409 A Regular meeting of the City Council. Austin Tex May 03, 1886. Hon J.W. Robertson - mayor, presiding. Roll Call - Present. Aldermen Schneider, Anderson, Campbell, Schutze, Warren, Wortham, Costley, DeGress, Cummings, Giesen, Walker, Jones - 12. Absent - Aldermen Metz, Pillow, Brush, Caldwell, Odell, Holman, Ervin - 7. Alderman DeGress moved that a Call of the Council be made. The motion was adopted and the marshal sent after the absentees. Alderman Metz Came in and answered to his name. Alderman Walker moved to excuse Alderman Pillow on account of sickness. Adopted. Alderman DeGress moved to suspend the Call of the Council. Adopted. Alderman Crooker moved to dispense with reading the minutes of the last meeting until they are printed. Carried. Alderman Odell Came in. The treasurers report for the month of April was presented and read. It shows that there was Collected during this period $10,658.22, and that $12.893.80 was paid out; and that balances unappropriated amount to $16,028.29. The City marshals report for the month of April was also presented and read. The amount of fines assessed in the recorders Court during the month, as shown by the report, is $781; Cash Collected, $51.55; total number of arrests, 94. The Assessor and Collectors reports of advalorem and school taxes Collected during the quarter ending, April 30, 1886, were read The amount of Advalorem taxes, etc., Collected, $45.020.84; amount of School taxes Collected, $13.779.81. The City Clerks report of warrants issued during the month of April, was read. It shows that warrants were issued during this time, to the amount of $12.675.29 The City Sexton's report for month of April was presented. It shows that there were twenty --- Page break --- 410 May 3-1886 deaths in the City during the month. The report of the City Physician Shows that there were Seven patients in the hospital may 1st. and the health of the City is moderately good. Alderman DeGress moved that all further business be Suspended and that the Council go into Committee of the whole. To Consider the report of the finance Committee. The motion was adopted, and Alderman DeGress took the Chair. Alderman Odell for the finance Committee presented a report of estimated resources and liabilities of the City for the fiscal year ending November 30, 1886. The report Shows that after paying all liabilities there will probably be a Surplus in the treasury of $8676.73. The Committee recommended that about $3000 be taken from the amount already appropriated for Street Improvement, for the purpose of buying the necessary teams and implements to equip a complete outfit to each Ward. On motion the report was received and the recommendation of the Committee adopted. In response to the Chair's question, asking if action if action was desired on the probable surplus that would be on hand at the end of the fiscal year, Alderman Walker gave notice that a small portion of the amount would be needed to purchase land in the Tenth Ward in order to open Certain Streets. Mayor Robertson in the Chair. The Chairman of the Committee of the whole reported action as follows viz: That the Committee had adopted a resolution to take $3000 out of the amount already appropriated for improvement of the Streets, for the purpose of purchasing the necessary teams, implements, etc to equip a complete outfit for each Ward, and recommend that the same be adopted. The resolution above referred to was then read and adopted. The Chairman also Called the attention of the --- Page break --- 411 May 3-1886. Council to the statement made in the Committee of the whole by Alderman Walker, to the effect that a small amount of the probable surplus of revenue would be required to purchase land in order to Open Certain Streets in the South Ward. On motion further time was granted the above Committee in which to report. Alderman Cummings moved to suspend the rules and take up an ordinance further regulating the treatment of infectious and contagious diseases in the City of Austin. No Objection being made the ordinance was read, and a motion made to suspend the rules and place the Ordinance On its second reading, which was adopted by the following vote: Yeas – Aldermen Schneider, metz, Anderson, Campbell, Schuber, Giesen, Warren, Wortham, Crooker, Odell, DeGress Cummings & Walker and Jones, total 14. Alderman DeGress moved to amend Section 2 by inserting “and provided that this ordinance shall not apply to the State health Officer”. Alderman Wortham moved to amend section 4 by inserting “and shall have power to call on the City Marshal for aid and assistance when necessary”. Accepted. Alderman Cummings moved to amend the motion made by Alderman DeGress by adding “Except as to disinfection.” Accepted. Alderman DeGress moved to amend Section 3 by inserting “at once”. Adopted. Alderman Cummings moved to amend Section 3 by striking out “and” and inserting “or” between the words “medicine and Surgery”. No objection was made. A motion was made to suspend the rules and place the ordinance on its third reading, which was adopted by the following vote: Yeas – Aldermen Metz, Anderson, Campbell, Schuber, Warren, Wortham, Crooker, Odell, DeGress, Cummings, Walker and Jones, Giesen 13. --- Page break --- 412 May 3, 1886. Nays - Alderman Schneider, Alderman Schneider requested permission to change his vote to yea. Granted. The ordinance was then read a third time, and on motion passed by the following vote: Aldermen Schneider, Metz, Anderson, Campbell, Schuler, Giesen, Warren, Wortham, Crooker, Odell, DeGress, Cummings, Walker, and Jones; total 14. Alderman Wortham moved that the Clerk be instructed to furnish One copy of the ordinance when the same shall have been printed, to each practitioner of medicine, or surgery, in the city. Adopted. Alderman Cummings introduced "An ordinance providing for the better protection of the health of pupils in the schools of the city." Alderman Brush came in. A motion was made to suspend the rules and place the ordinance on its second reading, which was adopted by the following vote; Yeas-Aldermen Schneider, Metz, Anderson, Brush, Campbell, Schuler, Giesen, Warren, Wortham, Crooker, Odell, DeGress, Cummings, Walker and Jones-15. Alderman DeGress moved to strike out the word "physician" wherever it appears, and insert, "marshal" Adopted. A motion was made to suspend the rules and place the ordinance on its third reading, which was adopted by the following vote: Yeas. Aldermen Schneider, Metz, Anderson, Brush, Campbell, Schuler, Giesen, Warren, Wortham, Crooker, Odell, DeGress, Cummings, Walker and Jones - 15. On motion the ordinance passed. Alderman Cummings introduced a resolution expressing that it is the sense of the Council that all public schools should be closed, etc. Alderman DeGress moved that the enacting clause be stricken out. Adopted by a rising vote of 10 to 5. A resolution ordering a special election to be held in the Seventh Ward, Friday, May 14, for the purpose of electing one Alderman to fill the vacancy occasioned by the resignation of Dennis Corwin, was adopted. --- Page break --- 413 May 3. 1886 A petition from Citizens of Austin, requesting the Mayor and Council to accept a proposition which they believe Edward Christian will agree to Viz: That he will build a bridge over Waller Creek, On Magnolia Avenue, provided the City will allow the amount so expended to apply to the payment of his taxes. Referred to finance Committee. A petition was read and referred to the ordinance Committee, requesting that Teams and wagons be prohibited from standing on Brazos Street near Pecan. A petition from M. English Co, to rent a portion of the block north of Pecan Street, On Sabine Street, was referred to the Street Committee Alderman DeGress presented a petition from A. T. McKean asking that the city pay to him $4.60, that being the amount required to pay bill for repairing water pipe in front of his Residence, which was broken by the city street gang. Read and laid over. A petition of the Citizens of the Fifth Ward, requesting that a lamp be erected on the Corner of Colorado and Linden Streets, was read and referred to the Alderman of that Ward. Alderman Northam presented the following resolution which was read and referred to the finance committee Resolved, that the finance Committee be and are hereby instructed to ascertain what property has been assessed against the Swedish Methodist Episcopal Church, and whether such assessment should not be Cancelled. Mayor Robertson presented his report showing in detail the Expenditures made for detective services. It shows that there was paid for this service $4,183.27 out of the $5000 which was appropriated and placed at his disposal December last, by the Council. The Street Committee reported against the purchase of lots 2, 3 and 4, block 135, for Roadway. The Report was adopted. --- Page break --- 414 May 3 - 1886 The following report was Submitted by the police Committee: " "Your Committee on police to Whom was referred the within report, beg leave to report that we have Examined the Same, and have found few mistakes, but they have all been Settled, and we find the marshal's books Correct up to April, 1886. The report was adopted. The ordinance Committee reported favorably on an Ordinance regulating the duties of city officers in Certain Cases. Water | An Ordinance making an appropriation for payment of the City Water Company for the year 1885 was read a third time and a motion made that the ordinance now pass, which was defeated by the following Vote: Yeas Aldermen Metz, Brush, Wartham, Crooker, Odell, DeGress Cummings, Jones - 8. Nays - Aldermen Schneider, Anderson, Campbell Schuler, Green, Warren and Walker; Total, 7. Alderman Wartham requested permission To Withdraw an Ordinance granting Dr W.H. Tobin 150 x 180 feet of ground off the northeast Corner of public Square between Pine and Cedar and Neches and Trinity Streets. No Objection being made the Ordinance was withdrawn. An Ordinance appropriating $500 for the purpose of building a wooden bridge over Waller Creek where Willow Street Crosses the Same, was read a third time, and on motion of Alderman Anderson, Tabled. An Ordinance regulating the duties of City officers in Certain Cases was taken up and read a second time, and Alderman DeGress moved To amend Section 1 by adding the following thereto: "Provided that When the City Council is not in session the mayor may grant leave of absence for not exceeding ten days". Adopted. A motion was made to Suspend the rules --- Page break --- 415 May 3-1886. and place the ordinance on its third reading which was adopted by the following vote; Yeas Aldermen Schneider, Metz, Anderson, Brush, Campbell, Schuber, Giesen, Warren, Wortham, Crooker, Odell, DeGress, Cummings, Walker and Jones; total, 15. On motion the ordinance was passed. Sewer Alderman Cummings Called up the ordinance to lease to the City from Geo A. Brush the City Sewer, etc. A petition of Citizens, which was read at a former meeting of the City Council, requesting that the Sewer be purchased, was called for and read. A motion to suspend the rules and place the Ordinance on its second reading was defeated by the following vote: Yeas, Aldermen Brush, DeGress, Crooker, Odell, Cummings-5. Nays- Aldermen Schneider, Metz, Anderson, Campbell, Schuber, Giesen, Warren, Wortham, Walker Jones - 10. Alderman DeGress moved to lay this sewer ordinance on the table until legislative action is had. Adopted. Alderman Anderson introduced a resolution providing for an election to be held in the City of Austin for the purpose of authorizing the issuance of twenty five thousand dollars of the bonds of said City for the purpose of building a system of underground sewerage. Referred to Finance Committee. Alderman Odell introduced an Ordinance appropriating $2,097.15 to pay approved accounts. A motion was made to suspend the rules and place the Ordinance on its second reading, which was adopted by the following vote: Yeas Aldermen Schneider, Metz, Anderson, Brush, Campbell, Schuber, Giesen, Warren, Wortham, Crooker, Odell, DeGress, Cummings, Walker Jones - 15. Alderman Odell moved to amend Section 1, by adding $400 to pay Costs in Case of Ritz vs. --- Page break --- 416 May 3, 1886. The city of Austin: $78.29 to pay Austin Gaslight and Coal Company and $82.25 to pay the Capital Gaslight Company. No Objection was made. Alderman DeGress moved to amend Section 1, by inserting $4.60 to pay A. J. McKean. No objection was made. Motions were made to suspend the rules and place the ordinance on its third reading, and that the ordinance now pass, both of which were adopted by the following vote: Yeas - Aldermen Schneider, Metz, Anderson, Brush, Campbell, Schuber, Giesen, Warren, Wortham, Crooker, Odell, DeGress, Cummings, Walker, Jones - 15. Alderman Giesen introduced an Ordinance appropriating the sum of Two hundred dollars to place the approaches of the new engine house in good shape. A motion was made to suspend the rules and place the Ordinance on its second reading, which was adopted by the following Vote: Yeas - Aldermen Schneider, Metz, Anderson, Brush, Campbell, Schuber, Giesen, Warren, Wortham, Crooker, Odell, DeGress, Cummings, Walker and Jones; total, 15. A motion to suspend the rules and place the Ordinance on its third reading was defeated by the following Vote: Yeas - Aldermen Schneider, Anderson, Brush, Campbell, Schuber, Giesen, Warren, Crooker, Odell, DeGress, Cummings, Walker and Jones; total, 13. Nays - Alderman Metz and Wortham; total 2. Alderman Anderson moved to suspend the rules in order to take up his resolution regarding the issuance of bonds for sewer purposes. Alderman DeGress offered as a substitute for the motion made by Alderman Anderson, that the resolution be recalled from the finance Committee. The motion was accepted and adopted. --- Page break --- 417 May 3, 1886. A motion to suspend the rules and place the Ordinance on its second reading was adopted by the following vote: Yeas. Aldermen Schneider, Metz, Anderson, Brush, Campbell, Schuler, Greison, Warren, Wortham, Crooker, Odell, DeGress, Walker and Jones Total, 14. Nays - Alderman Cummings.
