmon and Saylor. The Chairman announced she was no quorum present. Alderman Sheeks moved a call of the house. Call sustained and the City Marshal was directed to bring in the absent members, Alderman Darmour was brought in and answered The chair announced that a quorum was present. The Journals of the meeting from March 6" to March 27" inclusive was read and approved Alderman Cook presented a petition from L. W. Lornel, Secretary of the Colorado Foundry Co to lease for a period of Twenty five (25) years, that portion of ground known as the River Walk and extiratiee between block N" 181 and the Colorado River On motion of Alderman Bremond the petition was referred to the Mayor and Streets Committee, with fully powers to act. The Yeas and Nays being called the motion was carried by the following vote Yeas. Aldermen Bremond, Cook, James, Darmour. Nays Aldermen. Robinson and Sheeks Petition was presented from A. Heff, regulating the refunding of Twenty five (25) dollars the same being the amount paid by him to the City of Austin for license as butcher. Alderman Bremond moved, that the request of the petitioner be granted and that the mayor be authorized to draw his warrants on the City Treasurer in favor of the said Heff for the sum of Twenty five (25) dollars. 91 Alderman Shucks presented petition of James Kollinger requesting permission to peddle Poultry Egg & Butter after Market hours without paying license. Alderman Cook moved the permission be granted The Yeas and Nays being called the motion of Alderman Cook was carried by the following vote: Yeas Alderman, Bremonds Cook, James, Garmann, Robinson and Shucks. Nays, none. Petition of R H Wilson requesting permission to solicit subscriptions for Books & magazines without license for the period of one month. Alderman Cook moved the request of Mr Wilson be granted on account of him being a very old man and a sufferer The Yeas & Nays being called the motion was carried by the following vote. Yeas. Petition of J B Hotchkiss and others requesting the modification of the Ordinance prohibiting stock to run at large within certain limits. be so amended as to apply only to mischievous Cows and dry cattle. Whereupon Alderman Shucks offered the following. Be it ordained by the City Council of the City of Austin. That, Article 71° 23 of the ordinance regulatory the running at large of Cattle be amended by adding the following, Provided however that owners of Milch Cows may permit the same to run at large in any part of the City, except the fire limits, during the day time, but it shall not be lawful for such Cows to run at large within the limits first above described during the night time, nor for them at any time to be permitted to run at large within the fire limits of the City as they are now, or may be fixed by ordinance. The Yeas and Nays being called on the amendment it passed its first reading by the following vote Yeas Bremond, Cook, James, Garmann, Robinson and Shucks. Austin Texas April 3rd 1876 To the Hon the Mayor and Board of Aldermen of the City of Austin Gentlemen Your Committee to whom was assigned the duty of inspecting the Works of the City Water Company beg leave to submit the following Report. We have on several occasions witnessed the action of the Machinery, Valves. Hydrants. &c and find the entire Works fully in Conformity with the stipulations of the

93 Contract of said Company with the City, and in many individual respects. They are much in excess of the same. The quality of the Works is in all respects first Class, the capacity of the Machinery, Pipes and Hydrants. to supply the Water in sufficient quantity under the greatest pressure that could result from the location of a Reservoir on the highest. point of the City. has been proven beyond a doubt by actual trial in the presence of your Committee and many disinterested parties who are experts in the working of Hydraulic Machinery. The Machinery has been successfully worked against a pressure of over One hundred and sixty pounds to the square inch, which is over twice the pressure that could result from a Reservoir on the highest point in the City. The supply of Water to the Fire Engines of our Fire Departments has been maintained by a pressure of only Forty Six lbs per Square inch on the pipes, each of the two Fire Engines throwing two Fire Streams, and the Water Company having shown their ability to throw an equal number of Fire Streams equally well directly from the Hydrants through the same Hose and Nozzles. We feel safe in concluding that the completion of this work in our City has at least doubled the efficiency of our Fire Department. The Hydrants to the number of Forty Eight have been set and tested. the two remaining to complete the number of Fifty are in readiness and will be placed in position immediately. And in view of these facts and of the fact that the extension and enlargement of the works is now in rapid progress, Your Committee would recommend that the City Council pass a resolution accepting the works as complete in accordance with the provisions of the Contract. And requesting the Hydrants from the first day of February 1876 John H. Robinson, Samuel A. Jones, Comm Alderman Bremond moved that the report of the Committee be received and adopted, and that the Mayor. be requested to notify the President of the Water Works Co of the same. Be it Resolved by the City Council of the City of Austin, That the Mayor, Chairman of the Market House Committee, Chairman of the Police Committee and one other member of the Council (to be appointed) and the City Marshal be and they are hereby constituted a Committee with full powers to Contract for Material and to have such work done as may be necessary, to convert the City Market House into a City Prison, Mayors Court Room and Police Headquarters. That, said Committee shall let out the Contract for furnishing Material and doing the work to the lowest and best bidder, and that said Committee make the best terms practicable for the payment for the same, the dates of payment not to be a shorter time than ninety (90) days from the completion of the work The Yeas and Nays being called this resolution was adopted by the following Vote: Yeas Aldermen Bremond, James, Larmour, Robinson & Shanks Nays Aldermen Cook, Aldermen James was appointed on Committee The Mayor informed the Council that one of the City Warrants drawn in favor of the Bielty Manufacturing Company for Sixteen hundred (1500) dollars with 10% interest, for part payment of purchase money for Washington Steam Fire Engine No.1, was now due and that there was no money in the City Treasury for its payment.
