W.H. Saylor Mayor presiding Roll Call present Alderman. Kinney, Schubert, Brueggerhoff, Radkey, Moeller, Platt, Wilson. Absent Metz, Cook, Kuppertz
Motion made to call the council motion sustained and the Marshal called often absent.
On motion of Alderman Radkey the reading of of the last meetings was suspended.
Alderman Metz and Kuppertz came in and answered to their names.
Motion to adjourn Lost.
On motion of Alderman Platt the call of the council was suspended.
Alderman Brueggerhoff read the report of the special committee on the water works ordinance
Alderman Brueggerhoff moved to strike out the following from the report of the Committee motion carried And should the Water Company fail to furnish the pressure for fire as provided for in this section the said Water Company shall be held liable for all damages incurred by reason of said failure
Alderman Brueggerhoff offered the following amendment to section 8th insert after the word contract as follows not exceeding twenty five hydrants. Alderman Kinney moved to amend the word twenty five, to fifty hydrants. amendment of Kinney lost and the amend of Brueggerhoff adopted On motion the report of the committee was then adopted.

126 Alderman Kuppert’s offered the following amendment to Ord. No. 64. which was adopted by the following Vote: Yeas, Fritz, Henry, Brueggerhoff, Hoot, Pollack, Race, Schick & Kuppertz. Section 6th. Be it amended so as to read. That said City of Austill hereby agree to pay said City Water Company an annual rental of one hundred for each of said one hundred hydrants for the first five years and an annual of seventy five dollars every year thereafter for each of said one hundred hydrants.
Alderman Kuppertz offered the following amendment to section 6 which was rejected by the following Vote yeas Fritz, Huber, Kuppertz, Schilling, Nays, Kolby, Brueggerhoff, Noell, Pollack, Race about Cook. Sect 6. Be it amended so as to read. The said City of Austill hereby agree to pay said City Water Company an annual rental of seventy five dollars for each of said one hundred hydrants:
On motion of Alderman Noell the Water Work’s Ordinance was read the third time. Section 1. Granting the right for the term of twenty years to the Water Company to supply water to the City for fire protection and domestic use. Section 2. It grants said Company the right to lay mains and pipes through any City property also to erect and maintain machinery and other appliances necessary for said water Works Providing that said Company replace and make good all streets, alleys, and bridges that they may cross or make excavations in Sect 3rd Provided that the Water Company shall be liable for all damages done to persons through carelessness in the work of said Water Company in laying or repairing mains or pipes Section 4th Provides for the Capacity of the pumps of said water work and that they engines shall be of the Holly make.

Provided for the payment of one hundred dollars for hydrants per year for one hundred and fifty also later of payment of rent, the same being July, January of each year. Section 7. Provided for all extensions that the City Council may thereafter order, but not less than three (3) hydrants shall be located to the mile on said extensions for which the City shall pay fifty dollars per hydrant a year. Section 8. Provided that any citizens may erect stand pipes to any main of the City, or pipe Provided that they will not tap for any other pur pose except for extinguishment of fires, also granting the City the right to erect and connect to all hydrants to the mains for fire protection free of charge. That the test of said water work shall take place exclusively for any other completion of said Water Works Provided that the City Council shall accept said work after first meeting, after satisfactory test of said work and time performed. and time of payment of hydrants which have been erected, or may be located at that time. by notice from acceptance of said work. Sect 9. Provided that the Works shall have the capacity of discharging six fire streams from different hydrants at the same time to the height of one hundred feet. Section 10. Provided that the City shall have water free of charge, for flushing gutters and sewers. For the City Hall, the department offices of the City government, for one fountain in each park for public schools, for fifteen watering places for man of beast and for the use of the City Provided all of which the City agrees to exempt The property of the City Water Company from Municipal Taxation for the term of this contract. Section 12. Provided that the water rates to consumers shall not exceed two cents per barrel. Section 13. That the City of Austin may become the sole owner of said Water Works at the expiration ten years on the payment of the actual value of said works at that time.

Section 14. That the City of Austin shall Pay the rental of Fire Hydrants to a Trustee said Trustee to use said rental to pay interest on the bonds of said Water Company. Section 15. That the City will prevent all persons from using fire hydrants for any other purpose but for the extinguishing of fire and for such purposes as this contract specifies and this contract and that the City will make all ordinances and appropriations necessary to protect the Water Company in the privileges granted by this contract Section 16. Provides that all contracts previous made with the City Water Company, shall be void after the completion and acceptance of the Water works as specified in this contract Section 17. Authorize the Mayor of the City of Austin to sign the Contract between the City of Austin and the City Water Company Section 18. That this Ordinance take effect and be in force from and after its passage.
