Regular Meeting of City Council Austin Texas December 02, 1878 Alderman Doe. Jones, presiding. Roll called. Present, Aldermen Brown, Brooker, Neillle, [illegible] Haite, Halle, Raven, Sheehan, Strong & Vaughan. Absent: Jones.
The minutes of meetings held July 4, 15, 26 and Nov 11, 12, 25 and 26 were read and approved. The following business was then transacted. Resolution appropriating $25.00 to reimburse the City Marshal for moneys paid by him to the Assessor & Collector.
Be it resolved by the City Council of the City of Austin, that the sum of $25.00 be and the same is hereby appropriated to reimburse the Marshal for money paid by him to the Assessor & Collector, for a fine, since remitted by His Excellency the Governor.
Read first time, and on motion the rules were suspended and the resolution read second and third times and passed by the following vote. Yeas Aldermen Crown, Brooker, Neillett, Moetz, Halle, Hall, Raven, Sheehan, Strong and Vaughan. Nays: None.
The following resolution was then introduced. Be it resolved by the City Council of the City of Austin. That the sum of Eight [illegible] dollars be and is hereby appropriated to pay Claborn Stovall for damages sustained to his wagon in hauling Washington Steam Engine to the fire on September 4th 1848 at C.R. Johns residence. Read first line. The motion to suspend the rules to place the resolution on its second reading was lost by the following vote. Yeas. Aldermen Brooker, Halle, Raven, Sheehan, Strong and Vaughan. 6. Nays. Aldermen Crown, Neillett, Moetz and Hall. 4.
Communication from R.A. Smith calling attention to the condition of Hickory Street, south & south west corner of Block No. 99. also suggesting south west corner of Block 99 as a suitable place for the erection of a Lamp. Referred to City Engineer and Street Committee and that the petition of citizens of the 11th Ward

for erection of lamps in said ward be reported in at the next regular meeting. Petitions of citizens of the 11th ward asking for an appropriation for the purpose of erecting a bridge at the crossing of Mesquite and Peaces Streets, now on motion referred to the Street committee. Petitions of Paul Pressler, Felix Loranes and G. N. Blood for licenses to retail liquors. Granted. Petition of City Water Co. for extension of time for lining their Reservoir until July 1st 1879. Laid on the table Communication from W. G. Leader asking for payment for publishing the Mayor's report in the Iron Age in addition to the amount already allowed for publishing the same in the Sunday Leader. Laid on the table. Reports of the City Sexton, City Marshal and City Physician for month of June 1878, were presented and read, and on motion were received and ordered filed. On motion, the petition of citizens of 5th and 6th wards for the erection of two fire plugs, and all such other petitions, were referred to the Fire committee, with the request that they investigate such matters and make such recommendations to the Council, as they may deem for the best interest of the City. The following resolution was presented. Be it resolved by the City Council of the City of Austin. That the City Engineer be instructed to make a survey for the construction of a sewer or sewers, beginning at or near the Capitol grounds and extending near and parallel with Congress Avenue Street to the Colorado river; and that the Engineer make a calculation of the probable cost to the City for the construction of said sewer or sewers, the best mode of construction &c. and make a report of the same to the City Council at its next regular meeting. and adopted. In accordance with a resolution of the City Council, your Special committee herewith submits the following resolutions. Resolved by the City Council of the City of Austin. That it is with deep regret that this body learns of the resignation of Capt. Joseph A. Nagle as Chief of the Fire Dept. of the City of Austin. 1 2d That in accepting the resignation of Capt Jos. A. Nagle, we now take occasion to express to him our sincerest thanks and gratitude as likewise that upon the part of the people of this City for the disinterested and prompt manner in which he has for the past five years discharged faithfully his duties as Chief of the Fire Department. 3d That in his retirement from the Fire Department, he takes with him the best wishes of our people as to his future welfare and success, and that the loss thus occasioned to the Fire Department although irretrievable perhaps, may be compensated in the example of so competent and good a man as Capt. Joseph A. Nagle. (Sgd) L. Mc Crooky W. E. Vaughan} Committee B. Raven. On motion the City Engineer was directed to examine into the condition of the porch in front of the Market House. The following committee report and accompanying resolutions were presented. Austin Texas Deni 2. 1878. To the Hon Mayor &d: Board of Aldermen Your committee to whom was referred the petition of Drs. J. W. McLaughlin J. J. Tobin, R. H. Swearingen and G. F. Weiselberg asking for aid and cooperation in the erection of a Hospital beg leave to report, that the County Commissioners of Travis County have

entered into a contract with the above named gentlemen for five beds per month at $25.00 per bed; we would therefore recommend that the City enter into a similar contract and herewith present a resolution and recommend its passage Be it resolved by the City Council of the City of Austin. That the Mayor be authorized to enter into a contract with Mrs. J.W. McLaughlin J.J. Tobin, R. Ho. Swearingen and G.G. Wesselbring for five beds in the City Hospital at the rate of $25.00 per month for each bed. (Sgd) W. E. Vaughan On motion the report was received. Resolution read first time and on motion the rules were suspended and the resolution placed on its second reading by the following vote. Yeas. Aldermen Crow, Crooker, Halley, Platt, Raven, Sheehan, Strong and Vaughan. 8. Nays. Aldermen Millett and Metz. Read 2nd time. Alderman Crooker moved to amend the resolution by striking out the word "five" and inserting "three" after the word "for" and before the word "beds". Motion carried. On motion the rules were further suspended and the resolution placed on its third reading as amended by the following vote. Yeas Aldermen Crow, Crooker, Millett, Metz, Halle, Plato, Raven, Sheehan, Strong and Vaughan. Nays. None. Read third time and passed by the following vote. Yeas Aldermen Crow, Crooker, Millett, Metz, Halle, Platt, Raven, Sheehan, Strong and Vaughan. Nays. None. On motion the Mayor was authorized to appoint a committee of three Aldermen to draft resolutions expressive of the sentiments of the Council on the resignation of Capt. C.S. Millett, Assistant Chief of the Fire Department. The Mayor appointed Aldermen Crow, Platt and Metz on said committee. An Ordinance regulating the blowing of Steam Engine Shuttles. Resolved by the City Council of the City of Austin. that the services and salary of the City Engineer be continued as per resolution of Octr 7th 1871. and that he be directed to make by survey a contour map of the City, for the purpose of preparing a comprehensive plan for the sewerage of the City. Read first time and on motion the rules were suspended and the resolution placed on its second reading by the following vote. Yeas. Aldermen Crow, Crooker, Hollett, Hosty, Halle, Platt, Raven, Sheehan, Strong and Vaughan. Nays. None. Read second time and on motion the rules were further suspended and the resolution placed on its third reading by the following vote. Yeas. That the Cemetery committee be instructed to see or communicate with James O'Reilly for the purposes of ascertaining at what cost can be had a certain piece of land belonging to the

said O'Reilly and lying adjoining to and south of the City Cemetery and to report such information to the City Council at its next regular meeting. Adopted. Communication from Alderman Strong relative to work and repairs needed in the 7th ward, was on motion received. Resolution. Be it resolved by the City Council of the City of Austin. That the sum of $15000 or so much thereof as may be necessary, be and the same is hereby appropriated for the purpose of putting Sabine street from the northern corporation line to the bridge over a branch of Waller creek, and to repair a gully and street at corner of Trinity and Walnut streets as per report of Street committee. Read first time and on motion the rules were suspended and the resolution placed on its second reading by the following vote. Yeas Aldermen Crow, Brooker, Hotz, Halle, Platt, Sheehan, Strong and Vaughan. 8. Nays Aldermen Millett & Raven 2. Read second time and on motion the resolution was referred to the Street committee. By Alderman Strong. Be it resolved by the City Council of the City of Austin. That the sum of Four Hundred dollars, or so much thereof as may be necessary, be and the same is hereby appropriated for repairing of, and building stone abutments to the bridge across Waller creek on Chestnut street and cutting down the hill East of said bridge. Read first time and on motion the rules were suspended and the resolution placed on its second reading by the following vote. Yeas. Aldermen Brooker, Hotz, Halle, Platt, Sheehan Strong & Vaughan 7. Resolution by Alderman, Vaughan Be it resolved by the City Council of the City of Austin that the sum of Five Hundred dollars be appropriated for the improvement and repair of the streets, bridges and crossings in the Fifthward of this City. Read first time. Ordinance. Be it ordained by the City Council of the City of Austin. That from and after the first day of January 1849, that Aldermen be allowed no compensation for attendance at meetings of the Board of Aldermen and that no fines be imposed for non attendance. Sec. 2. That all ordinances and parts of ordinances in conflict with this ordinance are hereby repealed. Read first time and on motion the rules were suspended and the ordinance placed on its second reading by the following vote. Yeas. Aldermen Crown, Brooker, Millett, Koelz, Halle, Platt, Raven and Sheehan. 8. Nays Aldermen Strong & Vaughan. 2. Read second time and on motion the rules were further suspended and the ordinance placed on its third reading by the following vote. Yeas. Aldermen Crown, Brooker, Millett, Koelz, Halle, Platt, and Sheehan.7. Nays Aldermen Raven, Strong & Vaughan. Read third time and on motion that the ordinance do now pass, the vote resulted as follows. Yeas Aldermen Crown, Brooker, Millett, Halle & Platt. 5 Nays. Aldermen Koetz, Raven, Sheehan, Strong & Vaughan. 5. The vote being a tie, the Mayor voted Nay and the ordinance therefore did not pass. Resolved. That the resignation of Capt Joseph A. Eagle, Chief of the Fire Department be accepted to take effect upon the election and confirmation of his successor and that the Mayor is hereby authorized to order an election for Chief Engineer

of the Fire Department On motion the resolution was adopted The Mayor presented the names of John Boardman and John Nelf for confirmation as Police Officers of this City, and the nominations were confirmed. Alderman Halle moved that the Mayor be authorized in his discretion, to grant persons the privilege of shooting pigeons within the City limits between certain hours such persons to be responsible for any accidents or damage that may arise therefrom. Motion carried. On motion Dr. Matthews, George Robinson and C. L. Lowday, were appointed as a committee to inspect and report on work to be done in the Eighthward On motion the Council adjourned.
