Called Meeting of City Council. Austin Texas February 19, 1879. Mayor D. G. Gries Presiding. Roll Call. Present, Aldermen Mitz, Nall, Burn, Sheehan, Strong and Vaughan — 6. Quorum Present. The following business was transacted. Vit message of His Honor, the Mayor on "An Ordinance regulating the storage of hay, straw, fodder &c. within the city limits of the City of Austin. Laid over until next meeting. Report of City Engineer & Street Committee on the Reservoir of the City Water Company stating that the same is in successful operation and is in every respect up to the require- ments of the Contract. The report was received and adopted An Ordinance amending Section 3 of Art. 305, Section 8 of Art. 309, Section 17 of Art. 318, Section 3o of Art 331, and Section 2 of Art. 338 of the Revised Ordinances of the City of Austin" together with the report of the Market House Committee recommending the passage of the same. Report adopted and the Ordinance read first time. By Alderman Raven. Be it resolved that the Committee on City Cemetery be requested to make a contract with the water Company to furnish the City water cemetery with water. Read first time and referred to the Cemetery Committee. By Alderman Raven. Be it resolved by the City Council of the City of Austin, That the Mayor be and he is hereby authorized to invite the Hon. Justice Miller of the United States Supreme Court, to visit this City. Resolution adopted. Petition of R. C. Kornber for an appropriation for account of damages sustained to his horse and carriage on East Pecan Street. Read and referred to Finance Committee.

Quorum Present. The following business was transacted. Protests of Butchers against the extension of the Market limits. Read and received. An Ordinance amending Section 3 of Art. 305, Section 8 of Art. 309, Section 19 of Art. 318, Section 20 of Art. 331, and Section 2 of Art. 338 of the revised Ordinances of the City of Austin. Read second time and on motion was laid on the table. Veto Message of His Honor the Mayor, on "An ordinance regulating the storage of hay, straw, fodder etc. within the Fire Limits of the City of Austin."- as follows: Mayor's office Austin Texas, Feby 6th 1879 To the Hon Board of Aldermen: Gentlemen: I have the honor to return herewith with my objections, "An Ordinance regulating the storage of hay, fodder, straw, shucks and other long forages. This Ordinance authorizes any person or firm to keep on hand any amount of sue hay, straw, fodder, shucks or other long forage, whether the same is baled or bunbaled and in a building provided for that purpose and so constructed or made as to reasonably protect the same from accidental fire. In my opinion that portion of the Ordi- nance which directs that hay etc. shall be kept in a building provided for that purpose etc. is too vague; and should this Ordinance, as it now stands, become a law, it will continue to work a hard- ship on the people engaged in this trade or selling those articles for their own use.

The Ordinance should state in positive terms how such buildings should be con- structed, so as to leave no doubt in the mind of any person desiring to keep on hand hay &c. within the limits of the City, in what kind of a building it may be stored. Especial care should be had as to fire protection, so as not to make insurmountable burden- some on persons who may own property near places where such hay, straw &c. may be stored.
