92 Regular meeting of the City Council of the City of Austin March 06, 1882 W A Sayler Mayor Presiding Roll call Present Aldermen Metz, Kinney, Cook Schuler, Bruggerhoff, Radkey, Knupfary, Statt Wilson, Korter Alderman Platt rose to a point of privilege stating that the street committee had been censured by the newspaper. He stated that all the work done by the City, by the street committee that the City had received more than value for every dollar spent and by said committee. Alderman Korter presented the petition of Charles Reicht stating that he was assessed $9300 more than his property was worth making his taxes twenty five dollars and thirty cents more than they Should be. asking that the Mayor be authorized to change his assessment. On motion of Alderman Korter the petition was granted as prayed for. Petition of J L Watts asking that he be allowed to open a Saloon in the Seventh ward on Block 168. was presented by Alderman Metz. On motion the petition was granted as prayed for. Alderman Korter was excused by the Council Alderman Metz presented the memorial of persons who had clothe and other property destroyed by order of the board of health. Alderman moved to refer to charity committee. lost On motion of Alderman Metz the Mayor appointed Aldermen Metz, Bruggerhoff, Radkey as a com mittee of three and the memorial was referred to said committee. Petition of J K Teak was presented by Alderman Wilson asking that he be allowed to open a shooting gallery on Congress Avenue on motion of Alderman Wilson the petition was granted as prayed for. --- Page break --- 93 Petition of J Whiting was presented asking that the rooms in his house and clothes of the sick be said properly and rooms being infected with small pox on motion of Alderman Rugglesoff the Petition was tabled Alderman Schubert presented the petition of Charles Treile asking that he be allowed to open a meat market on Block 89 division E. for the term of three months. Petition granted The market house committee reported favorable on the petition of H. F. Collins asking that he be allowed to open meat market on Block 35 division E. Petition was granted for three months. Petition of Dubaltzy Munger asking that they be allowed to open meat market on Block 88 fronting on Pecan street for the space of one year On motion the Petition was referred to the market house Committee. Petition of A Diefenbaugh as agent of George. Plummer asking that he be allowed to redeem lot No 4 in Block 1 division B. in the City of Austin which was sold for taxes July 8th 1878 to James J. 1878. On motion of Alderman Schubert the petition was granted on condition that Petitioner pay all costs and taxes due upon said land. Alderman Wilson presented a communication from the City sexton which stated that the Cemetery was too small and requesting that the City Council purchase twenty No C 9 R five twenty acres of land to be used as part of the City Cemetery. Also pointing out much needed improvements in the Cemetery On motion of Alderman Wilson the communication was referred to Cemetery Committee. The report of the City Marshal for the month of Feb. 1888 was received and ordered filed, the report shows fines $25.00. On motion of Alderman Remmey the rules were suspended and the ordinance placed on its second reading by the following vote yeas Alderman Motz Remmey Schuber Bruggesserhoff Platt and Wilson Alderman Radkey and Küpperitz voting no. Be it ordained By the City Council of the City of Austin That in consequence of the reduction of the Police Force by an ordinance passed on the 27th day of February 1882 The City Marshal is hereby authorized to select from the present police force such policemen as he may prefer and to fill any vacancy that may occur by resignation or otherwise Provided the number of policemen employed at any one time shall not exceed six besides the Sergeant of Police On motion of Alderman Motz the rules were suspended and the ordinance placed on its second reading by the following vote yeas Motz Remmey Schuber Bruggesserhoff Radkey Platt Wilson Küpperitz. Alderman Kinney presented the following resolution which on motion of Alderman Brueggerhoff was adopted. Be it resolved by the City Council of the City of Austin. That after the passage of this resolution no bill will be paid for work done or expence incurred in behalf of the City of Austin unless such work be ordered and expence incurred by order of the proper committee of this Council and the bills for the same properly approved. The following is the report of the ordinance committee which on motion was adopted. We the undersigned committee to whom the attached petition of H. W. H. Morler. A Platt. Alderman Kenny offered the following Ordinance which was read first time. Be it ordained by the City Council of the City of Austin Sec 1st That the Board of trustees of the Austin Public schools shall elect one of their number Treasurer who shall hold the office for the term of two years and until his successor shall be elected and qualified. Sec 2d Said Treasurer shall before entering upon the duties of his office enter into bond payable to the Mayor of the City of Austin and his successor in --- Page break --- in office in the sum of one Thousand dollars. with two or more good and sufficient sureties to or approved by the Mayor Conditioned for the faithful discharge of his duties and that he will strictly account for and pay over all monies coming into his hands as said Treasurer. Sec 3 Said Treasurer shall perform such duties as may be prescribed by the Board of Trustees of the Public Schools and shall receive such compensation as said board may designate. Sec 4. The books papers and records of the said Treasurer's office shall at all times be subjected to the examination and inspection of the said Board of Trustees Mayor and City Council of the City of Austin. Sec 5 Said Treasurer may be removed from office by a two third vote of a majority of the members of the said Board of Trustees and should the office of Treasurer at any time become vacant whether by removal of incumbant by the Board or otherwise the said Board of Trustees shall have powers to elect one of their number Treasurer who shall hold for the unexpired term. Sec 6 That the City assessor and his successors in office be and he and they are hereby authorized empowered and directed to turn over and deliver to the present Treasurer of the Board of Trustees of the Public Schools and his successors in office all monies received and hereafter to be received by him or them from collection of any special school tax levied in behalf of the Public Schools of the City from any source whatever for Public School purposes. for collecting said monies except such commissions allowed said tax assessor and shall take from said Treasurer proper receipts and vouchers. for all monies paid by him to said Treasurer. Alderman Kinnery offered the following Ordinance which was read first time, Be it ordained by the City Council of the City of Curtin Section 1st. That the City Treasurer is hereby directed to pay out of the money appropriated for the payment of back debts the 10 per cent City Warrants issued October 2d 1875 with interest thereon on request. Sec 2d. That after the payment of the above mentioned 10 per cent warrants the City Treasurer shall by public notice call in and pay in the order of their registration the 6 per cent registered City warrants to the extent of the balance on hand of the money appropriated as above referred to, and thereafter he shall repeat the call for the payment of said 6 per cent warrants whenever and as often as $5.00 shall accumulate from the revenue set apart. Sec 3d. That this ordinance shall take effect and be in force from and after its passage. On motion of Alderman Bruggesserhoff the rules were suspended and the ordinance placed on its second reading by the following vote Yeas, Kotz, Kinnery, Schubert, Bruggesserhoff, Radkey, Kuppertz, Platt, Wilson. A Resolution was offered requesting that the City of Curtin enter into an agreement with the Dover County bridge Co. to fix Congress Avenue at the approach of the Bridge. The financial condition of the City being such that the City could not have it done at this present time. --- Page break --- 101 On motion of Alderman Brueggerhoff the resolution was referred to the ordinance Committee Alderman Pratt in the Chair. Alderman Hetz Presented the following resolution Resolved that the Mayor be and is hereby granted a leave of absence for the period of thirty days. with the privilege of an extension of thirty days. to take effect from the acceptance of the same. On motion of Alderman Kinney the resolution was adopted and the Mayor granted leave of absence. Mayor in the Chair. The lease of the City of Austin to the N.M. E Church of two lots in Block no 101 of the Church reserve for the period of 99 ninety years was read and on motion of Alderman Wilson was approved and the Mayor authorized to sign the same by the Vote, Yeas Hetz, Kinney, Schwab Brueggerhoff, Radkey, Kuphut, Pratt, Wilson, Abend, Cook Edward Martin. The City attorney was instructed to draw up an ordinance for the amount of J.M. Swishers rent. of ground used for small pox Camp. On motion of Alderman Martin the Council adjourned J.G. Purnall City Clerk
