A communication was received from the Board of appraisers and equalization calling attention of the Council to the fact that it was the custom of the majority of the business men of the City to assess the value of their merchandise far below its actual value, the board asked permission to sit longer and investigate the matter

163 Adjourned Meeting of the City Council Austin Texas July 8th 1857 Hon W. B. Taylor Mayor Presiding Roll call present Aldermen, Pritz, [illegible], Schubert, Borden, Platt.
On motion of Alderman Schubert the council was called and the Marshal sent after the absentee.
Aldermen Bruggert, Hoff, Kinney, Wilson Cook came in and answered to their names in due order.
On motion of Alderman Platt the Call of the Council was suspended.
The petition of J. G. Moor asking that the Council pray to him the amount of money, received by the City from the sale of horses belonging to said Moor — said horses having been sold at the City Pound — Petition referred to the City Attorney with instructions to draw up an Ordinance to cover the amount.
Alderman Platt introduced the following resolution which was adopted. Whereas the I & G. N. R. R. Company has purchased property in the City of Austin valued at [illegible] dollars and whereas they are claiming an exemption from taxation by virtue of a law passed by the Legislature exempting [illegible] property from taxation for twenty five years which law in deed and truth was not applicable to property purchased inside of the Corporation of the City of Austin. Therefore be it resolved by the City Council of the City of Austin, That the Assessor & Collector be required to levy and collect the taxes against the I & G N R R Company.
A communication was received and read from the City Sexton calling the attention of the City Council to the fact that only 3 book twenty lots remained on hand

in the City Cemetery unsold and belonging to the City and requesting that the Council make some provision for an addition to the Cemetery. Referred to the Cemetery Committee
Alderman Plath introduced the following resolution which was referred to the City Attorney and a committee of 3 aldermen. Be it resolved by the City Council of the City of Austin That the Mayor appoint a committee of three and the City attorney to inquire into the facts as to how far the different rail road Companies have violated their privilege in the Ordinance giving them the right of way and what legislation is necessary to carry out and enforce the provisions set forth in the Ordinance granting the right away to the different Rail Road Companies in the City. To report at the next regular meeting. The mayor appointed the following to the Committee Alderman Cook Plath Kinney.
Alderman Kinney introduced the following resolution which was adopted. Resolved By the City Council of the City of Austin That the street Committee has control of work upon the streets and that it is their duty to give directions as to how to and where work upon the streets shall be done. That the City Engineer and City Marshal are in this work subordinate to said Committee and that it is the duty of the City Marshal to send the City Prisoners liable to work upon the streets where said Committee shall direct either in person or by instructions given by the City Engineer.
Alderman Plath introduced an Ordinance amending article 37 section 1st of the revised City Ordinances of the City of Austin which was read and then read second and third time under suspension of the rule and on motion of Alderman Plath passed by the following vote Yeas Kinney Cook Gruber Kruggelhoof Miller Plath Wilson.
Alderman Kinney introduced an Ordinance amending an Ordinance passed July 6th 1883 granting for the expenses of the girl at Charmount $46.00

165 Sir month amendment requires the Chief of the Fire Department to furnish the City Council with a schedule of the names (of and residences) of each member and the total amount not to exceed $36.00 per month which was read and then read second and third time under suspension of the rules and passed by the following vote yeas Hoetz Kinney Cook Schuber Brueggerhoff Hoetler Plank and Wilson.
Alderman Brueggerhoff offered an Ordinance which was read permitting persons to pay their ad valorem Tax to for required to do so by law and allowing them a reduction upon the amount of their Taxes if paid by Sept 1st 5 % if paid by Oct 1st 4 % if paid by Nov 1st 3 % if paid by Dec 1st 2 % if paid by Jan 1st 1 %. The Ordinance was read second and third time under suspension of the rules and passed by the following vote yeas Hoetz Kinney Cook Schuber Brueggerhoff Hoetler Wilson & Plank.
Alderman Brueggerhoff offered a resolution to cancel the Contract between the City of Austin and W Y [illegible] and to give the printing of the Council proceedings to the Statesman for the reason that the Statesman is read by 1500 subscribers and the dispatch is not read by one fifth of the Tax payers of the City On motion of Alderman Cook the petition was referred to the printing Committee
Alderman Cook introduced an Ordinance which was read, appropriating $75.00 to pay for rent of Washington Steam Fire Engine Co No 1 for the months of April & May 1888 which was read second and third time under suspension of the rules and passed by the following Vote, yeas Hoetz Kinney Cook Schuber Brueggerhoff Hoetler Wilson Say Plank.
Alderman Hoetler introduced an Ordinance appropriating $150.00 for the Board of the horse of Washing ton Steam Fire Co No 1 which was read first time and then referred to the Fire Committee

166 that officer Cunniville did not properly account for the Collections made by him from the stands in the Market House and that the Committee report at the next meeting. The Mayor appointed the following as the Committee, Kinney, Seitz, Radkey, Schuber & Bruggerhoff.
An Ordinance was introduced repealing Section 1, of Article 33 and repealing article 335 Section 31, of the Market House Ordinance passed April 6, 1893. Motion to lay the Ordinance on the table was lost. Ordinance referred to Market House Committee.
An Ordinance was introduced regulating the salary of the City Engineer and repealing that part of Section 1 of Article 495 making the Salary of the City Engineer &c. per annum and reenacting Ordinance 495, making the salary of the City Engineer $1000. per annum. The Ordinance was read 2nd time under suspension of the. The motion to suspend the rules and place the Ordinance on its third reading was lost by the following Vote, Yeas – Seitz, Schuber, Bruggerhoff, Cook, Nordler, Blaxh Nay – Kinney & Wilson.
Alderman Kinney offered an Ordinance which was read first time. Imposing a fine of five dollars for non attendance at regular meeting and a fine of $5. for non attendance at called meeting also prohibiting alderman from drawing pay for meeting that they do not attend. The motion to lay the Ordinance on the table was lost by the following Vote. Yeas – Seitz, Schuber, Nordler, Blaxk, May, Kinney Cook, Bruggerhoff, Wilson. the vote being 9 to 6. the Mayor voted nay. The ordinance was referred to the committee of the whole.
On motion of Alderman Bruggerhoff the Council went into a committee of the whole.
