180 Called Meeting City Hall January 15, 1881 Mayor S.M. Crocker Presiding – Roll called – Present – Alderman Boardman Duff, Melty Platt Robertson Schaen Tobin Land Wachenberger. Absent – Alderman Nalle. Quorum present. The mayor stated that he had called the council together for the purpose of canvassing the vote for alderman of the seventh ward held this day and also to take some action in reference to referre H. & T. C. R. R. Co. Alderman Melty Platt and Robertson were appointed as tellers to canvass said vote. The vote being canvassed, the canvass was declared to result. Ed. Huppertz 125; J. W. Odell 109. Mr. Huppertz having received the majority of votes cast was duly declared elected Alderman of the seventh ward. Mr. Huppertz then took the oath of office and assumed to his name. [illegible] Alderman Platt presented a petition of citizens of the Sixth Ward asking the council to grant right of way to Houston and Texas Central Railroad Company through said ward. Alderman Boardman moved that petitions be received and filed. Carried. The following report from a Special committee to whom was refered an ordinance granting The Houston and Texas Central Railroad Company right of way to cross Comprall Avenue track leads and on motion of Alderman Wachenberger was adopted.

181 To the Honble City Council of the City of Austin Your committee to whom was referred an ordinance amending articles 487 (1) 488 (2) and 489 (3) of the revised ordinance of the city of Austin beg leave to report that it recommends the passage of the ordinance with the following proviso: Provided That a board of arbitration consisting of four persons two of which are to be chosen by the Houston Central Railroad Co and two by the City Council who shall be citizens and tax payers which four shall choose a third party to act as a referee whose duty combines shall be to assess the value of damages to the property fronting on streets & down Water creek to Congress Avenue through which said railroad shall pass and which assessment shall be final and binding on the Houston Central Railroad Co. to pay to the owner of said property. Alderman Platt moved with Alderman Robertson seconding that further action in reference to the ordinance be postponed. Lost. The ordinance with the amendment of the committee was read the second time. Alderman Robertson moved to amend that the Central railroad shall plank the entire length of the road through the city. The ayes and nays being called the amendment was lost by the following vote: Ayes – Aldermen Platt Robertson Duffield and Fahrenduger. Nays – Alderman Boardman Duff Duly Linchard and Tobin –

182 Alderman Metz moved That the rule be suspended and that the ordinance be placed on its Third reading. Carried by the following vote: Yeas – Alderman Boardman, Duff, Metz, Haepperly, Sheehan, Tobin and Hahlenberger. Nays – Aldermen Platt and Robertson. The ordinance was read the Third time.
