The Journals of the Meetings of Jan 1st and 18th were read and adopted Petition of Robert Lowry for permission to peddle Apples and other fruits without license to enable him to support his widowed mother and little brothers and sisters On Motion of Alderman Millete the pet= ition was received and granted Petition of Vc Montgomery for license to retail liquors in quantities less than one quart inward 7 No 9. On Motion of Alderman Platt the petition was received and granted Petition of Denslow for furnishing Rock for macadamizing Streets On motion of Alderman Millete the petition was received and referred to Street Committee Petition of H. S. Denny for permission to cut down certain Trees that obstruct the side walk on College Avenue On Motion of Alderman Brown the petition was received and referred to Street Committee Petition of John Burrows for permission to erect a frame building on Colorado Street for a Shoemaker shop On motion of Alderman Mertz the petition was laid on the table Petition of Mrs. H. I. Horne asking for the refunding of two dollars paid by her for taxes on property not owned by her at the time of the assessment as the taxes has been paid by the present owning the property On Motion of Alderman Millete the Pet= ition was referred to the Mayor with power to --- Page break --- 396 act The City Engineer submitted the following Reports and Estimates Austin January 4th 1878 G Lowe, Esqr Chairman of St. Louis Sir I have the honor to report that upon an examination of San Jacinto Street, between Peach and Walnut Street, I find that the drainage from a ravine crosses the street about opposite the center of Block No 162 and flows in a natural channel diagonally through lots 10, 11, & 12, of said Block, much to the injury of said lots In order to remedy the evil, it will be necessary to construct a Stone wall containing about twenty perches, on the East side of the Street, and dig a ditch from this around the North West corner of the Block. The wall itself will cost about fifty dollars. The excavation of the ditch and the necessary filling will cost about fifty dollars more. I have to state that the street at this point is now in very good passable condition and that the lots referred to are not enclosed nor occupied Very Respectfully C S Anderson City Engineer On Motion of Alderman Plats the report was referred to the Street Committee Austin January 28th 1878 Col G Lowe Dear Sir At your request I respectfully submit the following estimate for two stone walls 25 feet long by 4 feet high and an average thickness of 1 foot and 9 inches: which with the paving 25 feet long by 2 feet wide and 9 inches deep will contain about 25½ Perches @ 2to City Warrants would amount to $63.75 If covered with Stone 105 Sqr feet @ 15ct 15.75 Total 79.50 This culvert is necessary at a point about opposite the Middle of Block 61 South side of East Pecan Street in order to give access to the Wagon Yard on Young --- Page break --- 397 of - Goodman and might form part of a sewer which should extend along the whole front of said Block as well as the opposite one Very Respectfully C D Anderson City Engineer On Motion of Alderman Milleto the City Clerk was instructed to advertise for proposals for doing the work by posting written notices The Report of the City Physician for the Month of January 1898 was read received The Report of the City Marshal for the month of January 1898 was read and received. Markley and Metz Nays Aldermen Nalle, Platt and Strong The Ordinance appropriating Two hundred and fifty dollars or as much thereof as may be necessary for the repairing of the approaches to East Pecan St Bridge which was read the first time Jany 4th 1848 and referred to St Committee, was taken up and read the second time Alderman Nalle moved that the ordinance be laid on the table Tie vote. The Mayor cast his vote in the negative and the motion to lay on the table was lost --- Page break --- 399 Alderman Markly moved to amend the ordinance by striking out Two hundred and fifty and insert six hundred dollars Alderman Brow moved to lay the ordinance on the table Carried Alderman Millett moved that the Street Committee be instructed to examine the bridge on back Cedar St and report as early as practicable its condition and an estimate of the probable cost of repairs Carried By Alderman N'alle, An Ordinance Appropriating Twelve hundred dollars for the building of a bridge across Muller Creek on Cedar Street The Ordinance was read Alderman Platt moved to suspend the rules and put the Ordinance on its second reading The Yeas and Nays Ordered and the motion to suspend the rules was lost by the following vote Yeas Aldermen Millett Mortz N'alle, Platt and Strong Nays Aldermen Brow, Lemothe and Markley Austin Texas February 4th 1848 To the Hon Mayor and Board of Aldermen Austin Texas Your Committee to whom was referred an Ordinance entitled an Ordinance, authorizing the Publishing of the proceedings of the City Council in the German language. Respectfully Report That in as much as the German population of this city are an intelligent and educative class of people, nearly all of whom can read English, and taking into consideration the present depressed financial condition of the City, We deem it inadvisable at this time to incur the expense of this additional publishing. Le Gons --- Page break --- 400 May City of Austin Sir In answer to your favor of Jan 26th attached hereto I beg leave to report as follows I referred your Communication to Jos A Nagle Chief of the Fire Department whose opinion in the matter you will please find on the back of your letter. I further have to say that I examined the premises personally, and it is my opinion that the occupation of the late Campbell and Dento building as a Blacksmith Shop is dangerous in regard to fire I suggest that in the event of the removal of the present wooden floor and the construction of side walls of brick or stone I could see no serious objection to its occupation for the purpose of a Blacksmith Shop. Respectfully L F Mollete Chm Fire Com T J Moarley On motion of Alderman Brewster the report was received and adopted The Austin Gas Co submittee the following To the Hon Mayor and City Council City of Austin Gentlemen I am directed by the Board of Directors of the Austin Gaslight and Coal Co to submit to you the following proposition We will run service pipes to and fit up complete for burning Gas any of your Oil Lamps on our present line Mains on either side of the Streets as you may direct, free of charge We further propose, that provided that you will increase the number of gas lamps on our present line of Mains to forty (40) being an increase of fifteen and will light extinguish and keep them in repair we will furnish said lamps with gas at the rate of $4th per thousand cubic feet Respectfully Arthur E. That the Freedom of the City be and the same is hereby tendered to the Right Worthy Grand Lodge, I.O.O.F of the State of Texas during their sojourn in this City On motion the Resolution was adopted By Alderman Plate an Ordinance providing for the Collection of Taxes in Current Money The Ordinance was read On motion of Alderman Crow the ordinance was referred to the Finance Committee Alderman Markley asked to be excused for the evening Request granted By Police Committee an Ordinance appropriating the sum of Eighty dollars and fifteen cents for the purchase of Police Equipment The Ordinance was read Alderman Millette moved to suspend the rules and put the Ordinance on its second reading The Yeas and Nays ordered and the rules were suspended by the following vote Yeas Aldermen Crow. Metz- --- Page break --- 403 Aalle Platte and Strong Nays None His Honor the Mayor stated to the Council that there was a vacancy on the Police Force caused by the resignation of Officer Jas R Farnell and presented the names of D B Withers and L P Hicks for the position and stated that the one receiving the greatest number of votes would be appointed to the vacancy Aldermen Crow and Mertz were appointed tellers Who after receiving and counting the votes announced the following. For Withers 3. For Hicks 3 and one vote No. His Honor cast his vote for L P Hicks and he was Confirmed as Police Officer By Alderman Millett, Resolved that the number of Oil Street Lamps be reduced to the number of not Exceeding 25 and that the Street Committee be authorized and directed to locate this number at such places as they may deem proper, and that the City Marshal be required to see that said lamps are kept properly lighted Alderman Platte offered the following substitute, Be it Resolved by the City Council of the City of Austin. That on and after the 15th day of February 1878, that the use of gaslights by the City of Austin, except those used in the City Hall building and the oil lamp lights on all the streets of the City except Pecan Street from Colorado Street to East Avenue, and on Congress Avenue from the Capitol fence to the Colorado River and at all bridge crossings now in use, be and the same is hereby discontinued and that the City Marshal is hereby instructed to cause Oil Lamps to be put in place of the gaslights discontinued by this resolution Substitute Lost On Motion of Alderman Platt the Resolution of Alderman Mottatt reducing the number of Oil Lamps to 25 was adopted By Alderman Plato - Be it Resolved by the City Council of the City of Austin, That the Mayor be and he is hereby authorized and directed to have sold at public Auction to the highest bidder for Cash in United States Currency on Saturday the 9th day of February A.D. 1878 at 12 Oclock --- Page break --- 40.
