Austin's New Cemetery Plans & City Budget

Greenwood Cemetery Approved: The City Council established a new cemetery called Greenwood Cemetery, purchasing 120 acres from J.H. Patterson. The council allocated 10 acres specifically for the burial of Black residents (increased from 5 acres), and created a separate pauper burial section with numbered graves.

Cemetery Regulations Set: The city established lot prices ($25 for half-lots, $15 for quarter-lots) and new rules including restricting children under 12 unless accompanied by adults, banning dogs, and requiring the City Sexton to organize and number lots designated for Black residents.

July Payroll & City Services Funded: The council approved $3,083 to pay city officers and employees for July, plus $167 for hospital staff wages.

Street & Infrastructure Improvements: The council approved $150 to improve the street in front of the Fire Hall on Hickory Street and ordered the removal of chili stands from Pecan Street.

Miscellaneous City Business: The council addressed a property tax refund request for the Swedish Church, investigated a collision damage claim, and approved funding for printing the city's revised ordinances.

456 A Regular Meeting of the City Council. Austin, Tex July 19, 1886. Hon. J. W. Robertson mayor, presiding. Roll Call Roll Call - Present, Aldermen Brush, Campbell, Crooker, Cummings, DeGress, Giesen, Jones, Odell, Schuler, Walker, Warren, & Wellmer - 12. Absent - Aldermen Anderson, Caldwell, Erwin, Holman, Metz, Pillow, Schneider, Wortham - 8. Call Council A Call of the Council was moved and adopted, and the marshal sent after the absentees. Aldermen Pillow, Holman, Caldwell, and Wortham Came in. Suspend Call Alderman Giesen moved that the Call be suspended - Adopted. Minutes The minutes of a regular and a Called adopted meeting of the City Council held July 5, and 12, respectively, were adopted as printed, after the former was so changed as to show that the Committee on fire department was named in the resolution, introduced by alderman Giesen, providing for the repairing of approaches to the engine house on market Hill, instead of the Committee on Streets, alleys etc. Pet Mrs A petition from Mrs T. J. Houston, Houston asking that $10.00 be refunded to her, the amount being paid by her at a tax sale of property on which the City had no right to levy a tax, it being the property of the Swedish Church, was referred to the Committee on finance and revenue. Block 52 The Committee on Streets, alleys, etc, reported Div. D. favorably on a petition from Citizens owning all of Block No. 52, in division D, who request the perpetual Closing of the alley running through said block. The report and petition were referred --- Page break --- July 19, 1886. 457 to the City attorney with instructions to prepare an Ordinance in accordance with the petition, and submit the same to the Council. Alderman Anderson came in. amendment The Committee on Streets, alleys, etc, reported to pound adversely on an amendment to Section One Ord. of an Ordinance prohibiting the running at large of animals in the City of Austin, and providing for the sale of the same. The report was adopted. Further time was given to the Committee on Charges by police in which to prepare their report of the Leader charges made by Dr. Y. L. Leader against policemen Q. H. Gibson, Ed O'Banion and Marshal James Lucy. Cemetery The Committee on Cemetery presented their Comitee report on the Communication from the City Sexton relative to the price of lots in the Cemetery, etc. The report fixes the prices of one-half lots at $25, one quarter lots at $15; to be sold only for immediate use. The report recommends that the City Sexton be required to name and number the lots set apart to the Colored people; in the present City Cemetery, and report the same to the City Council at their next regular meeting; and that he take charge of the gate on the South String of Cemetery fences, and that Children under twelve years of age be not allowed admittance into the Cemetery, except when in Company with some grown person; further, that dogs be not allowed at the Cemetery grounds. The report and recommendations were adopted. Cemetery The Same Committee reported on the disposition Old fence made of the Old Cemetery fence recently removed. The report shows that the fence netted $89.36, and that improvements were made at the Cemetery with a portion of the lumber, and that the west and north fence was hauled --- Page break --- 458 July 19, 1886. to the Hospital, leaving about 200 feet of old lumber, etc., at the Cemetery. On motion the report was accepted. Mayor's report on his action Cemetery. Mayor Robertson presented a report of his action under a resolution authorizing him to purchase 120 acres of land from J. H. Patterson, for a Cemetery. The report states the terms of purchase, etc. Postpone action. Alderman Brush moved that action on the report be postponed, and that the Council accept an offer made by Monroe Miller, to take the members of the Council in a body, free of charge, to inspect any or all tracts of land offered for sale to the City for Cemetery purposes. Rejected. Ratifying purchase Cemetery. Alderman Anderson introduced a resolution ratifying and confirming the sale of 120 acres of land made to the City for a Cemetery, by J. H. Patterson and wife, through Mayor Robertson. The resolution also provides that all income from the sale of lots shall be set apart and appropriated to the liquidation and payment of the outstanding notes of purchase. Call Council. Alderman Brush moved a Call of the Council, which was duly seconded and the Call of the roll showed the following: Present- Aldermen Anderson, Brush, Caldwell, Campbell, Crooker, Cummings, Giesey, Holman, Jones, Odell, Pillow, Schuber, Walker, Warren, Wellemer, Wortham - 16. Absent-Aldermen De Gress, Erwin, Metz, Schneider - 4. Alderman Pillow moved that absentees be excused. Adopted. Previous question. Alderman De Gress Came into the Council and moved the previous question. The motion prevailed by a rising vote of 13 to 4. The main question (the Adoption of the resolution offered by Alderman Anderson), was then put and carried by the following vote: --- Page break --- 459 July 19, 1886. Ord. to close up purchase of cemetery. Alderman Anderson introduced an ordinance providing for the establishment of a new Cemetery for the City of Austin, to be Known as the Oakwood Cemetery, and providing for the purchase of land therefor, and making an appropriation to carry the same into effect. A motion was made to suspend the rules and place the ordinance on its second reading which was adopted by the following vote. Yeas - Aldermen Anderson, Brush, Caldwell, Crooker, Cummings, DeGress, Giesen, Holman, Odell, Pillow, Walker, Warren, Wellmer, Wortham - 14. Nays - Aldermen Campbell, Jones and Schuler - 3. Name Cemetery and Section 1. Alderman Brush moved to amend the Caption and Section 1. by striking out "Oakwood" and inserting "Greenwood" Cemetery. Adopted. 10 acres for Colored people. Alderman Walker moved to amend section 6 by striking out "five" and inserting "ten" acres for the use of colored people for burial purposes. Adopted. Alderman Campbell was refused. Ord. passed. Vote. Motions were made to suspend the rules, and place the ordinance on its third reading, and that the ordinance do pass, both of which were adopted by the following vote: Yeas - Aldermen Anderson, Brush, Caldwell, Crooker, Cummings, DeGress, Giesen, Holman, Jones, Odell, Pillow, Walker, Warren, Wellmer, Wortham - 15. Nay - Alderman Schuler. Pet. J.F. McKinley A petition from J. F. McKinley asking for $150 as damages to his person, horse, buggy and harness, caused by a team belonging to the City colliding with his buggy. Referred to --- Page break --- 460 July 19, 1886. The Committee on Streets, Alleys, etc., for investigation, and report at next meeting of the Council. Ord. to pay Alderman Odell introduced an ordinance appropriating July pay rolls. $3083 to pay officers and regular employees of the City; also, $167.00 to pay employees of the City and County hospital each for the month of July, 1886. Motions were made to suspend the rules, and place the ordinance on its second and third readings, and that the ordinance now pass all of which were adopted by the following Vote. Ord. passed Yeas- Aldermen Anderson, Brush, Caldwell, Crocker, Cummings, DeGress, Giesen, Holman, Jones, Odell, Pielow, Schuber, Walker, Warren, Wellmer, Wortham, total 16. Move chili Alderman Schuber introduced a resolution stands. directing the City Marshal to have the Chili Stands on Pecan Street removed. Adopted. Make map Alderman Cummings offered a resolution, pauper burial which was adopted, requiring the City Engineer to ground. make a map of the ten acres of land in the new Cemetery, set aside by Ordinance for burial of paupers, and that each grave be numbered and that the City Sexton be furnished with said map and be required to record the name of paupers when buried in the appropriate place, with the number of grave used. Alderman Crocker introduced an Ordinance Ord. to improve appropriating $150.00 for improving the street Engine house hill in front of Fire Hall on Hickory Street. Motions were made to suspend the rules and place the Ordinance on its second and third readings, both of which were adopted by the following Vote: Yeas Aldermen Anderson, Brush, Caldwell, Cummings, DeGress, Giesen, Holman, Jones, Odell, Pielow, Schuber Walker, Warren, Wellmer, Wortham - 15. Nay - Alderman Caldwell. On motion the ordinance passed. Ord. to pay for Alderman Wortham introduced an Ordinance printing revised making appropriation to pay for the printing ords. and binding of the revised Civil and Criminal --- Page break --- 461 July 19, 1886. Ordinances of the City of Austin. The ordinance was read, after which motions were made to suspend the rules and place the ordinance on its second and third readings, and that the ordinance now pass, all of which were adopted by the following vote; Passed. Yeas- Aldermen Anderson, Brush, Caldwell, Cooper, Cummings, Degress, Giesen, Holman, Jones, Odell, Pillow, Schuber, Walker, Warren, Wellmer, Wartham - 16. "Stands." Alderman Odell offered a resolution naming the east side of Brazos between Pine and Cedar Streets as a stand for wagons. Amendments Alderman Brush moved to amend by adding "and on market house hill." No objection. " Alderman Cummings moved to amend by adding "and block No. 59." No objection. The resolution was adopted as amended. $700 restored Alderman Jones introduced a resolution to genl fund restoring to the general fund $700, which was appropriated March 1, 1886, to lay flag stones on Certain Street Crossings. Adopted. Cistern top. Alderman Brush moved that the City engineer be required to lower the top of the Cistern in front of Damertz drug store to a level with the Street. Adopted. Charges-City Alderman Cummings offered a resolution prohibiting hospital-per the City physician and resident physician of the City day. and County hospital from charging any private patient who pay the regular per diem charge any other or further amount.
