Austin Budget Debate & Street Obstruction Rules 1884

Saturday, April 26, 1884 special called

Major Debt Payment Approved – The city council authorized $18,000 to pay interest and principal on a debt to a New York creditor, with repayment expected once city bonds are sold.

Street Obstruction Dispute – Property owners on Congress Avenue and Pecan Street petitioned against street obstruction rules. The council suspended enforcement and created a special committee to review and potentially modify the ordinance.

City Bonds Authorization – Council approved authorization for $125,000 in 6% municipal bonds to fund city projects and debt management.

Water Infrastructure Expansion – An ordinance was introduced to plan the location and installation of water hydrants west of Rio Grande Street, referred to the finance committee for review.

Attorney Fee Policy – The council formally allowed the city attorney to collect legal fees in appealed cases, provided those fees were recovered from defendants.

515 Called meeting of the City Council Austin Texas April 26, 1884 Hon W A Dayton Mayor Presiding Roll call present aldermen Lulow Hancock Wells Campbell Schuber J W Robertson Driskill Odell Foul Platt Ervin and Brush Absent aldermen Suton Schneider Underhill Maas Brooker Carrington V. L. Robertson & Brennan On motion the Council was carrien and the marshal sent after the absentees Aldermen Underhill and schneider came in and answered to their name Call of the Council suspended Mayors office Austin Texas April 16th 1884 To the members of the City Council of the City of Austin Gentlemen You are hereby notified to attend a called meeting of the City Council This Saturday april 16th 1884 at 4 Oclock P.M. for the consideration of matters pertaining to the Citys finances and such other matters as I may call to your attention Very Respectfully W A Dayton Mayor by F H Pannell City Clerk Alderman Hancock introduced an ordinance appropriating the sum of $18.000. to pay the interest and as much of the principal as the amount will cover of a note against the City held by P. M. Revermany & Son of New York, said sum of $18.000. is to be returned to the general revenue less the interest on said note. When the City bonds are sold that are now on the market for sale in New York the ordinance was read second and third time under suspension of the rules and passed by the following vote. Alderman Odell offered an ordinance amending an ordinance passed Nov ye 1883 authorizing the issue and sale of $40,000. 6% bonds The motion to suspend the rules and place the ordinance on its second reading was lost by the following vote Yeas Aldermen Schneider Pillow Hancock Wells Campbell Schubert and Underhill J W Robertson Driskill Odell Hill Brown and Brush Nays Starr Aldermen Platt J W Robertson Hill and Schubert presented petitions signed by property owners on Congress avenue and Pecan Street asking the repeal and modification of an ordinance in regard to street obstructions Alderman Hill introduced the following resolution which was adopted Resolved that the petitioners praying all as to obstructions be received and referred to a special special committee of five to be appointed by the Mayor with instructions to report them by ordinance thereon 2. That pending said report all proceeding against the said petitioners as to the matters therein be and the same are hereby suspended and the City Marshal and City attorney are instructed not to proceed further until after report of said committee and action of the Council thereon His Honor appointed as the Committee Aldermen Hill J W Robertson Underhill Pillow and Driskill Alderman J. W. Robertson offered the following resolution which was adopted A Resolution allowing the City Attorney a fee in appealed cases in the County Court Be it resolved by the City Council of the City of Austin That the City attorney is hereby allowed and authorized to receive the attorney's fees taxed by the County Court in all cases appealed to --- Page break --- 517 to said Court from the recorders Court provided that no such fees shall be paid unless the same is collected from the defendant Alderman Hancock offered an ordinance providing for the location and erection of afor water Hydrants, West of Rio Grand St The ordinance was read first time and then referred to the finance Committee Alderman Plath moved to reconsider the Vote by which the motion to suspend the rules and Read the second time an ordinance amending section 1 and 3 of an ordinance passed Nov 7 1883 Authorizing the issue and sale of $125,000, 6% Austin City Bonds. The motion to reconsider was carried and the ordinance read second and third times under suspen sion of the rules and passed by the following vote yeas Aldermen Schneitter, Dillow Hancock Wells Campbell Schuber Meuskill J W Robertson Dickill Call Hall Plath Ervin and Brush A communication was Received from Elisia Mills which on motion of Aldermen Hill was returned to Mr Mills On Motion the Council adjourned Read and approved June 10/884 J L Burnell City Clerk
