Austin's 1877 Police, Budget & Bridge Debates

Police Force Expansion & Confirmations: Council confirmed most police officer nominations but rejected two candidates. Additionally, aldermen passed a resolution to appoint two more police officers for the underserved 5th, 6th, and 7th wards due to insufficient protection.

Budget Crisis: The city treasurer reported a $1,269 deficit for upcoming bond interest payments due in New York, requesting council authorization to convert silver currency to cover the shortfall.

Bridge Construction Approved: Council passed a $2,800 appropriation to build a stone arch bridge over Valley Creek at Pecan Street and relocate an iron bridge to Cedar Street.

Market & Street Improvements: Petitions requested extended market hours (from 8am to 9am closing) and repairs to a deteriorating public well in Ward 6; council also appropriated funds for East Pecan Street improvements.

Regulatory Updates: Council passed an ordinance regulating loose animals in city limits and referred a proposal to regulate market hours to committee.

[illegible] City Clerk Regular Meeting of City Council December 8th 1874 Council called to order at 7.40 P.M. His Hon Mayor D. Abreu in the chair Roll called and the following Members answered Aldermen. Crow, Crooker. Miller Mallette. Markley. Motz Nalle. Platt. Sheehan and Strong. Absent Crow Quorum present The Journal of the last meeting was read and approved. Petitions of D.H. to Baxter. S.P. Fisher J.S. McBury and other Citizens of Ward No 6 asking for the appointment of J.H. La Rew. as Police Officer On Motion of Alderman Nalle the Petition was received and referred to the Committee on Police Petition of E. P. Haegler, D. S. Martin J. Fruitt and others. Butchers doing business in the City Market House, asking that the Hours for closing the Market House be changed from 8 Oclock A.M. to 9 Oclock A.M. Lot 2. 46 ft Ed Christian Lot 2. 23 ft J S Bernard. Lot 3 Shed 23 ft Ed Christian Lot 3. 23 ft Fred Sterzing Lot 3. East 23 ft Mc Kreusle. Lot 4 Miss Ella Carter Respectfully Ed Creary City Marshal On motion of Alderman Halle the report of the City Marshal was received The report of the City Physician for the Month of November 1877 was presented and read On motion of Alderman Millets the report was received The City Treasurer presented the following City Treasurers Office Austin Texas Dec 1st 1877 To the Hon Mayor and Board of Aldermen Gentlemen I have the honor to report that there is now due at the City Treasury and in process of --- Page break --- 373 payment Interest on City Bonds to the amount of 4450.and will be due in the City of New York on the 1 of Jany 144.45. 3 Making the aggregate the sum of $4899.00 To meet this demand there is now in the Treasury $2.25.90 of this amount there are 1332.50 in silver turned over by my predecessor, and 187.75 in silver paid in by the Assessor and Collector. The principal object of this Communication is to request some action by your honorable body to authorize the conversion of the silver into currency to make it available for the payment of interest above mentioned It will be observed that there is at present a deficit of $1269.10 to meet the rapidly maturing interest This sum will no doubt be lessened by further deposits by the Assessor and Collector, but whether a sufficient amount will be realized from that source in time to cover the sums required to be placed in New York I have no means of knowing. I therefore respectfully suggest that this subject should enlist your early attention Your Obedient Servant J W Howard City Treasurer On Motion of Alderman Miller the report of the City Treasurer was received. On Motion of Alderman Brown the report of the City Treasurer was referred to the Committee on Finance Alderman Miller, Chairman of the Committee to whom was referred the Ordinance fixing the salaries to be paid certain officers asked for further time to prepare their report. On Motion of Alderman Nalle the Committee was granted further time By Alderman Miller Be it Resolved by the City Council of the City of Austin, That the Mayor be authorized to advertise for proposals for the digesting and Codifying of the Charter and Ordinances of the City of Austin Carried Alderman Nalle moved that the bids re- ceived for the digesting and Codifying the Charter and Ordinances of the City be submitted to the City Council for final action. Carried By Alderman Miller I hereby move that the petition of James McCulloch, Contesting the seat of Alderman G F Millett on the grounds of ineligibility, which was tabled at the last regular meeting --- Page break --- 374 of the Council. be taken up and referred to a Committee with power to summons Witnesses for and in behalf of the Contestant and Contestee and report the result of their investigation to the Council at the next regular meeting thereof December 8th 1874 Alderman Markley moved the adoption of the resolution The Yeas and nays ordered and the motion was lost by the following vote it requiring a vote of 2/3 of the whole Council Yeas Aldermen Miller. The Ordinance was read Alderman Miller moved that the Ordinance be laid on the table. Markley and Shehan By Alderman Strong An Ordinance authorizing the printing of the proceedings of Council in the German language The Ordinance was read the first time only On Motion of Alderman Miller the Ordinance was referred to the Committee on printing By Alderman Markley, Whereas the 5 6 and 7" Wards have not for the past year received any benefit or protection from the Police Force of the city Therefore Be it Resolved by the City Council of the City of Austin, That the Mayor, by and with the consent of the City Council appoint Two additional Police Officers for duty in said wards Alderman Snow moved to refer the resolution to the Committee on Police. Meller Millett, Markley, Metz, Nalle, Platt Sheehan and Strong By Alderman Millett Resolved that the Fire Committee be instructed to sell and dispose of to the best advantage at as early a day as practicable the Chemical Engine now out of use, and the Old Hand Engine abandoned Five years since On motion of Alderman Crooker the resolution was adopted Alderman Platt moved that the City Attorney be instructed to investigate the title of the Old Court House property and ascertain what interest if any the City of Austin has in said property, and to report at next meeting. Carried His Hon the Mayor presented the names of the officers of the Police Force for Confirmation Aldermen Grow and Metz were appointed tellers to receive and count the votes The Officers were nominated as follows J.H. Pallerson, received 7 votes for Confirmation Against Confirmation 3 Votes, Confirmed Patrick Connelly, received 6 votes for Confirmation Against Confirmation 3 Votes Confirmed Dennis Sheehan received 9 votes for Confirmation Against Confirmation None Confirmed L.P. Hicks, received 3 Votes for Confirmation Against Confirmation 7 Votes Rejected John Damacoth received 10 votes for Confirmation Against Confirmation None Confirmed A.F. Otto received 3 Votes for Confirmation Against Confirmation 7 Votes Rejected John Shaneville received 6 Votes for Confirmation Against Confirmation 4 Votes Confirmed M.G. Wilson received received 7 votes for Confirmation Against Confirmation 3 Votes Confirmed James Simms received 5 Votes for Confirmation Against Confirmation 5 Votes, it being a tie vote His Honor cast his vote in the affirmative and the nomination was Confirmed His Honor stated that there were four more Police Officers to be confirmed and presents the names --- Page break --- 377 of pezen for council to select from to wit John Farrell. Alderman Mortz moved that in case of the number required not being confirmed on the first ballot that the name of the person receiving the lowest vote be dropped Carried On Motion of Alderman Markley. Alderman Crooker was Excused from voting. After receiving and counting the votes the following was announced as the result John Farrell received 8 Votes for Confirmation Confirmed J.H. Robinson received 5 votes for Confirmation, it requiring 6 votes to Confirm His Honor the Mayor Cast his vote in the affirmative and the Nomination was Confirmed Thos R Johnson received 8 votes for Confirmation Confirmed Thos Smith received 3 Votes for Confirmation Rejected Jas A Farrell received 6 votes for Confirmation Confirmed W.H. Robinson received 4 Votes for Confirmation Rejected Alexander Denny received 5 votes for Confirmation, it requiring 6 votes to Confirm His Hon the Mayor Cast his Vote in the affirmative and the Nomination was Confirmed His Hom called attention of council to the bad conditions of the Street leading to the Shoal Creek Ford and also stated that he had ben informed that a portion of the Street was claimed as private property Alderman Miller moved that the City Attorney be instructed to examine the titles to the property claimed and report the result of his investigation to the city Council Carried Alderman Miller moved that the Street Committee be requested to call on the County Authorities regarding the repairing of the approach to the Shoal Creek Ford Carried His Honor called attention of Council to the fact that there was quite an amount of Poll Tax on the Assessment Rolls previous to the year 1899. that they could not be collected, as the Courts had declared the tax unconstitutional. The Collector should be given authority to drop them from the Rolls and receive the proper credit, as the amount is charged against him. Also that the City Collector should be given authority to dispose of property sold for taxes and bid in by him as authorized by law --- Page break --- 378 and authorize him to settle such cases in the same manner as settled by County Collectors His Honor also requested that an Ordinance be prepared prohibiting the carrying of Deadly Weapons as the ordinance now in force was not full enough On motion of Alderman Miller the Ordinance Com was requested to prepare the necessary Ordinances as suggested by the Mayor By Committee on Streets An Ordinance authorizing the Appropriation of One hundred and twenty five dollars for Improving East Pecan Street The Ordinance was read and passed to second reading Alderman Halle moved to suspend the rules and put the ordinance on its second reading The Yeas and Nays ordered and the motion to suspend the rules carried by the following vote Yeas Aldermen Snow, Brooker, Miller, Millett Markley Metz, Halle, Platt Sheehan and Strong Nays None The Ordinance was read the second time and passed to third reading Alderman Halle moved to amend the Or- dinance by striking out the words one hundred and twenty five dollars and inserting instead the words Three hundred and twenty five dollars or so much thereof as may be necessary Alderman Miller moved that the amendment be laid on the table Carried Alderman Miller moved to further suspend the rules and put the ordinance on its third reading The Yeas and Nays Ordered and the motion to further suspend the rules carried by the following vote.
