494 Called Meeting City Council Austin, Texas April 17 18-78 Mayor Di Grass presiding. Roll called. Present Aldermen Brooker, Millett, Metz, Havens and Vaughans. There being no quorum present Alderman Millett moved a call of the council. Call sustained and the Marshall sent for the absentees. Alderman Platt and Strong appeared and answered to their names. There being a quorum present on motion of Alderman Millett the roll was suspended. His Honor the Mayor then presented a certified copy of a petition of the City Water Company to Hon. C. B. Carner Judge 16th Judicial District and also a citation to appear and answer and asked the action of the council in the premises. The petition and citation were read Alderman Millett moved that the Council go into secret session. Carried. Open session resumed Alderman Platt moved that a committee of to consist of the Mayor & two Aldermen be appointed to employ competent counsel to defend the City in the suit with the City Water Company. The motion was carried and Aldermen Platt & Millett were appointed members of the committee. It was unanimously agreed by the members of the Council present that the committee should be authorized to use their discretion in fixing the fee to be paid to the counsel so to be employed.
