Aldermen Metz and Nalle appeared and answered to their names and on motion, the call was suspended. The minutes of October 6th were read & approved. The following communication was read and ordered filed. Austin Tx. Nov 8, 1879. To the Hon. Mayor and City Council: I desire to withdraw the protests filed by me on Monday, third instant; against the counting of certain tickets mentioned in said protests. That a number of the tickets deposited in the boxes on last Monday were what may very properly be called illegal tickets, I have no doubt whatever, but I cannot think that the number was so overwhelming as the majority cast for the entire ticket that was elected, more especially so for the office of Mayor; hence, believing as I do, that a prosecution of such protests would be fruitless & perhaps, futile, I respectfully withdraw my name from such protests, and ask that they be held for naught. Very respectfully, (Signed) Joe. H. Stewart J. D. Muggly, Esq, as attorney for the Dem-ocratic Executive Committee, by permission of the Council, stated verbally to the effect that the executive committee had determined not to prosecute the protests referred to in the above communication, as they believed it would be useless, and expensive and as they believed it would probably prosecute by a different proceeding.
