55 Called Meeting of the City Council Austin January 31, 1882 W A Taylor – Presiding Roll call present, Aldermen Schuler Bruggarhoff Platt, Brants, Aldermen Fritz Cook Radkey Kupfertz Morter Wilson Kinney. Alderman Bruggarhoff moved a call of the Council Present Alderman Schuler Bruggarhoff Platt. Absent. Alderman Fritz Cook Radkey Kupfertz Morter Wilson Kinney. Alderman Fritz Radkey Kinney Wilson Cook Morter and Kupfertz came in and answered to their names in the above Order. The Mayor stated that the meeting was called for the consideration of Financial and Sanitary matters in regard to the Sued [illegible] and Hospital and all other matters that may be called to your attention Minutes of the Called meeting of January 7th 1882 were read corrected and adopted. Also The Minutes of the called meeting January 17th 1882 was read and adopted On Motion of Alderman Radkey Dr. Cummings was requested to read the following report. “To the Mayor and Board of Aldermen, of the City of Austin. Gentlemen: The undersigned subcommittee appointed for the purpose of conferring with your Honorable body on the subject of devising means to purchase land and erect suitable Hospital buildings by your committee composed of six members of the City Council Six Citizens of the City and six Physicians at a meeting held by said committee on the 18th inst beg leave to sub mit the following report. We are informed that the County is ready and willing to co-operate with the City in the matter of providing necessary site and buildings for Hospital and pestilential purposes. It is quite certain that the annual expenditures of money now made for the sick of the City and County can be materially lessened by the consummation of this object. The Board of health with whom we have consulted declare that there is at present and will be a future necessity for such public charities in order to protect the health and lives of our Citizens and recommend that land be purchased and that a general --- Page break --- 56 Hospital be other enclosure free from Further recommend the sum of five thousand dollars, to be purpose specified in view of the above facts the under signed committee recommend that your Honorable Body cooperate with the County in this measure and with in erecting the Hospital Called for by the board of health. We suggest. That the health board in calling our attention to this matter has referred to a subject that often will force its self upon the mind of every thought, the sense of highest feeling and sense of Philanthropy and humanity, the Example for which is already set by our sister Cities San Antonio Houston and Galveston. They both of their Hospital and Galveston by her enterprise has taken from us what we should have possessed. the medical department of the State University. We heartily concur in the recommendations of the Board of Health That the City by her representative The Honorable Mayor and Board of Alderman appropriate the sum of Five Thousand dollars. to be used in connection with the County appropriation and what can be raised by private contributions in attaining this Hospital and just honor advantage. Still Committee Austin, Texas, January 20th 1882 Alderman Bruggerhoff asked the opinion of City Attorneys of the Council levied a tax of 10 cents on the one hundred dollars. could the amount. be collected in ninety days. Alderman Cook moved That a special committee of three be appointed by the Mayor. to be known as the ways and means committee and that the matter be referred to them motion carried. The Mayor appointed as the committee Alderman Kinney, Cook and Bruggerhoff. as the committee. --- Page break --- 57 On Motion of Alderman Henry Judge Fullmon addressed the council in regard to Hospital for. County and City. On Motion of Alderman Brueggerhoff Dr. Mc Laughlin addressed the council regarding a hospital for the use of County and City jointly Petition of Peter D Martin asking that he be allowed to open a meat market on lot 1 Block 97. Congrese Council. Alderman Brueggerhoff moved that petition be granted for three months on the condition that Peter D Martin pay a license for that length of time. The ayes and nays being called for petition was granted by the following vote. Aldermen Metz, Kenney, Cook, Schuber, Brueggerhoff, Radkey, Supper, Horan, Wilson, Nay, Platt. Petition of John and Shew as agent of D Melville Asking that they be allowed to redeem lots block 9 in the City of Auville belonging to said D Melville said lot. having been sold for Taxes on July 2 1878 on motion the word Collector was struck out and the word Mayor be authorized to issue deed was substituted and Petition granted on condition that Petitioner pay all amounts due upon said land. The following is the report of the Police committee on the petition of C. W. Randolph asking to be allowed for time lost in the months of Oct and Nov. To the Mayor and board of Aldermen Your committee to was refered. the petition of C. W. Randolph would most respectfully recommend. That Petition be granted as prayed for. N. B. Metz H. W. Mc Neller R. Platt. On Motion of Alderman Brueggerhoff the above petition was granted. Report of Police committee. To his Honor the Mayor and board of Aldermen your committee to whom was refered the petition of Patrick McManamy asking for a police office of the City would most respectfully repre sent That the financial condition of the city will not. justify an increase of the Police force at this time and as there is no vacancy on the police force there for we --- Page break --- would most respectfully decline to recommend the granting of this Petition prayed for. Alderman Kinney offered the Ordinance which was read first time Be it Ordained by the City Council of the City of Austin, That Article 693 of the City Ordinances be and is hereby amended. That said article shall hereafter read as follows. Article 693. Whenever a bill, account, or other evidences of indebtedness against the City of Austin which have received the approval of the proper authorities, is presented to the Mayor he shall, if he find them correct, approve them and cause them to be placed on file and recorded by the City Clerk. But in no case shall the Mayor issue his warrant on the City Treasurer for any amount, unless an appropriation shall have been made by the City Council for that specific purpose, and unless the Mayor shall know by direct information from the City Treasurer in writing that there is sufficient monies in the Treasury to pay said warrant, exclusive of all amounts, which may have been specifically set aside by any existing Ordinance of the City Council, and in all cases, the object for which the warrant is drawn shall be stated on the face of the warrant. Alderman Kenny offered the following ordinance which was read first time Be it Ordained by the City Council of the City of Austin, That Article 696. of the City Ordinances in relation to City warrants, be and is hereby amended so that said Article shall hereafter read as follows. Article 696. Warrants may be issued for stated salaries or for accounts ordered paid by a vote of the City Council with out other approval than that of the mayor. except. that Salaries of Policemen must be certified to by the City Marshal Provided, That in all cases an appropriation therefor shall have been made by an ordinance of the City Council and that the information required in Article 673. as amended shall have been received by the Mayor. Alderman Kenny offered the following ordinance which was read first time Be it ordained by the City Council of the City of Austin That Article 698 of the revised Ordinances be and is hereby amended to read as follows. Article 698 (6) No warrants shall be drawn by the --- Page break --- Mayor, upon the Treasury of the City unless in pursuance of an appropriation made by the City Council and unless sufficient money is known to be in said the City Treasury, to pay said warrant at the time it is drawn. Sec. 2nd. Upon evidence of the violation of the foregoing section of this ordinance, it shall be the duty of the City Attorney to make complaint against the Mayor charging him with said offence to the President of the City Council who shall immediately call the Council together and place before them the complaint of the City Attorney. The President of the Council or acting Mayor shall then immediately cause a written notice of the complaint to be served on the Mayor which notice shall operate as a suspension of the Mayor from Office. The City Council shall then proceed to investigate and determine the charge preferred against the Mayor. in accordance with Article 355 of the City Ordinance. Section 3rd If the City Attorney, shall refuse or neglect to act as herein required, he shall be deemed guilty of a neglect of duty, for which he may be removed from Office in accordance with the provisions of Article 379. If the City Attorney is not aware of such refusal or neglect on the part of the City Attorney, it shall be the duty of any Alderman having knowledge of the misdemeanor herein referred to to make complaint to the President of the City Council who shall act as herein before directed. Section 4th In case of the conviction of the Mayor on the charge herein and referred to and his removal from office in consequence of said conviction and in accordance with paragraph (4) of Article 341 of the City Ordinance it shall be the duty of the President of the Board of Aldermen to order an Election for Mayor, for the unexpired term. Section 5th This ordinance shall take effect, and be in force from and after its passage. On motion of Alderman Cook the rules were suspended and the ordinance placed on its second reading by the following vote Yeas: Alderman Kenney, Cook, Schuber, Bruggerhoff, Platt, Hostler, Wilson, Rupp, Pratt, Nittig, Crew, Padkey. The Mayor presented the following names as Judges of Election to be held Feb. 11th 1883 for the extension of the limit of the debt of the City of Austin also.
