Austin's 1877 Street Repairs and Public Works Plans

Street improvements approved – City Engineer secured authorization to improve streets across multiple wards (1, 2, 3, 5, 6, 7, 8, and 10), with funding to hire workers for the project.

Licensing refund dispute – Truck and hack drivers who paid licenses later ruled unconstitutional by county court petitioned for refunds; the petition was referred to committee for further review.

Public well and bridge projects – Council approved plans for a public well in Ward 4 and authorized advertising for bids to construct a wagon bridge over Waller Creek on Mesquid Street.

Liquor licenses granted – Two petitions for retail liquor licenses in Wards 9 and 7 were approved, and a hospital establishment permit was granted to Dr. B.E. Hadra.

City wins lawsuit – The City Attorney reported a court victory against a defendant named Buddington, securing a judgment of approximately $300 plus $20 in costs.

331 Adjourned Meeting of City Council September 24, 1877 Council called to order at 8½ O'clock P.M. Mayor De Grus in the chair Roll called and the following members answered Aldermen Bremond. Deffenbaugh. James. Moos. Robinson Ward and Mittin Absent Alderman Cook Larmour and Taylor Quorum present The minutes of the meetings of August 21. 24. Sept 3. 6. 10. 11. 12. and 19th 1877. was read and adopted The Mayor informed the council that he had called them together for the purpose of laying before them certain petitions and reports of officers which required immediate action and to dispose of some unfinished business Petition of Patrick Scott. Andrew Major Huby Stewart and others stating that they paid license for running trucks within the city limits. and that said license had been declared unconstitutional by the county court. and asking that they be refunded the amount the amount paid by them as license At the conclusion of the reading of the above petition an alarm of fire was sounded and the council adjourned Approved Oct 1st 1877 John [illegible] City Clerk Called Meeting of City Council September 24th 1877 Council called to order at 8 O'clock P.M. Quorum present The Mayor stated that he had called them together for the purpose of laying before them the reports of the City Attorney regarding certain suits in which the City is interested, and that there were several petitions requiring the action of Council. The City Attorney reported that the case of the City Vo Buddinglon et al. that the Court of Appeals --- Page break --- 332 had affirmed the judgement of the County Court that the judgement in favor of the city amounts to about Three hundred dollars. that the costs in the case amounts to about twenty dollars. and asts that the costs be paid, that the necessary papers may issue for the collection of the judgement On Motion of Alderman Hithin the report of the city Attorney was received On Motion of Alderman James the Mayor was authorized to draw his warrant on the City Treasurer for the payment of costs as requested by City Attorney The City Attorney submitted a report in the case of Hallow and Shilly vs Ed Breary et al. the City of Austin garnishee On Motion of Alderman Taylor the report of the City Attorney was received and referred to a special Committee of three for settlement Aldermen Taylor Bremond and Hare were appointed on the Committee On Motion of Alderman Bremond the City Attorney was added to the Committee The City Attorney submitted a report in the case of the City of Austin vs Miller for running hacks without license. which case had been decided against the City in the County Court. On Motion of Alderman Taylor the report of the City Attorney was received Petition of Patrick Scott Andrew Mayors Andy Stewart and others stating that they had paid license for running hacks within the city limits, and that said license had been declared unconstitutional by the County court, and asking that they be refunded the amount paid by them as license On Motion of Alderman Hithin the petition was received On Motion of Alderman James the petition was referred to the ordinance Committee with instructions to report at Next Meeting Petition of Oscar Sullivan for license for retailing Spirituous liquors in Ward #9 On Motion of Alderman Robinson the petition was granted Petition of C.C. Williams for license for the retailing of Spirituous liquors in Ward 7No 1. --- Page break --- 333 On Motion of Alderman Robinson the petition was granted Petition of B E Hadra. M.D. for permission to establish a hospital within the city limits On Motion of Alderman Withers the petition was granted Petition of John Condon. stating that his contract with the city for furnishing oil, lighting and keeping in repair the Oil Lamps from March to December 1896. was to be paid in United States currency, and that he had received City Warrants in payment which he was compelled to dispose of at a discount and asking that he be paid the difference On Motion of Alderman Bremond the petition was referred to the Street Committee On Motion of Alderman Ward the City Attorney was added to the committee with instructions to investigate the contract and report at next meeting The City Engineer submitted a report stating that it is necessary that certain streets be improved in Wards 1.2.3.5.6.7.8 and 10 and asking that authority be granted to employ sufficient force to prosecute the work Alderman Diffenbaugh moved that the report of the City Engineer be received and referred to the Street Committee The Yeas and Nays Ordered and the motion carried by the following vote. Taylor and Ward Nays Alderman Withers Austin Texas September 2d 1871 To the Hon the Mayor and City Council of Austin Your Committee to whom was referred the petition and proposition of the Austin Gas Light Co respectfully recommend that the Contract with John Condon be extended for the term of six months Respectfully submitted Daniel G James. Carried Austin Texas September 24th 1877 To the Hon the Mayor and Board of Aldermen of the City of Austin Your Committee to whom was referred the petition of the Citizens of the 4th Ward in regard to the digging of a public well in said Ward, respectfully recommend that the same be granted and that the Mayor be authorized to advertise for bids for the same and to let the contract to the lowest and best bidder D.
