1886 Austin Opium Ban, Budget Report & Street Issues

Opium Smoking Banned – City Council passed an ordinance prohibiting opium smoking and punishing opium den operators, reflecting growing concerns about drug use in Austin.

City Budget Stable – The treasurer reported a cash balance of $7,112.17 with estimated income of $47,869.55 through March 1887, against estimated expenses of $45,750.00.

Street Damage Claims Rejected – The Committee on Streets reported against claims from residents and merchants (Dr. Firebaugh, Carl Mayer, and J.F. McKinley) seeking compensation for damages caused by city street work and city vehicles, with no action taken.

Public Health Concerns – The physician's report noted considerable sickness in the city with 20 scarlet fever cases reported in July, and the sexton recorded 46 deaths, prompting hospital committee review.

Alleyway Closure Approved – Council authorized property owners in block 52 of Graham's addition to close a north-south alley running through their block.

468 A Regular Meeting of the City Council. Austin Tx. August 02, 1886. Hon J. W. Robertson, Mayor, presiding: Roll Call - Present: Aldermen Anderson, Brush, Campbell, Cummings, deGress, Giesen, Jones, Odell, Walker, Warren, Wellmer, Wartham - 12. Absent - Aldermen, Caldwell, Crooker, Ervin, Holman, Metz, Pillow, Schneider, Schuber - 8. Alderman Crooker, Schuber and Holman came in. On motion, the minutes of the last regular meeting of the Council were adopted as printed. Alderman Walker presented a Claim from J. W. Gassaway for $70, for services as a secret officer during a portion of the months of April and May, 1886. Laid Over. A Communication from Chas. A. Newning, stating that he desired to purchase the City's interest in land on the South side of the river, Known as the pest grounds, was read and referred to the Committee on Hospital. The report shows an actual cash balance this date (August 2,-86) of $7,112.17 Estimated income to March 1, 1887, including the cash balance on hand $47,869.55 Estimated liabilities to same period $45,750.00 In the estimate of expenses the cost of improving streets is not included except the feed of teams & pay of drivers. Laid over till printed. Claims of Firebaugh, The Committee on streets, Alleys, etc. reported adversely on the claims of Dr. A. Firebaugh and Carl Mayer for costs of replacing etc. water pipes interfered with by City Street gang; also J. F. McKinley on petition and Claim of J. F. McKinley for damages to his person, buggy and horses, caused by colliding with a team belonging to the City. No action was taken on the reports. Police Comtee. The Committee on police reported that they had report on examined the marshal's report for the month of Charges June and found it correct. Action deferred. The same Committee, to whom was referred the charges against marshal Lucy and policemen Gibson and O'Banion, by Dr. W. Y. Leader, reported, stating that the charge against marshal Lucy had been withdrawn, and that as articles 330 and 332, inclusive, of the City ordinances, placed the policemen entirely under control of the mayor and marshal, they had no authority to investigate the charges. No action was taken on the report. Aldermen Schneider and Caldwell came in. Ord- to Close Alderman Northam presented an ordinance Alley in block Authorizing the owners of block No. 52, in division D 52 Div. D. Graham's addition to the City of Austin, to close the alley running from north to south through said block, and moved that the rules be suspended and the ordinance placed on its second reading, which was adopted by the following Vote: Yeas- Aldermen Anderson, Brush, Caldwell, Campbell, Crooker, Cummings, DeGress, Giesen, Holman, Jones, Odell, Schneider, Schuber, Walker, Warren, O'Kellemer Northam - 17. --- Page break --- 471 Aug. 2-86. Alderman Cummings introduced a resolution as follows: Marshal to "Resolved, That whenever a nuisance remove exists, that the City marshal shall have the authority nuisances to demand of the City engineer and Chairman Street Committee, Whose duty it shall be to have the matter attended to at Once, by City teams if necessary." amended. Alderman Schuber moved to amend by striking out "Chairman Street Committee" and inserting "Street Commissioner." No objection. " Alderman Odell moved to amend by adding "The marshal shall use the City prisoners and Scavenger Carts in abating nuisances involving the public health". Adopted. The resolution was then adopted as amended. Disposing of Alderman Cracker introduced a resolution to bound ords. dispose of the bound and interleaved revised Civil and Criminal Ordinances of the City. The resolution provides that each officer, Alderman and the Chief of the fire department Shall be furnished with One Copy. The resolution was adopted. C.E. lower Alderman Brush moved that the City engineer top of cistern be required to have the top of the Cistern in front of Damoetg's Store, on Congress avenue lowered to a level with the Street and report cost of same to the Council. Adopted. Opium. Alderman Anderson introduced an Ordinance Prohibiting opium Smoking in the City, and punishing the keepers of Opium dens. Motions were made to suspend the rules and place the Ordinance on its Second and Third Readings, both of which were adopted by the following Vote: Yeas - Aldermen Anderson, Brush, Caldwell, Campbell, Crooker, Cummings, DeGress, Giesen, Helm, Jones, Odell Pillow, Schneider, Schuber, Walker Warren, Wellmer, Wortham - 18. On motion, the Ordinance was passed. Kirk. A Claim from Jno P. Kirk for $150, --- Page break --- 472 Aug 2. 86 for services as a secret officer during a portion of January and February, was Referred to the Committee on police. Ord- to pay Alderman Odell offered an Ordinance appropriating approved ofc- $1268.63 to pay approved accounts. A motion was made to suspend the rules and place the ordinance on its second reading, which was adopted by the following vote: Yeas– Aldermen Anderson, Brush, Caldwell, Campbell, Crooker, Cummings, deGress, Giesen, Holman, Jones, Odell, Fillow, Schneider, Schuler, Walker, Warren, Wellmer, Wartham. Total 18. amended. Alderman Walker moved to amend by adding $74 to pay J W Gassaway for services rendered as secret officer in April and may Adopted. The Caption was changed to read $1,342.63. Motions were then made to suspend the rules and place the Ordinance on its third passed reading, and that the ordinance now pass, both of which were adopted by the following vote: Yeas– Aldermen Anderson, Brush, Caldwell, Campbell, Crooker, Cummings, deGress, Giesen, Holman, Jones, Odell, Fillow, Schneider, Schuler, Walker, Warren, Wellmer, Wartham– 18. Spl- Comtee. Alderman deGress introduced a resolution which ascertain amt was adopted, directing the mayor to appoint a money used Special Committee of five, to ascertain the without consent amount of money taken from the different wards of aldermen– under the direction and control of the engineer and Street Committee without the authority of the Aldermen of the different wards, and Report to the City Council by Ordinances at its next meeting, the amount so taken and used; and further, Report an Ordinance to return to the different wards the amount of money so used. Alderman DeGress moved that the Council go into executive Session. Adopted. Reduce police force to 15. Tabled! Alderman DeGress moved that the police force be reduced to 15. Tabled!
