Regular Meeting of the City Council Austin Texas Sept 4th 1882 Hon W. M. Taylor Mayor Presiding. Roll call present Aldermen Huty Kinney Schriber Brueggerhoff Mohrer Clauth Luphartz Wilson Radkey absent Alderman Cook A fine of one dollar was entered against Alderman Cook for non-attendance at this meeting Minutes of the regular meeting of August 21 1882 were read and approved A petition for citizens of the 10 ward was received and read protesting against H. W. Strotter fencing the new walk in the rear of Block 184 & 184½ Petition referred to the Ordinance committee Petition of E. C. Robertsen asking that the Council allow him two days time work from sickness in the month of August 1882 Petition granted The petition of H. W. Strotter asking that the Council protect him in his lease upon the City of property south of block 184 & 184½ Petition referred to the Ordinance committee The following is the reports of City officers for the month of August 1882 Report of the City Marshal for the month of August 1882 shows fines in the Mayor Court Cash received from fines $17.50 and worked out on the streets $18.50 Report of the City Marshal as market master shows received from Vegetable stand for the month of August 1882 $33.75 Hon Mayor and Board of Aldermen of the City of Austin Gentlemen - During the month of August just passed I have made twenty six prescriptions to out cast the total number of visits made including those made at hospitals were forty seven --- Page break --- 182 Eight persons entered the hospital during the same period seven were discharged and one died. Mayor Dear Sir, I would suggest that the gutters on the Avenue and Pecan Street be flushed and and carbolic acid, be sprinkled on the same and I would likewise suggest that the alley between as the avenue hotel and iron front be cleaned also the alley between Pecan and Bois D'Arc San Jacinto and Brazos and Bowie and Trinity and Bexar there are several low places where stagnant water and are a nuisance and are impassable in wet weather there are several bad and unhealthy places in the 9th and 10 wards because there is not proper grade for the water to run off I remain yours with respect W. H. Johnson Health Inspector for 6 7 8 9 10 wards Alderman Kinney introduced an ordinance appropriating $1,856 29. The pay approved for that amount. The ordinance was read second and third time under suspension of the rules and on motion of Alderman Schubert passed by the following vote Ayes Aldermen Hutz Kinney Schubert Bruggarhoff Radkey Koeppertg Morden Clark Wilson The following is the report of the Fire Committee on a bill for the board of Washington Steam Fire Engine horse. We the Committee recommend the payment of the bill herein as we find the same correct and bring contracted prior to April 1882 W. Bruggarhoff & Radkey --- Page break --- An Ordinance was called up appropriating one hundred (and thirty) dollars and read second for the payment of money on account. For the Board of Police account, for the Board of Washington Engine Company horse. The Ordinance was read second and third time under suspension of the rules and passed by the following vote Yeas Aldermen Hertz Kinney Schuber Bruggorhoff Radkey Horten Plath and Wilson Haupertz. An Ordinance was called up and read second time appropriating $300 to pay the per diem of members of the City Council for services performed from August 2nd to November 1st 1881. The Ordinance was amended by inserting the words The amount to be paid out of the back debt fund. The Ordinance was read third time under suspension of the rules and passed by the following vote Yeas Aldermen Hertz Schuber, Bruggorhoff Radkey Haupertz Horten Plath Wilson Pnys Kinney. Report of the Fire Committee Your committee to whom was referred the first ordinance for revision respectfully recommend the passage of the within ordinance Mrs Bruggorhoff B Radkey 3 Fire Committee The Fire Committee introduced and ordinance repealing the latter part of article 197 of the revised ordinance of the City of Austin passed July 1st 1878 and providing that no person of persons shall erect and building in the City without first receiving a permit from the Mayor to erect said building and providing that no board fence inside of the fire limits shall be higher than six feet. The ordinance was read second and third time under the suspension of the rules and passed by the following vote Aldermen Hertz Kinney Bruggorhoff Radkey Haupert Horten Plath Wilson Schuber A letter was received from E. H. Holmes superintendent of the Gas Company offering the City about one hundred loads of c[illegible] of the --- Page break --- 184 City would remove the same in thirty days or the gas Co would put the dirt in the gully at the foot of congress avenue at 10 cents per cubic yard The letter was tabled An ordinance defining the market house limits and repeating section 1 of article 337 estab lishing market limits passed April 6 1887 also repealing article 337 (31) of the revised ordinance of the City of Austin was called up and read second time Alderman Platt offered the following amend ment. To strike out said “south along center line of said street to its intersection with said San Jacinto avenue” thence along center line of said street to its intersection with the center line of Pine street, thence east with the center line of said street to its intersection with said Pecan street The amendment was adopted and on motion of Alderman Radkey the vote adopting the amendment was reconsidered and the amendment rejected The motion to suspend the rules and place the ordinance on its third reading was lost by the following vote Yeas Aldermen Hertz Bruggerhoff Radkey Corbell Platt Wilson Nays Aldermen Kinney Schubert and Ruppertz The ordinance was then referred to the Chairman of the market house committee, Aldermen Platt and Kinney as a conference committee. Alderman Wilson called up an ordinance appropriating $300 to drain exontown which was read second and third time under suspension of the rules and passed by the following vote. Yeas Aldermen Hotz Kinney Schubert Bruggerhoff Radkey Ruppert Corbell Platt Wilson An Ordinance was read appropriating $400 to pay Thomas J Moore the surplus on Pecan for Lots Frome sold by the City in July 1881 The ordinance was read second and third time under suspension of the rules and passed by the following vote Yeas Aldermen Hotz Kinney Schubert Bruggerhoff Radkey Ruppert Platt and Corbell Wilson --- Page break --- 185 An Ordinance regulating the speed of Rail Road trains in the Corporation of the City of Austin at 6 miles per hour and the Crossings of congress avenue and Providing a penalty of Twenty five and not more than One Hundred dollars for each and every violation of said Ordinance was called up and read third time and passed by the following vote Yeas Aldermen Schueter Bruggerhoff Radky Kinny Horton Clark Wilson Nays Aldermen Kinny An Ordinance was introduced and read, authorizing the mayor to order an Election of the property tax payers of the City of Austin for the purpose of voting for or against the levying of a special tax of not less than ½ of one per cent to aid in the maintenance of an effective system of public free schools in the City of Austin The motion to suspend the rules and place the ordinance on its second reading was lost by the following vote Yeas Aldermen Kinny Schuber Bruggerhoff Kilpertz Wilson Nays Aldermen Nortz Radky Horton Clark Alderman Bruggerhoff introduced an Ordinance to the State of Texas the right to erect and maintain an underground sewer from the state buildings through the City of Austin to the Colorado River The ordinance was read first time and then referred to a committee of three aldermen The Mayor appointed the following aldermen as the Committee Bruggerhoff Kinny and Radky Alderman Bruggerhoff introduced the following resolution which was adopted. Resolved That the Fire Committee and the Fire Commissioners may and are hereby author ized to expend any balance from the appropriation made for the Fire department up to November 1st 1882 for such improvements on account of Fire Department as may be necessary Alderman Bruggerhoff offered an Ordinance which was read first time granting to S J Norton --- Page break --- 186 and Joseph the Capital Commissioners of the State of Texas and their successors in office the right to build and operate a rail road through the City of Austin, from any Rail Road to the Capitol and university grounds and that the right shall remain in force for six years Alderman moved that the mayor appoint a committee of three Alderman and that the ordinance be referred to them, motion Carried. The mayor appointed the following as the committee Alderman Bruggenhoff, Plath, Hupertz. Alderman Plath introduced an ordinance which was read first time Regulating the appointment of special Policeman and repealing an ordinance passed December the first 1879 amending art 447 Section (15) of the revised ordinances of the City of Austin. The ordinance was referred to the Police Committee Alderman Plath introduced an Ordinance which was read first time Authorizing the Mayor to lease to E. W. Shands and his associates the south half of City Block No 59 for the term of ten years the same to be used for market house purposes. The ordinance was referred to the Market House Committee.
