Austin's 1879 Liquor Licenses and Market Rules

Liquor and Business Licenses Approved – The council granted licenses to retail liquor for R.M. Leiber and W.F. Seltzer, and approved two butcher stalls to operate outside the designated market limits, though a petition against this decision was tabled for later consideration.

New Tax on Auctioneers – The council passed an ordinance imposing a new tax on auctioneers as part of updates to the city's licensing and occupation tax codes.

Vehicle and Animal Transport Regulations – New rules were established for licensing and taxing horse-drawn vehicles (hacks, drays, and carts) to regulate transportation services in the city.

Public Infrastructure Improvements – The council approved curbing and sidewalk improvements on two blocks of Pecan Street west of Congress Avenue, and heard a proposal from the Water Company for expanding water mains and fire hydrants (postponed for later review).

Tribute to Fire Department Leader – The council unanimously adopted a resolution honoring Captain C.F. Millett's resignation as assistant Fire Chief, praising his "indomitable courage" and service to the city.

622 Regular Meeting of City Council Austin Texas, Feby 3d 1879. Mayor De Gress presiding. Roll call. Present Aldermen [illegible], Brooker, Hubbell, Platt, Parn, Sheehan, Strong and Vaughn- Quorum Present. The minutes of the meeting of January 6th were read and approved. On motion Alderman Crow was excused from attendance. The following business was transacted. Petitions of R.M. Leiber, W.F. Seltzer for licenses to retail liquor. Granted. Petitions of B.F. Hopkins and C.T. Leath-gett to establish butcher stalls out- side of Market limits. Granted. Petition of A.D. Griffith asking the city to refund the amount of Forty dollars for two mules that were im- pounded and sold under article 84 of city ordinances. Referred to City Attorney. Reports of City Marshall, City Suptoms, City Assessor and Collector, City Physician and City Treasurer read and on motion received and orders filed. Report of Ordinance Committee on an ordinance amending section 20 of licenses and occupation taxes which is article 632 of the Revised Ordinances of the city of Austin imposing a tax on Auctioneers, offering a substitute for the original ordinance. Report received and adopted and Sub- -stitute read first time. On motion the rules were suspended and the Ordinance placed on its second reading by the following vote: Yeas Aldermen Brooker, Metz, Nolle, Platt, Parn, Sheehan, Strong and Vaughan. Nays none. Read second time and on motion the rules were further suspended and the Ordinance placed on its third reading by the following --- Page break --- 623 vot. Yeas, Aldermen Crooker, Metz, Halle, Platt, Panel, Sheehan, Strong and Vaughan. Nays none. Had third time and passed by the follow- ing vot. Yeas Aldermen Crooker Metz, Halley, Platt, Paveu, Sheehan, Strong and Vaughan. Nays none. Report of Ordinance Committee on an Ordinance to regulate the storage of Hay, Straw, Fodder &c. offering a Substitute for the original ordinances. Report received and the substitute read first second and third times and passed under a suspension of the rules two thirds of a full council voting in the affirmative Report of Ordinance Committee on an ordinance proposing to amend the Revised Ordinances of the City of Austin regarding the licensing and taxing hacks, drays carts etc. offering a substitute for the original ordinances. Report and amendments recom- mended were adopted and the Ordinance read second first time. On motion the rules were suspended and the ordinance placed on its second reading by the following vote: Yeas, Aldermen Crooker, Metz, Halle, Platt, Sheehan, Strong and Vaughan. Nays Alderman Paven. Ordinance read third time and passed by the following vote: Yeas Aldermen Crooker, Metz, Halle, Platt, Sheehan, Strong and Vaughan. Nays Alderman Paven. Report of Ordinance Committee on an Ordinance amending Article 4 for of the Revised Ordinances of the City of Austin recommending the passage of the Ordinance, Also a minority report by Alderman Strong protesting against the passage of the ordinance Reports tabled. Ordinance read first time and motion to place suspend the rules to place the ordinance on its second reading lost by the following vote: Yeas Aldermen --- Page break --- 624 Brooker, Metz, Slatt, Pann, Sheehan and Vaughan. Nays Alderman Strong. Alderman Halle was excused from further attendance at this meeting. Proposition of City Water Company for the extension of their mains and an increase of their hydrants. Laid over under the rules. The following resolution was introduced by Alderman Vaughan & unanimously adopted. Whereas Captain C. F. Millett on the 10th of October 1898, tendered the City Council his resignation as assistant Chief of the Fire Department of this City, which was accepted, and be it resolved by the City Council, That in accepting the resignation of Captain C.F. Millett we feel deeply his loss; that we deeply regret it because necessary for him to resign a position which he has so nobly filled for so long a time with credit to himself and benefit to all and be it further Resolved. That we tender Captain Millett the sincere thanks of this body and of all our citizens who have so often been saved considerable loss by the indomitable courage and fearless example of Captain Millett, who has, by the fair, impartial and noble discharge of his duty, won laurels for our fire department and honor and esteem for himself. An Ordinance directing the Curbing and flagging of the sidewalks on the two blocks of Pecan Street, immediately west of Congress Avenue. Read first, second and third times and passed under a suspension of the rules two thirds of a full council voting in the affirmative. An Ordinance amending Article 33 3 of the Revised Ordinances of the City of Austin. --- Page break --- 625 Read first, second and third times & passed under a suspension of the rules two thirds of a full council & voting in the affirmative. Resolution by Alderman Strobly. Whereas the Ballet meeting at 11:30 A.M. of this date was not in the interest of the City or at least cannot be considered directly in the interest of the City, - Therefore Resolved that the members of the Board of Aldermen shall receive no pay for said Meeting, nor shall those absent be fined for non-attendance at said meeting. Resolution adopted Petition of A. G. Puddington and others, pro-testing against the establishment of butcher or vegetable stalls outside of the market limits. On motion the petition was laid on the table. Report of Special Committee to whom was referred that part of the Mayor's message referring to public free schools in the City of Austin, recommending that the matter be laid over until after the action of the Legislature. Report received and filed. Resolution. Whereas P.J. Markley being a member of the City Council of Austin at the time of his death, and was buried on one of the lots in the Cemetery belonging to said City - Be it therefore Resolved that the Mayor be authorized and requested to make out and deliver to the widow of said Markley a deed to one half of said lot free of charge and that the same belong to her and her heirs.
