Public Safety Concerns: The Mayor challenged proposed ordinances about firearms regulation and safety measures at theaters, citing cost concerns and questioning their effectiveness. City Marshal reports showed 56 arrests for carrying deadly weapons and 23 for discharging firearms over a 19-month period.

Church Access Dispute: A petition from Alderman Reichert and citizens requested that colored churches be allowed to use streets under new police regulations to prevent disturbances—referred to a special committee after a church pastor addressed council directly.

Market House Stall Investigation: A five-person committee was appointed to investigate whether market stall sales violated city ordinances, after complaints that new regulations were unfairly cutting off merchants' business.

Infrastructure Projects: The fire committee recommended authorizing the Mayor to contract with the water company to build a water trough on Robertson Hill for horses and cattle in that area.

Regular Meeting of City Council Austin Texas July 12 Council Chamber Roll called Present Alderman Reichman Poynter & Bohl Present as quorum Boardman Rorebach Sille, Platt, Robertson and Wadsworth. No quorum present. Alderman Boardman moved that the council which being duly seconded adjourn to meet this afternoon at 8 o'clock p.m. Carried. By motion of Alderman Wadsworth Seconded, the absent Aldermen were ordered to be notified to take their seats in the council Chamber Carried. Minutes of adjourned regular meeting on 30 June were read and The Mayor announced the following in committees which by resolution duly published, said election being unanimous, Alderman Platt was to be received. Ordinance Committee, J. A. Boardman F. B. Heitz, R. Platt. Police Committee J. B. Saetz, B. Reichman and J. A. Boardman. Building Committee J. W. Robertson, Platt, F. B. Selle. Finance Committee J. Tobin, R. Platt J. B. Selle Petition of Jos. Petition of Police Officer P.B. Lacy to remit fine assessed against him, by the police committee was laid on the table. Petition of Alderman Reichert, and sundry citizens, asking that the colored churches be allowed to use street police regu- lations, to be established to protect the citizens from disturbance, annoyance, was read and received. Parson Jackson of one of the above churches, wished to address the council, and permission being granted, he made a statement in regard his church, after which Alderman Watkins moved that the whole matter be referred to a special committee to report to the council. Carried. The Mayor appointed on said committee the Mayor, Alderman Reichert and Faller. Petition of I. Fallow to open a ditch in ward Nº 2, was referred to the street committee. Petition of B.P. Stovely, to have [illegible] ward, was referred to a committee of Finance, the City Attorney for the remission of his fees due, in cases 525 and 528 in Justice Court. Petition of Alderman Booker, the city Attorney was requested to draw an ordinance to provide for the same. The following communication from His Honor the Mayor, together with a report from Alderman Lakin was read, received and on motion of Alderman Reichert, referred to a special committee, composed of Alder- men Boardman, Reichert and Faller. To the Honorable Board of Aldermen, City of Austin Gentlemen, My attention has been called to the message of an ordinance repealing article 124 of the ordinances of the city of Austin. also to an ordinance amending articles 86, 87, 88 of the revised ordinances of the city. I believe the first principle of our community is to give security to life and property. --- Page break --- 107 seward, which would lead to the detection and punishment of persons who violate to an end of persons discharging fire arms in the city limits. While it has not been entirely arrested, no change for the better has taken place. So to the amendment to article 6, directing any proprietor of any theatre, concert, circus or exhibition, to employ at the discretion of the mayor, one or more suitable persons by the proprietors of the same to be approved by the mayor and with the consent of the city council, for the purpose of attending and preserving order and decorum therein, and shall be paid, not less than one dollar and fifty cents, for each exhibition, etc. There is among other objections to it, that every person has a right to pursue an occupation when not in conflict with law. A person designated by the mayor and approved by the council as suitable, and willing to follow in an employment, of that kind and nature, is among other things too expensive, for the person suggested by this amendment, and the consent of the council, to be had, before the council at a regular meeting of the council, a full day, or an extra meeting of the council will have to be called, for the appointment of the person suggested, where an appointment it would cost the city council, two meetings of the council, and the person suggested is impossible. It has been suggested that for persons to be paid a regular monthly salary of $2,50 per month, it is too much to be paid a regular monthly salary of $2,50 for all places of amusement to be under the supervision of the keeper of the place of amusement, but special officers for the purpose of keeping order in every place of amusement. And in support of this position, but only one will suffice, for the purpose of the people are aware of the fact that it would cost the city council, two meetings of the council, and the person suggested is impossible. --- Page break --- generals accompanying carrying to pur- suit the person will shall act as special officers, will simply encourage and and protect petty theft. Sir-I respectfully report that from the passage of an ordinance to secure the arrest and conviction of persons violating its articles left a "passed Nov 26. 1878, to July 1, 1888. the period of nineteen months, there were for carrying deadly weapons, 56 persons and for discharging fire arms 23 persons. In the nineteen months preceding the passage of said ordinance of viz: from May 1st 1877 to November 26th 1878, the number of for carrying deadly weapons was 56 persons and for discharging firearms 7 persons. Very respectfully, R.L. Emery, City Marshal. The following communications were read and received. To the Honorable Board of Aldermen, City of Austin. Gentlemen - Last February 16, an ordinance was passed, giving the lease of the stalls and fixing the rental price for each stall to be paid on the day of the lease and a note to be given for with good sureties to be payable at the expiration of the first three months. Before the first three months expired, more than one ordinance was passed, which had hereby cutting off a good deal of trade, which is not a fair or in any sense just. In view of these facts, I respectfully recommend. --- Page break --- 109 An ordinance be passed, for the relief of those whose who have complied with the re quired the laws. Very respectfully, Alderman Felle, moved that a committee of five aldermen, be appointed to investigate the sale of the market house stalls and report at this council, whether in said sales there has been, and is any violation of the market house ordinances, Carried. The mayor appointed on said committee Aldermen Felle, Platt, Tobin, Wahrenberger and Sheehan. A resolution appropriating the sum of $35.40 for the payment of J.W. Pilz. Resolution read first time, and on motion, the rules were suspended, and the resolution placed on its second and third reading by the following vote. Yeas. Aldermen Boardenman, Brooker, Fech, Felle, Reichman, Sheehan, Edelman and Platt. Nays. Alderman Platt. Report of street commissioner read and on motion the rules were further suspended and resolution placed on its third reading by the following vote. Yeas. Aldermen Boardenman, Brooker, Felle, Fech, Reichman, Sheehan, Edelman and Tobin. Nays. Alderman Platt. Report of city marshal showing fines in June amounting to $20 cash, $20 worked, making $40. Read & filed. Report of city engineer showing cost of street repairs in May. Read and filed. Report of city sexton showing the number of deaths in June to be 5. Ordered filed. Report of the pound master for the current month. Read and ordered filed. The following report from the city Treasurer. Read, received and ordered filed. --- Page break --- 110 of Austin: Gentlemen: Upon May the 31st 13 Patients were under care, 27 additional have been treated since, making a total of 40 treated during the month of June. Of this 26 have been cured. 3 have died. and 11 remain under treatment. 7 of the above treated at hospital have given 90 prescriptions during the month. Respectfully submitted R. L. Bibb. M. D. A petition from John W. Lane, agent Mil- Large Fire Ins. Company, to enclose his hut on lots 7, 8, and 9 in Block 8, together with report from the council commission was granted. On motion of Alderman Hall, the city at large was requested to draw up an ordinance to be revised ordi- nance or article 282 of the city of Austin. Bills of collection for the various officers, for No. 238 & 239, of the city poundmaster, was read and filed, it was ordered approved by the finance committee. On motion of Alderman Hall, the street committee. The following report from the street committee was read and received. To the City Council of Austin: Your street committee has those bills to pay in the matter before them for repair of streets. The bills attached to this report amount to $26.50 We have ordered them paid, and further recommend that in all cases, no work done by the city engi- neer be allowed to go before us. --- Page break --- 111 An ordinance appropriating money for the payment of Claim No. ordinance had first line Standing rules were suspended, and said ordinance read a second and third time, and passed by the following vote: Yeas - Aldermen Kalloch, Platt, Sheehan, Ross, Bietman, Best and Heuglin - 8. The following resolution from Ald: Best was carried: Resolved by the City Council of the City of Minnewa. That the bell of the Fire Engine house No. 3 be permitted on application from Heuglin be permitted on account of prior service rendered in taking care of a sick child. An ordinance repealing article 253 of an ordinance Read first time and referred to the Committee on fines. The following report from the fire commit tee was read and received. To the Honorable Mayor and Board of Alder men of Austin. Your committee on fire department, to whom was referred a petition of citizens of this city asking for the erection of a water trough on Robertson Hill, beg leave to report as follows: After having examined into the necessity of a trough to be located on Robertson Hill, we would recommend that an ordinance be passed authorizing the Mayor to enter into a contract with the city water company, for the speedy erection of such a trough. There is no water trough for horses or cattle living in the immediate vicinity. That if any citizen is praying for a speedy action in this matter we would ask the Respectfully, A. M. Ross I. N. An ordinance read first time and on motion to suspend the rules and place it on a second read and passed by the following vote: Yeas - Aldermen Schuetz, Feller, Pratt, Herr, Brunner, Toben, Brooker. Aldermen Boardman, Richman and Copenhagen. A resolution authorizing the City marshal Pro tem to settle his suits before closing his office. On motion of Alderman Feller, it was laid on the table. An ordinance amending article 44-12 of the revised ordinances of the city of Austin. An ordinance read first time, and on motion of Alderman Feller was referred to the ordinance committee. An ordinance recommending article 148 B of the revised ordinance of the city of Austin. Ordinance read first time. Alderman Boardman moved that the coun- cil do now adjourn until 8 P.M.
