Austin Street Repairs & Union Depot Plans 1882

Compliance Enforcement: The council authorized the city to compel the Austin City Railroad Company to properly grade streets along its tracks and authorized the city to do the work itself if the company refused, billing the company for costs.

227 Regular meeting of the City Council Austin Texas November 20, 1882 Hon w v Nageon Mayor Presiding Roll call present Aldermen Kenny Lawrence Schuler Bruggenhoff Ractzkey Plath and Wilson Absent Aldermen Hertz Ruppert and Morlen A fine of one dollar was entered against Alderman Hertz Ruppert and Morlen for none attendance at this meeting. Minutes of Oct 28 and 31 Nov 6, 1888 read and approved. Alderman Kinsey introduced an ordinance appropriating $116.84 to pay approved accounts. To which amount which was read and then read second and third times under suspension of the rules and passed by the following vote yeas Aldermen Kinsey Lawrence Schuler Bruggenhoff Plath and Wilson. The following report of the City Engineer was read and then adopted and on motion of Alderman Bruggenhoff the City Engineer was authorized to have the work done and the Finance Committee was instructed to appro priate the amount asked for. Austin Texas Nov 10 1888. To the Honorable mayor and City Council of the City of Austin. I would most respectfully call your attention to the condition of Congress avenue and Pecan Street and ask an appropriation of fifty ($50) dollars to put the above mentioned streets in a passable condition also an appropriation of twenty five ($25.00) dollars to repair the street and approaches to the bridge on the extension of College avenue Between Block 50 and 56 in division B. Very Respectfully J R Lytle City Engineer --- Page break --- Alderman Kinney offered the following amendment to the Union Depot ordinance amended by adding to section fourth the following words: Said building shall be constructed of wood brick or iron or a combination of these materials and shall extend in length from Congress avenue to Colorado street. The gates or doors in the end of said building shall be kept closed except when necessarily opened for the ingress and egress of trains and passengers and such other regulations shall be observed as will promote safety and good order. Alderman Rackey moved an amendment by striking out the words six months after the passage of this Ordinance and insert and insert three months after January 1st 1883. Alderman Brueggerhoff offered the following amendment to Alderman Kinney's amendment: which alderman Kinney accepted. Provided that the D&.S.P.R. Road will permit the A. & P. W.R.R. to lay a third rail along their track to Colorado street at the expense of the A & P W.R.R. After the amendment was then adopted. Alderman Plath offered the following amendment to section 3. Provided that if the Rail Road Companies shall fail or refuse to comply with any of the conditions set forth in this ordinance it shall operate as a forfeiture of this grant. The amendment was adopted. The ordinance was then read second time, as amended. The motion to suspend the rules and place the Ordinance on its third reading was lost by the following vote: yeas Aldermen Kinney Lawrence Schuber Brueggerhoff Rackey Wilson Nays Alderman Plath. An Ordinance regulating the pay of officers of the City Government and pay for time lost by policemen from sickness and other causes was called up and read second time Alderman Kinney then offered the following amendment which accepted amends section first by adding the following. Provided that if any policeman shall --- Page break --- Become disabled by wounds or injuries received in making arrests the City Council may grant an allowance for time lost in consequence of such disability. Motion to suspend the rules and place the ordinance on its third reading, was lost by the following Vote. Yeas Aldermen Kinney, Bruggerhoff, Laurence & Schuber, Wilson Nays Aldermen Rookey Clark. Alderman Kinney offered the following resolution which was adopted. Resolved, by the City Council of the City of Austin That the revenue derived from the sale of Cemetery Lots shall be hereafter set a park as a special fund to be applied to the payment of Cemetery expenses only. Including the salary of the City Sexton and that the surplus revenue over and above the current expenses of the Cemetery shall be applied either to the improvement of the Cemetery grounds or to the purchase of land for Cemetery purposes as the City Council may grant from time to time direct. Alderman offered an ordinance which was read, appropriating $600 for the purpose of building a bridge at the crossing of Colorado and Peach Street Alderman Bruggerhoff moved in lieu of the ordinance that the Street Committee have the bridge built and that the Finance Committee appropriate the required amount in the next general appropriation motion adopted. Alderman Bruggerhoff introduced the following resolution. Resolved by the City Council of the City of Austin. That the Mayor and Street Committee are hereby instructed to notify in writing to the owners of the Austin City R.R. Co. to grade up the streets and crossings on both sides of said R.R. is now operating in compliance with article 480. of the ordinance of the City requiring them to keep said streets in as --- Page break --- good order as was granted to them Be it further resolved that if said Austin Rail Road Company, refuse or neglect to grade up said track as now operated to the satisfaction of the street committee the work shall be done by the City and the street committee is hereby authorized to have said work done. The cost thereof to be taxed against said street Rail Road Company and be recovered by the City assessor and Collector or any other way against property. Alderman Brueggerhoff offered the following resolution which was adopted Resolved by the City Council of the City of Austin. That the mayor and the street com- mittee are hereby authorized and required to advertise in the daily Dispatch and Daily Statesman for the construction of all Stone pavements and curb stones in front of all Buildings and lots The owners thereof or agents who have on that day, refused to have said pavements or side walks Built and made as required by ordinance Article 817. 818 and 824 of the ordinances of the City. That said work shall be let to the lowest and most responsible lowest bidder and said work to be done with least possible delay That the Cost of said work shall be recovered of agents or owners of said premises as required and provided for in Art 814 of the City ordinances Alderman Brueggerhoff offered the fol- lowing resolution which was adopted Resolved by the City Council of the City of Austin. That the mayor and the street committee be and hereby requested to advertise for bids to repair the ditch at the foot of Congress avenue and to fill up the same for public safety That said bids shall be opened by the street committee in the presence of the Mayor on the fifteenth day of December or at an earlier day and submit said bids with their recommendations to the City Council at the first meeting after opening of said bids. --- Page break --- 231 a communication was received from E. W. Shands stating that the parties whom he represented (who wished to build a general Market on Block 59) could not accept the terms as offered to him in an ordinance passed by the City Council granting to him a lease of said Block 59. An ordinance was also offered and read first time leasing to E. W. Shands and his associates south half of Block 59. for the purpose of erecting a general market house. on said Block. The ordinance was referred to the Market house committee. The communication was received and ordered filed. On motion the Council adjourned Dec 4 1882 Read and approved December 4 1882 S. L.
