Austin's July 1879 Business Licenses & Bridge Repairs

Three liquor licenses granted – The council approved retail liquor license petitions from I. Conova, Reismer & Haschke, and Eddy and Smith.

Infrastructure investments approved – The city allocated $200 to repair the Chestnut Street bridge and $100+ for improvements in the sixth ward, including a new bridge across a ditch on San Jacinto Street.

Market master position eliminated – An ordinance abolished the separate market master and health inspector offices, consolidating those duties under the city marshal to save money.

City clock relocated – B.C. Wells donated his clock tower to the city and offered free labor to move the clock to the city market house (later changed to city hall), providing Austin with a public timepiece.

Municipal jobs and regulations – The council filled a city policeman vacancy (James King was hired) and established standardized liquor license expiration dates while adjusting occupation taxes, including reducing nine-pin alley fees from $500 to $50 annually.

66 Regular Meeting of City Council. Austin, July 07, 1879. Mayor De Gress presiding. Roll called. Present, Alderman Crow, Coorher Millett, Metz, Pratt, Raven, Sheehan, Strong and Vaughn. Quorum present. The following business was transacted The minutes of June 2 and June 12 were read, amended and approved. The petitions of I. Conova, Reismer & Haschke and Eddy and Smith, for retail liquor licenses, were granted. A petition from W. B. Walker for permis- sion to put up in front of his place of business, on Cedar street, a four ton scale, and also for the appointment of city- weigher, was read, and permission was granted to Mr Walker to put up the scale as prayed for in the petition. Several applications were presented for the position of city engineer and street commissioner, vice C. D. Anderson resigned. On motion of Alderman Raven, the coun- cil refused to order an election to fill the vacancy, and the mayor declared the applications to be out of order. Petitions of Mr Ruden and others asking that public water carriers be prohibited from taking water from the public well in the eight ward. Laid on the table. Petition of James H. Raymond, stating that he was about to erect a fence on his lot, No 2, in division Z of out lots, and that by so doing it would cut off the now traveled road for some sixty or seventy yards and asking that the necessary work be done by the city to straighten said road as originally laid out. Referred to street committee. Petition of Wm. Walsh & Co. for per- mission to lay planks over the sidewalk in front of their lime depot for the purpose --- Page break --- 867 of enabling wagons to cross over the same. Referred to street committee. Reports of city marshall, city sexton and city physician for the month of June, 1879 read and ordered filed. Account of G. W. Brass for $29.22 for hay furnished the city pound. On motion of Alderman Raven, the account was referred to special committee of three. The Mayor appointed as such committee Alderman Raven, Brooker and Sheehan Report of city engineer and street committee on the petition of J. Samuelson, for compensation for extra work per- performed in filling and excavating for the bridge on West Broad arc street, re- commending that the sum of $47.90 be allowed J. Samuelson for such work. Report adopted. Resolution appropriating $47.90 to pay for extra work in the second ward. Resolution read first time and on motion the rules were suspended and the resolu- tion placed on its second reading by the following vote: Yeas. Alderman Conn, Brooker, Millett Metz, Platt, Raven, Sheehan, Strong and Vaughn. Resolution read second time and on motion, the rules were further suspended and the resolution placed on its third reading by the following vote: Yeas. Aldermen Conn, Brooker, Millett Metz, Platt, Raven, Sheehan, Strong and Vaughn. Resolution read third time and on motion, passed by the following vote. Yeas. Aldermen Conn, Brooker, Millett Metz, Platt, Raven, Sheehan, Strong & Vaughn. Proposition of C. D. Anderson, late city engineer, to sell his surveying instruments to the city for $284.80 was laid on the table. --- Page break --- 668 Report of ordinance committee on "An ordinance to abolish the office of market master and health inspector," as follows. "To his Hon. the Mayor and Board of Aldermen your committee to whom was referred an ordinance repealing Act 340 sec (1) part Feb the 16th 1878 after consid-ering the same whold most respectfully recommend its passage for the following reasons." "we believe it to be a part of the legi- -tamate duties of the city marshal and that it does not [illegible] interfere with his other duties in fact the Police are charged with that duty and are health officers the night watch can unlock the mark- -et house done in the morning we belive the interest of the city would be better surved and that much saved to the city - signed R. Platt N.B. Metz. Alderman Lenow moved to adopt the report. Alderman Strong moved a call of the council. Call not sustained. On Motion of Alderman Millett the report of the committee was adopted. Alderman Conooker moved to suspend the rules to place the ordinance upon its second reading. The motion was lost, two-thirds of a full council not voting in affirmative. The following communication was received from B.C. Talls: To the Honorable Mayor and Board of Aldermen of the City of Austin: Gentlemen - I desire to present to your favorable consideration the following. In view of the fact that my lease on the building which I now occupy, and on which building I have the city clock, soon expires, I therefore respectfully sug-gest to your honorable body that you take into consideration the disposition you --- Page break --- 669 wish made of said clock. Should you wish said clock removed and placed on the city market house, and will issue an order to that effect. I will superintend the removal and erection of the same free of charge for my services. It will continue the care and oversight of said clock without any further expense to the city than my present contract calls for. And when said clock is removed to the city market house it will then be the entire property of the city, I having donated to the city all my interest in the clock tower. I am your most obedient servant. B. C. Wells. On motion, the donation to the city of the clock tower by Mr Wells was accepted and the proposition submitted by Mr Wells referred to the Market committee with power to act; and on motion, the mayor was added to the committee. The resolution appropriating $200. to repair and extend the wings to the Chest-nut street bridge was read the second -time. Alderman Lemu offered the following amendment: Amend by adding: "Provided that the amount will finish the bridge & no more be asked for." Amendment adopted. Alderman Strong moved to suspend the rules to place the ordinance upon its third reading. The motion was lost, two-thirds of a full council not voting in the affirmative. A resolution appropriating $100. or so much thereof as may be neces-sary, to complete the improvement commenced in the sixth ward was read the first time and on motion, the rules were suspended to place the resolution upon its second reading by the following vote: Yeas - Aldermen Lemu, Lemokee, Mil- -lett, Metz, Platt, Sheehan, Strong & Vaughn --- Page break --- 670 Ray - Alderman Raven Resolution read second time Alderman Conn moved to amend by adding $150 toward improving East Pecan street and putting a bridge across the ditch from Pecan to Bois d Arc on San Jacinto street". Amendment adopted. Alderman Lowther moved that the rules be further suspended to place the resolution, as amended, on its third reading. Motion carried by the following vote: Yeas — Aldermen Conn, Lowther, Millett Metz, Platt, Raven, Sheehan, String & Vaughn. Resolution read third time and passed, as amended, by the following vote: Yeas— Aldermen Conn, Lowther, Millett Metz, Platt, Raven, Sheehan, String and Vaughn On motion Alderman Vaughn was ex- cused from further attendance at this meeting. Resolution appropriating $27.50 to pay the burial expenses of J. H. Cunningham, deceased. Read first time. and, on motion, referred to a special committee consisting of Aldermen Platt, Raven, and Millett. An ordinance providing that all licenses for the sale of spirituous and malt liquors shall be issued so as to expire on the thirtieth day of September 1879. Read first, second and third times and passed under a suspension of the rules- two-thirds of a full council voting in the affirmative. An ordinance regulating licenses and occupation taxes for the city of Austin. Read first time. Alderman Raven moved that the further consideration of the ordinance be postponed until Thursday next at 8 o'clock P. M. and that when the council adjourns, it shall adjourn to that day and hour. Carried. An ordinance authorizing the Mayor --- Page break --- 671 of the city of Austin, to enter into an agreement and make a lease with Jones J. Glass for the City Mill property, the question being upon the passage of the ordinance, the same passed by the following vote: Yeas — Aldermen Conn, Barker, Millett Metz, Sheehan, and Strong. [illegible] Nays- Aldermen Platt and [illegible]. The mayor nominated for the position of policeman, vice J. R. Johnson resigned, the following gentlemen: James King, J. L. Watts, Harry Montgomery, A. Zimmer- man, M. B. Hickman, and M. J. Boree. Aldermen Platt and Raven were appointed as tellers. The ballot being taken, the follow- ing was announced as the result: For confirmation - James King 6; H. Montgomery 1; A. Zimmerman 1. Mr. James King having received a majority of all the votes cast was declared duly confirmed as policeman. An ordinance relating to licenses and occu-pation taxes read second time. Alderman Raven moved to amend by reducing the tax on nine and ten pin alleys from $500 per annum to $50 per annum. Amendment adopted by the following vote: Yeas- Aldermen Conn, Crooker, Platt, Raven Sheehan, Strong and Vaughn. Alderman Crooker moved to amend by re- -ducing the tax on lighting rod agents from $25. per annum to $10. per annum adopted by the following vote: Yeas:- Aldermen, Conn, Crooker, Platt, Raven Sheehan, Strong and Vaughn. On motion of Alderman Crooker, the rules were suspended to place the ordinance, as amended, upon its third reading by the following vote. Yeas:- Aldermen Conn, Crooker, Platt, Raven Sheehan, Strong and Vaughn. Ordinance read third time, as amended, and, on motion, passed, by the following vote. Brass for $29.22 for hay furnished the city pound, with the follow-ing report from select committee to whom the same was referred, as follows: We the undersigned, are not able to find that the city owes Mr Brass for hay. Report of street committee upon the petition of Wm. Walsh & Co, for permission to lay plank upon the sidewalk in front of their [illegible], as follows: To the Honorable Mayor & City Council: Your committee having under consid- -eration the within petition of Wm. Walsh & Co, most respectfully report that the petitioners have the privilege of taken the stone pave-ment up and put in good substantial boards, to be on a level with the stone pavement, and in the event that the wood-en crossing is removed, or when said Walsh & Co. abandon said crossing, or -cease to use the same, the petitioners bind themselves to replace with good flag stone like the present. J. Cann H.M. Strong, Street Committee. Report adopted. By Alderman Vaughn - a resolution appropriating $150, or so much thereof, as may be necessary, for the purpose of re- -moving the city clock to the city hall and putting glass dials on the same.
