Called Meeting of City Councie March 9th 1898 Councie called to order at 5:35 P.M. Mayor DeGress in the Chair Roll called and the following Members answered Aldermen Brown, Carroker, Miller, Millett, Markley, Melz, Halle, Platt, Sheehan and Strong Absent None His Hon the Mayor stated that he had called them together for the purpose of presenting to the Board certain Ordinances from the Committee on Digesting and Codifying the City Ordinances, and such other business as may be properly brought before them for their action The City Marshal submitted the following report City Marshals Office Austin Tex March 9th 1898 To the Hon the Mayor and City Councie In compliance with a Resolution passed by your Hon Body on the 28th day of February 1898 and by Notice published published by the Hon Mayor in the Democratic Statesman of the 4th inst I have the honor to report that, I executed the order of your Hon Body by selling at public Auction

at the time and place designated Two Horses three Carts and three set of Cart Harness and one Mule, Making three teams complete. One Horse, Cart and Harness was sold to Mr Carothers for $40.00 One Horse Cart and Harness was sold to Sm D Kinney for $61.00 and the mule, Cart and Harness was bid off at $105.00 by Jpu Theisen. at the close of the sale I announced that all payments for purchase must be made by 5 oclock this P.M. The purchasers of the two Horses and cart and Harnes paid at the close of the sale and I delivered the property to them. The purchaser of the Mule, Cart and Harness tendered me $40.00 in money and what he claimed to be a judgment against the City for the balance of the purchase money, as the terms of sale was for U.S. currency, I declined to accept his tender. Mr Ross McDonald has tendered me $105.00 in money the amount that the Mule, Cart & Harness was bid off for and will take them, which amount I have deposited with the City Assessor & Collector, and ask your body what action I shall take as to their delivery The proceeds from the sale of the two Horse carts and Harness amounting to 101.00 I have turned over to the City assessor and Collector and taken his receipt for same

On motion of Alderman Plate the report of the City Marshal was received — By Alderman Moller Be it Resolved by the City Council of the City of Austin that the sum of $105.00 tendered by Mr McDonald for the purchase of the Mule, Cart and Harness be accepted, and the City Marshal directed to deliver the property to Mr McDonald Alderman Moller offered the following substitute for his resolution, That the City Marshal be authorized to sell the Mule Cart and Harness at private sale for a sum not less than the amount bid at Auction which amount was $105.00 On Motion of Alderman Plate the substitute was adopted Alderman Mored that Judgment against the City in favor of John Dougherty for $60.00 which was presented in payment for the purchase of the Mule Cart and Harness
