Capitol Syndicate Gets Railroad Rights: City Council approved a railroad track for transporting construction materials to the new state capitol, with protections ensuring the rights revert to the city if construction is abandoned or contracts fail.

Union Depot Approved on Cypress Street: Council authorized construction of a railroad depot for the I&N Railroad on Cypress Street between Congress and Colorado, with a minimum $15,000 building requirement.

Sewer Project & Police Expansion: Council allocated $675 for 78 feet of sewer work at Congress Avenue and approved adding one police officer to the force to supervise prisoners.

Street Lighting Contract: City authorized lighting up to 40 lamps on Congress Avenue and Pecan Street at $7 per lamp monthly through the Austin Hose Light and Coal Company.

Public Concerns on Railroad Routes: Residents petitioned against granting Capitol Syndicate rights-of-way on College Avenue, though the council ultimately passed the ordinance.

246 Called meeting of the City Council Austin Texas Jan 6. 1883 Hon W.A. [illegible] Mayor Presiding Now call present Aldermen Lawrance Bruggeschoff Roesler. Placky Wilson Hent Aldermen Aldermen Kuppery. Hunry Scheber. and Rodney Metz. On motion of Alderman Platt the Council was called and the Marshal sent after the absenter. Aldermen, Henry Kuppery Scheber. and Rodney came in and answered to their name On motion of Alderman Platt the call of the Council was suspended On motion of Alderman Bruggeshof the reading of the minutes of a previous meeting was postponed A Petition was received from Mss Ella Ruel and Mss Virginia Shoulding protesting against the City Council granting to Abner Taylor or the Capitol Syndicate the right of way on college avenue for a rail road track. The petition was received and ordered filed The following is the report of the City Physician for the month of December 1882. Hon Mayor and Board of Aldermen of The City of Austin Gentlemen During the month of Dec 1882 I made in behalf of the City fifty six daily visits at the City Hospital included patients not in the Hospital twenty seven prescriptions At the date of my last report seven cases remain in Hospital under treatment since which time six additional were received. Of this number seven have been discharged four and and five are on our hands under treatment Respectfully submitted J Gummings City Physician Austin Texas Dec 31st 1882 --- Page break --- 247 Report of the City Marshal for the month of December 1882 show no of arrests 169. Amount of fines collected from in cash $94.50. Fine worked out $7.50. Total fines $102. Two horses impounded and both redeemed. The City Sextons Report for the month of Dec 1882 show total deaths for the month 20 white 10. Colored 8. Mexican 2. Females, male 12. Alderman Brueggerhoff introduced the following resolution Be it resolved by the City Council of the City of Austin That the Mayor be authorized and instructed to award the Contract to the lowest bidder for seventy eight feet (78) of the sewer. at the foot of Congress Avenue as shown by bids received on December 18th 1882 and the Finance Committee are hereby instructed to report an ordinance appropriating the sum of six hundred and seventy five dollars ($67500) for the payment of the same The motion to postpone action on the resolution until next monday was lost by the following vote Yeas aldermen Henney Schubert Heippertz, Mays aldermen Lawrence Brueggerhoff Radky Moeller Platt and Wilson The resolution was adopted by the following vote. The following is the report of the ordinance committee to whom was refered the ordinance with amendment committed on the Union Depot ordinance which was adopted Hon. W.H. Saylor and Board of Aldermen of the City of Austin The undersigned members of the Ordinance Committe to whom was referred the the Union Depot building ordinance with amendment most offer the accompanying substitute which embodies said ordinance and all amendments and recommend the adoption and passage of said substitute. Company the right to erect a depot building The substitute granted to the I. & N. and other rail Roads the right to erect a Depot building on that part of Cypress Street lying between Congress Avenue and Colorado Street The ordinance was read. Alderman Metz came in and answered to his name. Alderman Bruggerhoff offered the following amendment to the union Depot ordinance which was adopted. Provided that any other Rail Road here after running in the city of Austin shall have the consent of the City Council to the privilege of this grant with the consent of the Railroad Companies herein instructed on the completion of said Depot building. Alderman Plath offered the following amendment to the Depot ordinance To amend section 2. on third line and after the word material and said building shall not cost less than fifteen thousand dollars The amendment was adopted by the follow ing vote yes aldermen Lawrence Bruggerhoff Finney Metz, Wilson, Nayo alderman Plath Schuber, Huppertz and Moeller, it being a tie vote the Mayor voted yes. Alderman Radkey offered the following amendment to the Depot ordinance amend section 3rd. That the center of said Depot building shall be in the center of said railroad longwise the amendment was adopted The ordinance was then read third time under suspension of the rules, and passed by the following vote Yes aldermen Finney, Metz, Schuber Bruggerhoff, Radkey, Huppertz, Moeller, & Wilson No. Nayo alderman Plath The ordinance committee introduced an Ordinance repealing Section 4. of an ordinance entitled an ordinance regulating the licenses and occupation tax of the City of Austin passed --- Page break --- 249 July 1883. and enacting an ordinance regulating and licensing livery and fare stables and vehicles let for hire. The ordinance was read second and third time under suspension of the rules and passed by the following vote Yes Aldermen Sgatz St. Cy Lawrence Schultz Brugggerhoff Plath Rodkey Morian Penitz Wilson An Ordinance regulating pay on Hotels and Boarding house was introduced and read first time and then referred to the Ordinance Committee A communication was received from J H Collett stating that the Quarthermarket House lot could be bought from its present owner for Five thousand dollars. The communication was referred to the Market House committee. The following report was received from the police committee on the request of Marshal Kirk asking for an increase of the police force The report of the committee was adopted. To the Hon. Mayor and Board of Aldermen. The undersigned members of the police committee to whom the above request was referred beg leave to report that we consider it necessary under the circumstances to increase the police force by one officer and request the adoption of this report and the appointment of the said one officer who shall be qualified to superintend the work of the prisoners where duty it shall be to attend to this work Respectfully H. W. Moeller R Plath Police Committee The following is the report of the Charity committee on letters from Mrs E. C. Peltzer in regard to the city hospital Respectfully reported back without action as we consider the petition of a private nature over which we have no jurisdiction Respectfully J Schubert M.D. Brugggerhoff W. Wilson Charity Committee --- Page break --- Alderman Rinney called up an ordinance granting to the contractors of the new state capital, Messrs Taylor and Sacy syndicate, the right to build and operate a rail road track from the intersection of the Houston and Texas Central and Austin and northwestern Rail roads, with East Avenue and along said avenue to College Avenue and thence along College Avenue to College Avenue to Brazos Street and thence along said Street to the Capital grounds, for the purpose of transporting building material to be used in the construction of the new state Capital. The ordinance was read second time. The ordinance was then amended by filling in the blank the word Ten on line fifteen of section two and after the words, The sum of. Alderman Brueggerhoff offered an ordinance as a substitute for the ordinance granting to the Capital syndicate the right of way on College avenue and East avenue, The ordinance was read. Alderman Haupertz moved to lay the substitute ordinance on the table. Motion carried by the following vote: Yeas aldermen, Metz, Rinney, Schuber, Bradley, Haupertz and Thornton. Nays aldermen Laurance Brugggerhoff Black and Willson. Alderman Rinney offered the following amendment to the right of way ordinance. Amend by changing section 6 to section 7 and introducing as Section six the following. The right and privileges granted by this ordinance are gratuity to the contractors for building the State Capital as herein mentioned and said right and privileges shall not be sold or transferred to any other parties therefore if the contractors for building said Capital now existing between the Capital Syndicate and the State of Texas shall at any time before the completion of said Capital Building, be annulled then at the same time the right of way with all of its privileges as herein granted shall be null and void and this ordinance shall no longer be in force and it is further provided that at any time said Capital contractors shall fail to observe the conditions of this ordinance then such failure shall operate as a forfeiture of this grant herein made. --- Page break --- 251 Alderman Brueggerhoff moved to lay the amendment on the table. The motion was lost by the following vote. Yeas Aldermen, Lawrance Brueggerhoff Platt and Wilson Nays Aldermen Metz Kinney Schuber Radkey Kupperty and Moeller. The amendment was adopted by the following vote. Yeas Aldermen Metz Kinney Lawrance Schuber Radkey Kupperty Moeller and Wilson Nays aldermen Brueggerhoff and Platt. The ordinance was then read third time under suspension of the rules and passed by the following Vote Yeas Aldermen Metz Kinney Lawrance Schuber Brueggerhoff Radkey Kupperty Moeller and Wilson nays Alderman Platt Alderman Moeller offered the following Resolution Be it Resolved by the City Council of the City of Austin That the mayor be and is hereby authorized to contract with the Austin hose light and coal Company to light Congress Avenue and Pecan street not exceeding forty lamps for the period of thirty months commencing at once or as soon as the contract can be made at a price not to exceed $4 per month per lamp. The resolution was amended by striking out the word "four" and inserting the word "7 per month". The resolution as amended was then adopted The street committee was instructed to designate such lamps as were to be lighted under this resolution. A petition was received from sergeant Cranwell asking the council to grant him leave of absence to go to Sanantonio as he was under Bond to appear then as a witness. Leave of absence granted. The City Marshal was authorized to sell the street oil lamps to such citizens as may want them for the purpose of using them to light the street.
