375 A Called meeting of the City Council Austin Tex March 22, 1886. Hon J.W. Robertson, mayor, presiding. Roll Call - Present: Aldermen Caldwell, Giesen, DeGress and Erwin - 4. Absent, Aldermen Schneider, Metz, Picklow, Anderson, Brush, Campbell, Schuber, Warren, Wartham, Crooker, Odell, Corwin, Holman, Cummings, Walker and Jones - 16. Alderman DeGress moved that a Call of the Council be made. Adopted, and the marshal sent after the absentees. Alderman Warren Came in and asked to be excused on account of sickness in his family. He was excused. Aldermen Walker, Wartham, Schuber, Campbell, Jones, Corwin, Anderson, Cummings, and Metz Came in. A motion was made and adopted suspending the Call of the Council. The object of the meeting was to take action on Various Ordinances Submitted by the Compilers and to act on other matters if placed before the Council. An Ordinance prohibiting the running at large of animals within the City of Austin, and providing for the sale of the same; was taken up on its second reading, and read, and on motion, was referred to the Committee on Ordinances with instructions to the Committee to report on the Same at the next regular meeting of the Council. An Ordinance regulating dance houses and exhibitions in the City of Austin, was taken up on its second reading and read, and on motion was referred to the Committee on Ordinances. The following named Ordinances were taken up on their second reading, and read and laid over: An Ordinance amending article 691 of the revised Ordinances of the City of Austin. --- Page break --- 376 Mch 22-86. An Ordinance amending article 420 of the revised Ordinances of the City of Austin. An Ordinance amending article 224 of the revised Ordinances of the City of Austin. An Ordinance amending article 289 of the revised Ordinances of the City of Austin. Alderman Schneider Came in. The following named Ordinance was taken up on its second reading and read: An Ordinance prohibiting the taking up and using any animal belonging to another. A motion was made to suspend the rules and place the Ordinance on its third reading, which was adopted by the following Vote; Yeas Aldermen Schneider, Metz, Anderson, Campbell, Schuber, Caldwell, Giesen, Wortham, Corwin, DeGress, Cummings, Ervin, Walker and Jones. 14. A motion was made that the ordinance now pass. Adopted. An Ordinance amending article 691 of the revised Ordinances of the City of Austin which had been read a second time, was Called up and a motion made to suspend the rules and the Ordinance on its third reading which was adopted by the following Vote: Yeas Aldermen Schneider, Metz, Anderson, Campbell, Schuber, Caldwell, Giesen, Wortham, Corwin, DeGress, Cummings, Ervin, Walker and Jones - 14. A motion was made that the Ordinance now pass. Adopted. An Ordinance entitled "An Ordinance amending article 289 of the revised Ordinances of the City of Austin Which had been read a Second time was Called up and a motion made to suspend the rules and place the Ordinance on its third reading which was adopted by the following Vote: Yeas Aldermen Schneider, Metz, Anderson, Campbell, Schuber, Caldwell, Giesen, Wortham, Corwin, DeGress, Cummings, Ervin, Walker and Jones - 14. --- Page break --- Mch 22. 86 377 A motion was made that the Ordinance now pass. Adopted. Alderman Cummings asked to be Excused on account of a pressing professional Call. He was excused An Ordinance entitled "An Ordinance regulating the manner of keeping the City teams, wagons, etc" was read a first time. and laid over. The following named ordinances were taken up on their second reading, read and laid over; An Ordinance to prohibit any interference with officers of the City of Austin. An Ordinance defining and punishing disturbances of the peace. An Ordinance regulating the work of night scavengers in the City of Austin. An Ordinance regulating lighted lamps upon licensed Vehicles. An Ordinance entitled "An Ordinance relating to public morals and decency," was taken up on its second reading, and read. Alderman DeGress moved to refer the Ordinance to the Committee on Ordinances. The motion was rejected by a rising vote of 6 to 7. Alderman DeGress moved to amend article 2. by inserting the word "knowingly." between the words "Shall drive". The amendment was adopted and the ordinance laid over. The following named ordinances were taken up on their second reading, read and laid over: An Ordinance regulating the removal and burial of dead animals within the City of Austin. An Ordinance to prohibit diseased animals running at large within the City of Austin. An Ordinance prohibiting the sale of unwholesome food in the City of Austin. An Ordinance amending article 288 of the revised Ordinances of the City of Austin. Alderman DeGress moved a Call of the Council. Adopted. Alderman Anderson moved that the Call of the Council --- Page break --- 378 Mch 22 - 1886. be suspended. Adopted. An Ordinance entitled "An Ordinance regulating the storage of hay, etc, Within the fire limits of the City of Austin," was taken up On its second reading and read. Alderman De Gress moved to amend Section 1 by striking out the word "shavings". Adopted. Alderman DeGress moved to amend Section 2, by striking out "2,000" and inserting "1000." Rejected. Alderman Corwin moved to strike out Section 2. The motion was adopted and The Ordinance laid over. An Ordinance entitled "An ordinance regulating the building, repairing and removal of wooden buildings in the City of Austin." Was taken up on its second reading, read, and on motion referred to the Committee on Ordinances. An Ordinances entitled "An Ordinances regulating riding and driving in the Streets of Austin," Was taken up on its second reading and read. Alderman Anderson moved to amend Sec 1. by striking out "5" and inserting "8." Alderman Giesen moved to amend the amendment offered by Alderman Anderson, by striking out "5" miles, etc, and inserting "Slow trot." Alderman Anderson accepted the amendment. Alderman DeGress offered the following amendment as a substitute for the amendments offered by Aldermen Anderson and Giesen: "Strike out "5" and insert "6 miles," etc. A motion was made to adopt the substitute. Carried. A motion was then made to adopt the amendment. adopted. Alderman Caldwell offered the following amendment to Section 1. After the words "Congress avenue", insert "South of the Capitol." Adopted. --- Page break --- Mch 22-86. 379 Alderman Anderson moved to amend Sec. 1 by striking out the word "walk," after faster than "a", and inserting "Slow-trot." Adopted. Alderman Caldwell moved to amend Sec. 3 by inserting after the words "attached thereto" the words "except when attached to Street Cars." Adopted. The ordinance was then laid over. The following named ordinances were then taken up on their Second reading and read: An Ordinance prohibiting the driving of animals in droves through the streets in the City of Austin. An ordinance prohibiting the hitching of any Stallion, Jackass or bull in any Street or alley, or keeping the Same for Service in Certain Places in the City of Austin. An Ordinance regulating bill posters in the City of Austin. - Alderman Cummings came in - An Ordinance regulating Auctioneers in the City of Austin. An ordinance amending article 534 of the revised ordinances of the City of Austin. An Ordinance relating to illegal contracts effecting the City of Austin. An Ordinance providing for the payment of jury fees in the recorder's Court of the City of Austin. An Ordinance relating to the Collection of occupation taxes in the City of Austin. An Ordinance regulating barrooms, Saloons, etc, in the City of Austin. An Ordinance prohibiting gaming in the City of Austin. An Ordinance prohibiting Sabbath breaking in the City of Austin. Alderman Caldwell moved to amend the Caption by Striking out "prohibiting Sabbath breaking," and inserting "regulating the observance of Sunday," etc, Adopted The following named ordinance was taken up on its Second reading and read: An Ordinance defining --- Page break --- 380 Mch 22. 1886. nuisances and providing for the prevention and abolishment of the same, and to promote the health cleanliness and welfare of Austin, and prescribing penalties for violation of same. Alderman DeGress moved to amend Sec, 2 by affixing the following thereto: "Nor water coming from private bath houses". The amendment was adopted. Alderman Cummings moved to amend section 8 by striking out the word "five" and inserting "three". Adopted. Alderman DeGress moved to amend Section 15 by affixing the following proviso thereto: Provided this section shall not apply where such water accumulates without any neglect or fault of such owner, agent or occupant. The amendment was adopted. Alderman Schneider moved to amend Sec. 12 by inserting the word "offensive", between the words "the rubbish". Adopted. A motion was made to suspend the rules and place the ordinance on its third reading which was adopted by the following vote: yeas Aldermen Schneider, Metz, Anderson, Campbell, Johnson, Caldwell, Giesen, Northam, Corwin, DeGress, Cummings, Ervin, Walker and Jones-14. A motion was made that the ordinance now pass, which was adopted. Alderman Ervin presented the following report, which was adopted. To the Honorable Mayor and City Council of the City of Austin: Gentlemen:- Your Special Committee to whom was referred the petition of citizens asking that the bridge over Waller Creek on East Pecan street, be made the width of 80 feet, respectfully report that they have had the same under consideration, and ask that said petition be granted, and said bridge be built in accordance therewith. Respectfully, Wm Ervin, G. Warren, Dennis Corwin, --- Page break --- 381 Mch. 22-86 A guarantee from ten Citizens of Austin for $225 to be used for the purpose of widening the bridge mentioned in the above report, accompanied the report of the Committee.
