Fire Department Reorganized: Council voted to move the engine house from the 10th Ward to the 5th Ward to save $25/month in rent, with the new building to be completed in August 1878 and operational by September 1st.

Public Health Focus: The city allocated $250 for disinfectants and established a three-person Sanitary Committee (led by the Mayor) to prevent contagious diseases, reflecting concerns about health and sanitation.

Noise Ordinance Stalled: An ordinance to regulate factory whistles—particularly ice factories blowing them at night—was introduced but tabled after failed amendment attempts.

556 Regular meeting of City Council, Austin Texas August 5: 1878. Mayor De Gress presiding. Roll Called. Present Aldermen [struck]from[/struck] Brooker, Millett, Metz, Nalle, Platt, Farm, Sheehan, Strong, and Vaughan 9S Absent Alderman Crow 1. *The following business was transacted. Petitions of A. Faggio and John Miller for retail Liquor license granted Reports of City Sexton, City Marshal, City Physician and City Attorney read and received. Report of City Attorney on petition of citizens relative to the blowing of the whistles of the Ice factories during the night was received and the City Attorney directed to draw up an ordinance on the subject. Communication of Assessor and Collector stating that Erwin and Jones lessees of the Old Mill Property refused to pay the rent on said Property on the ground that they had a Sheriffs due to said Property. Read and referred to City Attorney with authority to act. Communication from B. C. Wells in reference to the City Clock. Referred to Market House Committee. Quarterly reports of Assessor and Collector and Treasurer read and referred to Finance Committee. By Alderman Crow. Resolved That All citizens be requested to report any violation of the Health ordinances coming within their knowledge, to the City Marshal Adopted Report of Committee on Fire Department on account of Jno. T. Miller. To the Hon. Job. De Gress Mayor of the City of Austin. Dr. Sir: Your Committee on Fire Dept. to whom the --- Page break --- 557 hereto attached bill of Mr. Jno. T. Miller was referred, beg leave to make the following report. We deem the rental as named in the bill too high and in order to save the City the expense of twenty-five dollars monthly, we offer the following resolutions. Resolved by the City Council of the City of Austin, 1. That the Engine House of the Late Central Depot Fire Co. now located in the 10th ward be removed to and rebuilt on a piece of ground offered free of rental by Mr. F. [illegible] in the 5th ward. 2d. That the said engine house in the 5th ward be built under the direction of the Fire committee of the City Council and be built large enough to accommodate a hook and ladder truck and a hose carriage. 3d. That the said Engine house be built and completed in the month of August 1878 4th That on the first day of September 1878 or as soon thereafter as possible, the hose carriage of Washington Hose Co. Report of Special Committee to investi- gate charges against Sam. H. Wildy City attorney Austin Texas, Aug. 5. 1878. Hon. J. C. De Gniss. Mayor of City of Austin, Sir: Your committee to whom was referred a resolution passed at the last regular meeting of the City Council touching the absence of Sam'l H. Wildy Esq. City atty. have had the same under consideration and herewith present a preamble and resolutions as a result of their labors and respectfully recom- mend that they do pass. Respectfully submitted, (signed) E. Harm, L. M. Crooker. Whereas Sam'l H. Wildy Esq. City Atty. obtained a leave of absence from the City Council for the space of two weeks, And Whereas he has absented himself for three weeks over and above the time for which such leave was obtained And Whereas, he has not communicated with his honor the Mayor or any other offi- cer of the city officially or otherwise explaining his absence without leave, And Whereas his leave was obtained to [illegible] visit Indianola Texas and he has been heard from at Fort Worth, Fort --- Page break --- 559 Daris and El Paso, the same being in opposite directions from that portion of the State which he proposes to visit, and there are sundry and various facts and circumstances which tend to show that he does not intend to return to the city of Austin and assume the func- tions of his office - therefore - Be it resolved - By the City Council of the City of Austin, 1st That Sam't. Mildy be removed from said office of City Attorney. Resolved 2d. That in view of the fact that it is important that the office should be at once permanently filled, His Honor the Mayor is hereby requested to call a special election to fill said vacancy at the earliest practicable moment in conformity with the law regulating elections. Alderman Halle moved to amend by striking out $100.00 and inserting $50.00 Amendment adopted and on motion the rules were further suspended and the resolution placed on its third reading by the following vote: Yeas Aldermen Brooks, Millett, Metz, Halle, Platt, Parry, Sheehan, Strong & Vaughan - 9. Absent Alderman Brown; 1. Resolution read third time as amended and passed by the following vote. His Honor the Mayor stated that he desired to be absent from the city for a few days and requested the council to elect a Mayor pro tem. Nominations being de- clared in order, Alderman Strong nom- inated alderman Millett. Alderman Platt nominated alderman Parry. Alderman Parry nominated Alderman Vaughan. Alderman Halle nominated Alderman Sheehan. Alderman Vaughan nominated Alderman Platt & Brooker. Alderman Halle moved that Alderman Sheehan be elected Mayor pro tem by acclamation. Carried. His Honor the Mayor nominated T. R. Johnson as Policeman vice J.H. Patterson --- Page break --- 561 resigned. Nomination confirmed. By Alderman Hazen. Resolved that his honor the Mayor be instructed to consult with the President of the Water Company of Austin for flushing the gutters of the City every morning during the months of August and September and that he report his action in the premises at the next meeting. Adopted. By Alderman Farm. Resolved, That a Sanitary Committee of three be appointed with his honor the Mayor as Chairman, to carry out such measures as the prevention of contagious diseases may require. Resolution Adopted and the Mayor reques- -ted to call a meeting of citizens to act in conjunction with said committee and to report to the City Council. Alderman Broadley moved that the Street Committee be authorized to move the stand pipe from the front of Webb's Store on Pecan Street to a side street. On motion referred to Street Committee. By Alderman Walfe. Be it resolved by the City Council of the City of Austin, That from and after the sixth day of August until the sixth day of Novem-ber 1878 the City Physician shall receive a salary of fifty dollars per month. Read first, second and third times and passed under a suspension of the rules two thirds of a full Council voting in the affirmative. The following resolution was introduced Be it resolved by the City Council of the City of Austin that the sum of Two hundred and fifty dollars be and the same is hereby appropriated for the purchase of disinfectants to be used for the benefit of the City. After various amendments being offered none of which were adopted the Ordinance was laid on the table. A fine of one dollar was entered against Alderman Broy for non attendance.
