267 Called meeting of the City Council (Austin Texas Dec. 11th 1885.
Hon J.W. Robertson, mayor, presiding. (Roll Call—(Present: Aldermen Pillow, Hancock, Wells, Campbell, Schuler, Warren, Crooker, Odell, Carrington, Holman, Hill, Platt, Ervin and Brenden.—14. (Absent: Aldermen metz, Schneider, Underhill, Maas, Driskill and Brush.—6. Call of Council On motion of alderman Crooker a Call of the. Council was ordered and the marshal sent after the absentees. Aldermen Brush and metz Came in and answered to their names. On motion of Alderman Crooker the Call of the Council was Suspended. The following Call was read: To the members of the The Call City Council of the City Austin: Gentlemen. I hereby Call a special meeting of the City Council to assemble this Saturday evening at 7 o'clock sharp, for the purpose of making appropriations for certain unpaid accounts, and also to open the returns and declare the result of the late election for City officers, and to provide for the installment of the officers elected, and also to transact such other business as may there be brought before you. Very Respectfully, J W Robertson mayor. Motion to Canvass for mayor returns of election. The motion, that the Council proceed to Canvass the returns from the election held December 7th, 1885, for mayor and aldermen was adopted. His Honor appointed as the Committee to Canvass the returns aldermen Hancock, Campbell and Hill. The Committee rose and reported that the returns from the ninth Ward were all signed by the judges of election. Election [illegible] [illegible]

Alderman Hill moved as the judges of said Ward election were present that they Come forward and amend the returns. Motion Adopted. The returns being signed by J. C. Sandle J. L. Tannaway and W. E. Risher, election Judges of the ninth Ward. The motion to accept and act upon the amended returns was adopted. The Committee Submitted a verbal report on the Vote Cast for Aldermen, Showing that. J. The following resolution was introduced and adopted: Resolution - aldermen Be it resolved by the City council of the City Come forward + of Austin, that the aldermen elected at the election qualify, held in the City of Austin on the 7th day of December, 1888, be and they are hereby, requested to come forward at once and qualify, by taking the Oath of Office. This resolution will be notice to such aldermen. If the aldermen elected for the several Wards come forward to take the oath of office.

Protests The following protests against J C De Gress and G. A. Brush qualifying as members of the board of Aldermen were read;
To the Hon. Mayor and City Council of Austin:
McKinley's motion to Contest I hereby give notice to your honorable body, that I propose to Contest the right of the Hon Jacob C. De Gress to occupy a seat in your honorable body as the alderman of ward No. 8 of said City on two grounds, Viz:
First, That the said De Gress is not eligible to the office, and Second, he has not been elected by a majority of the qualified electors of the ward.
I propose to Contest this upon grounds of which I will give J. C. De Gress notice and furnish him fully with the grounds of my Contest in accordance with the Charter and the Ordinances of said City.

Wells notice of Contest I hereby give notice that I will contest the election of Geo A Brush to the office of Alderman of the third ward of said City at the election held on December 7th, 1885 in manner provided by the Charter and Ordinances of said City. B. C. Wells
Oath to aldermen The mayor administered the oath of office to all of the Aldermen elected.
Present: Roll Call & Present: Aldermen Metz, Schneider, Chilton, Anderson, Campbell, Brusselbach, Thadenhall, mass, Warren, Crooker, Workman, Odell, Carson, Holman, De Gress, Eison, Cummings, Johnson and Walker Aldermen Crooker moved that the mayor J. W. Robertson, now be called to the chair of office.

Motion adopted, and oath of office administered by O. Archer, a notary public. The following message of the mayor was read: Gentlemen of the City Council: A new administration of the municipal government of the City of Austin is inaugurated this evening. For the second time I have been honored by the people by election to this office. I come to this office again as I came to it before, free and untrammeled, and without a single promise or obligation of a private character to fulfill. I have no friends to reward and no enemies to punish; I enter upon the duties of the office free from favoritism and free from prejudice. I have but one desire, and that is to faithfully and impartially discharge the trust confided to me, and thereby to promote the welfare, happiness and progress of this City and its people. I feel confident that I address a body of men actuated by like motives and impulses as my own, and that our efforts will all center in a common object and end. Under the Charter, you are vested with great powers I shall at all times respect. It shall be my earnest desire to act in harmony with you in all matters of public interest, and I shall expect to be met in a like conservative and liberal spirit. If our joint action is guided by wise counsels, we cannot fail to accomplish much for the welfare and development of this City. The election of officers of the City devolves upon you, and let me urge upon you to select in every instance the very best men available for the position. The election is now over and partisanship is ended. We represent the whole people and not a mere faction, and let our action be broad, liberal and patriotic. I shall at an early day lay before you such suggestions as I desire to make as to such measures as in my judgment require immediate action, and I trust that our official intercourse may prove pleasant to us and profitable to the people whose interests we represent. of the City of Austin, that the City Council do now proceed to elect officers by ballot in the following Order; 1. Recorder. 2. City Attorney. 3. " Clerk! 4. " Treasurer. 5. " Engineer. 6. Assessor and Collector. 7. City Marshal. 8. " Physician. Nominations for recorder; C.S. Johns, W. Van Rosenberg. Electing Recorder C.S. Johns received on first ballot 12 Votes, Wm Van Rosenberg received 7 Votes and G. Ruggles received One Vote. C.S. Johns having received a majority of votes Cast was declared elected for the next succeeding two years. Nominations for City Attorney; Gardner Ruggles, George F. Pendexter First ballot: Electing City Atty. Gardner Ruggles 9 Votes. G. F. Pendexter 11 Votes. G.F. Pendexter having received a majority of Votes Cast, was declared elected. Nominations for City Clerk; T.L.Purnell & Milton Electing City Clerk Morris. First ballot, T. L. Purnell 10 Votes Milton Morris 10 Votes. Second ballot Milton Morris 11 Votes T. L. Purnell 9 votes. Milton Morris having received a majority of votes Cast, was declared elected. Nominations for City treasurer; J.W. Howard, Electing City Treasr. Wm Stacey, J. S. Myrick. First ballot, J.W. Howard 16 votes Wm Stacey 1 " J. S. Myrick 3 " J.W. Howard, having received a majority of Votes Cast, was declared duly elected.

Nominations for City engineer. Elected City Engr H. C. F. Schmidt, Carl Myer. J. K. P Mc Fall Final ballot, J. K. P Mc Fall 17 Votes H. C. F. Schmidt 1 " Carl Myer 2 " J. K. P. Mc Fall, having received a majority of Votes Cast, was declared duly elected. Nominations for assessor and Collector: Assr & Collr Fred elected. Sterzing, M. M. Johnson, and max maas. Fred Sterzing received on the first ballot 4 Votes, Second ballot 7 Votes. M. M. Johnson on the first ballot 6 Votes Second ballot 3 Votes, max maas on first ballot 10 votes. Second ballot 10 Votes. Third ballot, max maas rec'd 9 votes Fred Sterzing " 9 " m. m. Johnson " 2 " drop lowest The motion to drop the name of the Candidate Candidate. receiving the lowest number of votes was adopted. Fourth, fifth, Sixth and Seventh ballot M. Maas 10 Votes. F. Sterzing 10 " Eighth ballot, A & Collr max maas 11 Votes elected F. Sterzing 9 " Max maas having received a majority of votes Cast, was declared duly elected. Nominations for City marshal: A. P. Foster, W. M. Robinson, Wm Bailes and E Lucy and H. White. First ballot, City marshal J. E. Lucy received 12 Votes elected. A. P Foster " 8 " Wm Bailes " 0 " H. White " 0 " J. E. Lucy, having received a majority of Votes Cast, was declared duly elected.

First ballot, R.S. Graves received 8 votes C.E. Fisher " 6 " F. McLaughlin " 5 " F. J Bennett " 1 Vote Second ballot, R.S. Graves " 10 Votes C.E. Fisher " 5 " F McLaughlin " 5 " Third ballot, City Physician R.S. Graves " 11 " elected C.E. Fisher " 5 " F McLaughlin " 3 " R.S. Graves, having received a majority of votes Cast, was declared duly elected. Nominations for City Sexton; C.L. Nitschke, D.C. Sandle. First ballot, Sexton elected C.L. Nitschke received 13 Votes D.C.
