Called Meeting of City Council January 13, 1877
The Council was called to order at 1.30 P.M. Mayor Wheeler in the Chair Roll called and the following members answered, Aldermen Chandler, Deffenbaugh, Goodale James Larmore, Robinson, Roak & Taylor Absent Aldermen Bremond and Cook, Quorum found. The Mayor informed the Council that complaints had been made to him against the Capital Theatre, as being a disorderly place, that he had convened the Council for the purpose of taking such action regarding the same as they deem proper. Whereupon Alderman Taylor inx troduced the following Be it resolved by the City Council of the City of Austin, That the Capital Theatre, a place where theatrical exhibitions are made, situate in the Trohm Building on Congress Avenue in the City of Austin, is and the same is hereby declared to be a nuisance, and the City Marshal is hereby directed and required to immediately suppress all theatrical exhibitions of like character at said Capital Theatre or other theatres giving like exhibitions in this City The Yeas and nays being ordered the resolution passed by the following vote Yeas Aldermen Chandler, Deffenbaugh, Goodale James, Larmore, Robinson and Taylor x Nays Alderman Roak Alderman Cook came in and took his seat and was recorded as present The Mayor stated to the Council that there was quite a number of sick and destitute in the City and thought it necessary that some place should be provided where such persons could be properly cared for, That some arrangement should be made where the City and County Authorities could Co-operate, and that the County and City bear their proportional part of the necessary expenses, and suggested that a Committee be appointed to confer with the County Authorities with the view of using the Old Court House for Hospital purposes Alderman Taylor moved that a Committee of three be appointed for the purpose suggested by the Mayor Alderman Taylor Roak and Robinson were appointed

Larmour Robinson and Taylor Absent Aldermen Schneider and Road Quorum present The Mayor informed the council that he had called them together for the purpose of laying before them an Ordinance regulating Theatrical and other Exhibitions. which he requested them to consider and take such action as they deemed proper On motion of Alderman Deffenbaugh the Ordinance (No 87) regulating Theatrical and other Exhibitions was read and passed its first reading Alderman Taylor moved to suspend the rules and place the ordinance on its second reading. the Yeas and Nays being called the motion, & agreed by the following vote Yeas Alderman, Bremond. Cook. Deffenbaugh. Goodale. James. Larmour Robinson and Taylor. Nays None

The Ordinance was read the second time and passed to third reading. Alderman Taylor moved to further suspend the rules to put the Ordinance on its third reading The Yeas & nays being called the Motion carried by the following vote Yeas Alderman Bremond, Cook, Doffenbaugh, Goodale, James, Larmour, Robinson and Taylor. Nays, None. The Ordinance was read the third time and passed by the following vote Yeas Alderman Bremond, Cook, Doffenbaugh, Goodale, James, Larmour, Robinson and Taylor Nays, None. The Mayor called the attention of Council to the fact that as Austin was making rapid strides to become a city of considerable importance and that she being the Capital of the State he thought the Council should appoint a Committee to memorialize Congress to erect a building in this City for the U.S. Court, Post Office and other departments of Federal Government Alderman Taylor moved that a Committee be appointed Whereupon the Mayor appointed the following Committee Aldermen Taylor, Bremond, James, and Larmour p On Motion of Alderman Robinson the Mayor was added to the Committee On Motion the Council adjourned
