Austin's 1878 Business Licenses & Street Improvements

Business licenses granted: The council approved retail liquor sales for William J. Horton, a shooting gallery for Groo & Alexander, and fruit/cake peddling without a license for Leopold Schlinger.

City attorney under investigation: Mayor reported that City Attorney S.A. Wildy abandoned his post without permission; a committee was appointed to file formal charges against him at the next meeting.

Printing contract dispute denied: The council rejected a claim from printer John D. Elliott seeking extra payment beyond city warrants, ruling he had agreed to accept warrants as full payment.

Street and infrastructure projects: Orange Street opening was referred to committee, and the mayor was authorized to seek bids for curbing and flagging work on East Pearl Street and Congress Avenue.

Record storage approved: Council appropriated $6 to purchase a trunk for storing old city records and vouchers.

550 Called Meeting of City Council Austin Texas, July 16, 1878. Mayor De Gross presiding. Roll Called. Present Aldermen Kerow. Mety. Sheehan, Strong & Vaughan. There being no quorum present Alderman Sheehan moved a call of the Council. The call being sustained by three, the Marshal was despatched for the absen- tees. Aldermen Brooker, Millett, Falle & Parrin appeared and answered to their names. Quorum present and on motion of Alderman Brooker the call was suspended. # Petition of Wm. J. Horton for retail liquor license. Granted. Petition of Groo & Alexander to open a shooting gallery. Granted. Petition of Leupolt Schlinger for permission to peddle fruit and cake without license. Granted. Petition of citizens of 5th and 6th Wards for the opening of Orange Street. Referred to Street Committee. Claim of Jno. D. Elliott with report of the Printing Committee, as follows: Austin Texas, July 9th 1878. To the Hon. Mayor and Board of Aldermen Gentlemen: Your Committee on Printing to whom was referred the petition of Jno D Elliott for the difference between City warrants & Cash on his contracts for printing with the City, have to submit the following report: After carefully and fully investigating the claim, we can best with the evidence before us recommend its payment. Submitted herewith is the affidavit of Mr. H. Dieffenbaugh. Under the evidence your committee would recommend that the petition be --- Page break --- 5:51 Not granted. Respectfully (Signed) H. M. Strong. E. Parm V. E. Vaughan. Affidavit of A. D. Offenbaugh. W. A. D. Offenbaugh being duly sworn testifies that he being at that time an Alderman of the City of Austin and a member of and Chairman of the Printing Committee of the said City of Austin deposes and says, that he as Chairman of said Printing Committee made the Contract for printing with Jno. D. Elliott, and that it was distinctly and plainly understood between himself and said Elliott that payment for said prin- ting could only be made in City Warrants. that said Elliott understood such to be the contract between himself and the City and took the contract under these conditions. On motion of Alderman Vaughan the report of the Committee was adopted. Resolution: Be it resolved by the City Council of the City of Austin that the sum of six dollars or so much thereof as may be necessary be and the same is hereby appropriated to pur- chase a trunk for the purpose of storing away old records and vouchers of the City. Read first time and on motion the rules were suspended and the resolution placed on its second reading by the following vote: Yeas Aldermen Bro[illegible] Browder, Millstte, Metz, Wall, Parm, Sheehan, Strong & Vaughan- Nays none. Crooker, Millete, Metz, Halle, Parru, Sheehan Strong & Vaughan, 9. Nays none. Alderman Platt appeared and answered to his name. Ordinance relating to Special Policemen Read second time His Honor the Mayor stated that S.A. Wildy City Attorney was absent from the City without leave and asked the action of the Council. Alderman Millett moved that the office of City Attorney be declared vacant. Lost. Alderman Crooker moved that a committee of three be appointed to prefer charges against S.A. Wildy and present the same to the City Council at its next regular meeting. Carried. The Mayor appointed as such committee Aldermen Crooker, Parru and Crow. Resolution appropriating $100.00 to pay Thos. E. Sneed for legal services rendered to the City. Read first time and motion to suspend the rules lost two thirds of a full Council not voting in the affirmative. An Ordinance regulating Licenses. Read first time and on motion the rules were suspended and the Ordinance placed on its second reading by the following vote: Yeas Aldermen Crooker, Millett, Metz, Platt, Parru, Sheehan, Strong & Vaughan 9. Nays Alderman Crow. 1. Read second time and on motion the rules were further suspended and the Ordinance placed on its third reading by the following vote: Yeas Alderman Crooker, Millett, Metz, Halle, Platt, Parru, Sheehan, Strong & Vaughan 9. Nays Alderman Crow. 1. Read third time and on motion passed by the --- Page break --- 553 following vote Yeas Aldermen Brooker, McKee, Metz, Halle, Platt, Burns, Sheehan, Strong and Vilnghant— Nays none Alderman Crow. 1. An Ordinance amending an Ordinance regulating Markets etc. Read first, second and third times and passed under a suspension of the rules two thirds of a full council voting in the affirmative. By Alderman Halle. Resolved that the Mayor be authorized to advertise for bids to put down curbing and flagging wherever needed on East Pearl Street and Congress Avenue in accordance with an ordinance heretofore passed requiring flagging and curbing to be done.
