382 A Called meeting of the City Council
Austin Tex March 24, 1886. Hon J. W. Robertson; Mayor, presiding. Roll Call - Present Aldermen Brush, Caldwell, Giesen, Warren, Northam, Odell Nolman, Ervin, Walker and Jones. 10. Alderman Schuber Came in. Alderman Giesen moved a Call of the Council. Adopted, and the marshal sent after the absentees. Aldermen Schneider, Cummings and Campbell Came in. Alderman Giesen moved that the Call of the Council be suspended. Adopted. Alderman Corwin Came in. The Mayor's Call. Mayor's Office, Austin Tex March 24, 1886. To the members of the City Council; Gentlemen:- I hereby Call a special meeting of the City Council to assemble this, Wednesday evening, at 7.30 p.m., to Consider the matter, of of the extension of the bridge over Waller Creek on East Pecan Street, and also to further Consider the Ordinances now pending on the Second and third reading, and Such as are in the hands of Committees; also to Consider any other matter that may then be laid before you. Very respectfully, etc, J. W. Robertson Mayor. Alderman Cummings moved to reconsider the vote by which an Ordinance was passed entitled, "An Ordinance defining nuisances, and providing for the prevention and abolishment of the Same," and to promote the health, Cleanliness and welfare of Austin, and providing penalties for violation of Same" The motion was adopted. Alderman Cummings moved to strike out the word five in the penal Clauses of the Ordinance wherever the Same occurs and insert the word "ten". Adopted.

On motion the ordinance passed as amended. Alderman Ervin introduced an ordinance entitled, "An ordinance appropriating the sum of nine hundred dollars for the purpose of widening the bridge over Waller Creek on East Pecan Street". A motion was made to suspend the rules and place the ordinance on its second reading which was adopted by the following vote; Yeas Aldermen Schneider, Brush, Campbell, Schuber, Caldwell, Giesen, Warren, Wortham, Odell, Corwin, Holman, Cummings, Ervin, Walker and Jones - 15. Alderman Schuber moved to amend Sec. 1 by affixing the following proviso: Provided that all filling and sidewalk incurred by reason of this extension from 60 to 80 feet shall be done by the citizens at interest and shall not be a charge on the city. Adopted. Motions were made to suspend the rules and place the ordinance on its third reading, and that the ordinance now pass, both of which were adopted by the following vote; Yeas Aldermen Schneider, Brush, Campbell, Schuber, Caldwell, Giesen, Warren, Wortham, Odell, Corwin, Holman, Cummings, Ervin, Walker and Jones 15. Alderman Odell introduced an ordinance entitled "An Ordinance appropriating twenty dollars to pay costs in Ritz Case." - Alderman Metz came in. - Motions were made to suspend the rules and place the ordinance on its second and third reading, both of which were adopted by the following vote; Yeas Aldermen Schneider, Metz, Brush, Campbell, Schuber, Caldwell, Giesen, Warren, Wortham, Odell, Corwin, Holman, Cummings, Ervin, Walker and Jones - 16 A motion was made that the ordinance now pass. Alderman Odell introduced an ordinance entitled "an Ordinance authorizing the City engineer to employ an assistant". A motion to suspend the rules and place the Ordinance on its second reading was defeated by the following vote: Yeas, Aldermen Metz, Campbell, Schubert, Caldwell, Giesen, Warren, Wortham, Odell, Corwin, Holman Ervin, and Walker - 12. Nays; Aldermen Brush, Cummings and Jones. 3. The following named ordinances were taken upon a third reading and passed: An Ordinance amending article 420 of the revised ordinances of the city of Austin. An Ordinance amending article 224 of the revised Ordinances of the City of Austin. An Ordinance to prohibit any interference with officers of the city of Austin. An Ordinance defining and punishing disturbances of the peace. An Ordinance regulating the work of night scavengers in the City of Austin. An Ordinance requiring lighted lamps upon licensed vehicles. An Ordinance entitled "An Ordinance relating to public morals and decency" was taken up on a third reading and read. Alderman Corwin moved to strike out Section 2. The motion was adopted, by a rising vote of 9 to 5. Alderman Campbell moved to table the Ordinance Adopted. Alderman Anderson came in. The following named Ordinances were taken up on a third reading, read and passed. An Ordinance regulating the removal and burial of dead animals within the City of Austin. An Ordinance to prohibit diseased animals running at large within the City of Austin. An Ordinance prohibiting the

An ordinance prohibiting the sale of Unwholesome food in the City of Austin. An Ordinance amending article 288 of the revised Ordinances of the City of Austin. An Ordinance regulating the storage of hay etc., within the fire limits of the City of Austin. An Ordinance entitled "an ordinance regulating riding and driving in the Streets of Austin", was taken up. On a third reading and read. Alderman Giesen moved to Strike the following words out of Section 4: "Or shall stop any Vehicle within ten feet of any other vehicle, or immediately in front of any business houses, or within ten feet of the Curbstone or Sidewalk". The amendment was adopted. Alderman Brush moved to refer the ordinance to a special Committee. Defeated. Alderman Jones moved to amend Section 1, by Striking out Six and inserting ten. Defeated by a rising vote of 6 to 10. Alderman Giesen moved to amend Section 1 by striking out the words: "Provided a Slow trot be six miles an hour". The amendment was defeated by a rising vote of 7 to 9. Alderman Anderson moved to amend Section 1 by striking out "6" and inserting "8". Defeated by a rising vote of 6 to 9. Alderman Cummings moved to amend Section 1 by striking out "6" and inserting "moderate trot". Alderman Campbell offered as a substitute for the amendment offered by Alderman Cummings an amendment to strike out "6" and insert "7". On motion the substitute was rejected, and the Original amendment also rejected by a rising vote of 7 to 9. Alderman Giesen moved to lay the ordinance on the table. Defeated. Alderman Anderson moved to amend Section 1 by Striking out "6" and inserting "Seven and one half". The amendment was adopted by a rising vote of 9 to 8. A motion was made and adopted that the

Ordinance now pass. The following named ordinance were taken up on a third reading, read and passed; An Ordinance prohibiting the driving of animals in droves through the Streets in the City of Austin. An Ordinance prohibiting the hitching of any Stallion, Jackass or bull in any Street or Alley, or keeping the same for service in Certain places in the City of Austin. An Ordinance regulating bill posters in the City of Austin. An Ordinance regulating Auctioneers in the City of Austin An Ordinance amending article 534 of the revised Ordinances of the City of Austin. An Ordinance relating to illegal Contracts affecting the City of Austin. An Ordinance relating to the Collection of Occupation taxes in the City of Austin. An Ordinance regulating barrooms, Saloons, etc in the City of Austin. An Ordinance regulating the observance of Sunday in the City of Austin. An Ordinance entitled "An ordinance providing for the payment of Jury fees in the Recorders Court of the City of Austin," was taken up on a third reading and read. Alderman Campbell moved to table the same Defeated, and on motion was passed. An Ordinance, entitled "An Ordinance prohibiting gaming in the City of Austin." was taken up on a third reading and read. Alderman Anderson moved to strike out Section 8. Rejected by a rising Vote of 7 to 9. Alderman Cummings moved to strike out Section 7. Defeated by a rising Vote of 4 to 10. A motion was made and adopted that the Ordinance pass. Alderman Northam moved a suspension of the rules to place on a second reading an ordinance, entitled "An ordinance Authorizing the City engineer to employ an assistant".

The motion was adopted by the following vote Yeas: Aldermen Anderson, Campbell, Schuber, Caldwell, Giesen, Warren, Wortham, Odell, Corwin, Holman, Cummings, Ervin, Walker and Jones-14 Nays: Aldermen Schneider, Metz and Brush-3. Alderman Cummings moved to amend Section 1 by Striking out "3" and inserting "1". Alderman Campbell offered as a substitute for the amendment offered by Alderman Cummings, an amendment Striking out the words "the term of" and inserting "Such time as may be actively necessary, not to Exceed". A motion to adopt the substitute for the Original amendment was made and adopted. A motion was made to adopt the Substitute. Carried. A motion was made to further suspend the rules and place the Ordinance on a third reading which was adopted by the following Vote: Yeas Aldermen Anderson, Brush, Campbell, Schuber, Caldwell, Giesen, Warren, Wortham, Odell, Corwin, Holman, Cummings, Ervin, Walker and Jones-15 Nays: Aldermen Schneider and Metz-2. An Ordinance entitled "an ordinance regulating the manner of Keeping the City Teams Wagons etc" was taken up on a Second reading, read and a motion made to suspend the rules and place the Ordinance on a third reading which was adopted by the following vote: Yeas Aldermen Schneider, Metz, Anderson, Brush, Campbell, Schuber, Caldwell, Giesen, Warren, Wortham, Odell, Corwin, Holman, Cummings, Ervin, Walker and Jones-17. A motion was made that the Ordinance now pass. Adopted. Alderman Caldwell Called up an Ordinance on a third reading, entitled "An Ordinance for building an Arched bridge on College Avenue and Nueces Street". On motion the Ordinance passed by the

following Vote: Yeas Aldermen Schneider, Metz, Anderson, Campbell, Schuber, Caldwell, Giesen, Northam, Odell, Corwin, Holman, Cummings, Ervin, Walser and Jones - 15. Nays: Aldermen Brush and Warren - 2. Alderman Walser Called up an Ordinance on a third reading, entitled "an Ordinance requiring railroads within the City of Austin to Keep their tracks in good order and fixing a penalty for a violation thereof." Alderman Campbell moved to lay the Ordinance on the table. Defeated. Alderman Anderson moved the previous question to put. Adopted and the ordinance was then passed by a rising Vote of 13 to 4. Alderman Corwin introduced the following resolution: Resolved, That wherever any telegraph or telephone post is standing in any street of the City of Austin more than four feet from the side walks, are dangerous obstructions, and that the City engineer is hereby instructed to Cause the Same to be removed. Alderman Brush moved to amend the resolution by inserting, "They shall be removed from the street to the Edge of the Curbing. Adopted Alderman Schneider moved to amend the resolution by inserting and electric light posts etc. The amendment was accepted. On motion the Council adjourned Milton Morris City Clerk
