Street Railway Dispute Rejected: The council repealed a previously granted right-of-way for a streetcar line, then withdrew a new competing proposal after amendments sparked a tie vote that required the mayor to break, highlighting disagreements over where the railways could operate.

City Improvements Approved: Council approved multiple infrastructure projects including a $3,000 iron bridge over Waller Creek, a new arched bridge on College Avenue, and 39 new fire hydrants with extended water mains across the city.

City Finances & Services Reported: January reports showed 91 arrests, modest tax collections totaling $4,137, and 17 deaths recorded by the city sexton, while the city physician noted good public health with only a few measles and scarlet fever cases.

Engine House & City Hall Costs Paid: Council approved $176.50 for extra work on the new engine house and paid an architect $183.05 for city hall improvement plans, settling the latter claim through compromise.

Aldermen Metz, Pellow, Schuber, Odell, Cummings, Ervin, Walker, and Jones - 8. Petition by Alderman Wortham presented a petition by Barnet & Flume to lease the market house lease Shed Shed. Referred to market house Committee. Petition Patrick Alderman Metz introduced a petition by Scott Patrick Scott requesting the City to pay a bill of the City Water Company against himself, for repairing a water pipe which was broken by parties working on the streets. Referred to the Street Committee. Petition J.E. Petition of J.E. Mater for pay for Mater for pay time lost account of sickness in September and October, was read and referred to the Street Committee. J.L. Driskell. A notice from J.L. Driskell, requesting for possession possession of the house occupied by Washington Fire Company within ninety days, was read and referred to the Fire Committee. Wilson, Joseph Nalle and associates as follows: The undersigned again appear before your honorable body asking the right of way to Construct and operate a Street Railway, over the streets within the City of Austin. We regret the necessity of informing you that we find it absolutely impossible to undertake the construction and operation of a line of Street Railway in this City under the severe provisions and requirements of the Ordinance passed by your honorable --- Page break --- 331 body on the night of the 13th of January last. We have prepared an Ordinance which has been thoroughly examined by one of our best and most prominent lawyers, and whose opinion is that it Safely guards the rights of the City, and to which we respectfully invite your attention, in the hope that it may meet your approbation. This Ordinance requires us to Construct more road within twelve months than has been Constructed in the City for the past fifteen years, and Contains Other requirements not to be found in any Ordinance heretofore passed by the City Council. The present Street railway Company, we find from the Charter Originally granted them by the Twelfth Legislature, has no exclusive rights and privileges over the Streets of Austin, and we ask none at your hands. nor do we ask a Cent from the City in way of exemption from taxation Or otherwise, but Simply the right to inaugurate an enterprise that will, from its inception, be a revenue business to the City, a general benefit to the public and a blessing to many of our poor laboring people. Believing that the necessity exists, we respectfully ask that your honorable body take Such definite action tonight as to enable us to at Once proceed with the work. Cook, asking that a Cook-fine fine of $50. assessed against him in the recorder’s Remitted Court for disturbing public worship, was read and his honor remitted $25 of the fine, and asked the approval of the same by the City Council. The fire department Committee, Aldermen Crooker, Jones, and Schneider, recommended the payment of the bill, as it was necessary to have the work performed in order to make the building complete. Alderman Odell submitted the following report: To the Honorable mayor and the City Council: Claim of A.M. Your Committee, to whom was C. Nixon referred the account of A.M.C. Nixon, architect, for plans, specifications and estimates for improvements on City hall beg leave to state that they have agreed to compromise the matter, the City to pay $175 and costs, $8.05; total $183.05; and we recommend the amount be allowed. Alderman DeGress Called up his ordinance entitled "an ordinance designating a 'Stand' for the Vending of wood, hay, and poultry, brought to this City on wagons," which was on its Second reading. Amendment. Alderman Schneider offered the following Amendment to Section first after "block 57," and "the public Squares": Adopted. Motions to further suspend the rules, and place the Ordinance on its third reading Passed. and that it now pass, were adopted by the following Vote: Yeas Aldermen Schneider, Metz, Pillow, Brush, Caldwell, Giesen, Warren, Wortham, Crooker, Odell, Corwin, Holman, DeGress, Walker and Jones - 15. Ord- regulating Alderman Odell offered an Ordinance regulating Construction the Construction and Operation of horse-railways in the City of Austin, and providing the penalty for Violation of Same. Referred to the Street Committee. Alderman Brush introduced the following named Ordinance: Ord. right of An Ordinance granting the right way. of-way over the streets of the City of Austin, to J.M. Wilson, J. Nalle, and their associates for the purpose of Constructing and operating a line or lines of street railway in Said City. The ordinance was read, and a motion was made to suspend the rules and place the Ordinance On its second reading. Adopted by the following Vote: Yeas Aldermen Schneider, Metz, Pillow, Anderson, Brush, Campbell, Caldwell, Giesen, Warren, Northam, Crooker, Odell, Corwin, Holman, Degress, Cummings, Walker and Jones – 18. Amendment Alderman Anderson offered an amendment to Section first, after “City of Austin”, as follows; “Not already occupied by another Street railway. Alderman Cummings moved to amend the amendment offered by alderman Anderson, to read, “except west Pecan Street” The amendment was accepted by alderman Anderson, and a motion to adopt the amendment was made and the following vote was the result: Yeas – Aldermen Anderson, Campbell, Caldwell, Giesen, Warren, Northam, Crooker, Odell and Cummings – 9. Nays – Aldermen Schneider, Metz, Pillow, Brush, Corwin, Holman, Degress, Walker and Jones – 9. Tie Vote The Council having Cast a tie vote, mayor Robertson voted yea, making yeas 10, nays 9. --- Page break --- 540 Feby 1st 1886 The amendment was adopted. Amendment Alderman Odell moved to strike out "whenever required", in Section 2. Adopted. " Alderman Odell moved to amend Section 3 by inserting "City engineer and" after Supervision of the "etc. Adopted. " Alderman Odell moved to amend Section 4 by striking out "fire limits of the" after "within the "etc., and inserting "Pecan Street and Congress Avenue". " Alderman Pillow moved to amend section 4 by striking out that portion relating to fire limits altogether. withdrawn. Alderman Brush requested permission of the City Council to withdraw the Ordinance. There being no objection made, the Ordinance was withdrawn. Ord. to repair Alderman Pillow presented an Ordinance Culvert on W. making an appropriation to repair the Pecan St. Culvert on West Pecan Street, between Crockett and Blanes Streets. Referred to the Street Committee. Alderman Odell introduced the following named Ordinance: $183.05 to Claim An Ordinance appropriating the of A.M.C. Nixon sum of $183.05 to pay the Claim of A.M.C. Nixon for plans and specifications furnished the City of Austin. Extending Water mains the water mains of the City of Austin, and the additional location of thirty eight fire hydrants thereon. A motion to suspend the rules and place the ordinance on its second reading was made, and adopted by the following Vote: Yeas - Aldermen Schneider, Metz, Pillow, Anderson, Brush, Campbell, Caldwell, Giesen, Warren, Northam, Crooker, Odell, Corwin, Holman, De Gress, Cummings Walker and Jones -18. Amendment Alderman Pillow moved to amend Section 1 by striking out 2600 feet and inserting 3168 feet. Adopted. No objection being made, the caption of the Ordinance was changed to read 39 instead of 38 fire hydrants. Motions to further Suspend the rules and place the Ordinance on its third reading, Passed. and that the Ordinance now pass, were adopted by the following Vote: Yeas Aldermen Schneider, Metz, Pillow, Anderson, Brush, Campbell, Caldwell, Giesen, Northam, Crooker, Odell, Corwin,
