283 The minutes of a Regular Meeting of the City Council. Austin Tex. April 16, 1888.
Hon. J. C. DeGress, President of the board of Aldermen, Presiding. Roll Call. Present Aldermen, Assmann, Boland, Campbell, DeGress, Fisher, Haigler, Linn, Odell, Platt, Schneider, Townsend, Wilson, Northam - 13. Absent, Aldermen Brush, Caldwell, Graham, Jones, Metz, Phillips, Pillow - 7. Alderman Fisher moved a call of the Council: Adopted. On motion, the Call was suspended. Alderman Northam moved that the minutes of the last meeting of the Council, where reference is made to the Printers Home, be amended by striking out "two aldermen," and inserting in lieu thereof "two members of the City Council" The amendment was agreed to and the minutes were then adopted. Alderman Wortham presented a petition from Committee on repairs of Protection Hose Company No. 3, Austin Fire Department, requesting an appropriation of $60 for the purpose of repairing truck house, and painting front of same. Read and laid over. Alderman Fisher presented a petition from citizens of the Sixth Ward, asking that petition of John Schlueder, for permission to operate a slaughter pen in the Sixth Ward, at or near Shoal Creek, be not granted. Laid over. A recommendation from the City marshal, that pound fees collected from Mrs Odom through mistake, be refunded to her, was introduced and adopted. Alderman Jones entered and answered to his name. A report from the City Treasurer from April 2 to April 16, 1888, was introduced. It shows: Balance April 2 $9,879.98 Receipts 5,411.112 Total $ 15,291.110

Ordered filed. The Committee on streets, bridges, etc., reported on a resolution, requiring the owners of the telephone poles now on East Fourth Street, to remove and place them near the edge of the Sidewalk, stating that the owners promised to do so. Report ordered filed.
1016 1. The same Committee submitted a report on a petition of Citizens, requesting that East 13th Street, between Red River Street and East Avenue, be repaired, recommending that the street be improved as soon as the teams can be spared for that purpose. Report received and filed.
V. Schmidt The Committee on finance and revenue offered a report on a petition from V. Schmidt requesting that taxes assessed against his property, erroneously rendered, be allowed him as a credit. The report recommends that the assesser and Collector be authorized and directed to give said Schmidt Credit for $34.67, the amount of tax assessed against his property erroneously rendered. The report was adopted.
Marshal's The reports of the Police Committee on the Marshal's reports reports for the months of February & March, 1888, were presented and ordered filed. They state "the reports are Correct."
J. Schlueter The Committee on Sanitation and Sewerage presented an unfavorable report on a petition from John Schlusten for permission to establish a slaughter pen in the northwestern Corner of lot 10, Div. 3 West of Shoal Creek. Report adopted.
Farmers Alderman Fisher presented the following letter and Alliance resolution:

petition Submitted to that Han. Woody, in February, from the Farmers Alliance, relative to the S 1/2 of block 59 and the Public Square immediately South of it, for market purposes. It is the desire of a Committee to use the same before the Legislature, if favorable. (Signed) J.R. Ray, J.W. Cloud, S. C. Granberry, F.E. Smith, Committee.
Resolution Be it resolved Etc., That the Mayor and City attorney are hereby instructed to enter into the necessary Contracts with the Farmers Alliance of this County, to Cede for their use for a term of years, for a Cotton and Produce mart, the South half of block 54, or the Public Square immediately South of it, if in their opinion it Can be legally done. Adopted.
Alderman Haigler presented an ordinance appropriating money ($500) for graveling Water street from Congress Avenue Eastward to the city limits. The Ordinance was read first time, after which Alderman Wortham moved a call of the Council, which was adopted. Alderman Fisher moved that the Call be suspended. Carried. Alderman DeGress offered an Ordinance appropriating eight hundred dollars ($800) to purchase a two- horse four wheel hose Carriage for East Austin Fire Company. Alderman Pillow entered and answered to his name. The Ordinance was then read first time, after which motions were made to susp- end the rules and place the ordinance on its second and third readings, and that it do pass; all of which were adopted by the following Vote: Yeas- Aldermen Toland Campbell, DeGress, Fisher, Haigler, Jones, Lima, Odell, Pillow, Platt, Schneider, Townsend, Wilson, Wortham-

Alderman Campbell introduced a petition from J. L. Driskill, Ned Green, Wesley Stewart and Fred Sterzing, asking to be released from Judgme[nt] obtained against them in the month of January, 1888, in the County Court of this County, as sureties upon appeal bonds in the following cases appealed from the Recorder's Court in the month of January 1881, towit: The City of Austin V.S. John Thornton, No. 4502, and The City of Austin V.S. John Thornton, No. 4503. The petition was endorsed by the City attorney, and on motion was granted. Alderman Fisher was called to the Chair. The Committee on finance and revenue presented a report, on a resolution refunding to Mrs. Houston $9.54, the same being an erroneous assessment on lots 1 and 2, block 81. The report recommends that the amount be refunded. Adopted. Alderman DeGress, President of the Board, took the Chair. Alderman Wortham introduced an Ordinance appropriating the sum of $3,821.69 for the purpose of paying officers and regular employes of the City and City and County Hospital, each for the month of April, 1888, and also approved accounts. The Ordinance was read first time, after which the rules were on motion suspended by a vote of two-thirds of a full Board. Alderman Wortham then moved to amend Sec. 1 by inserting the sum of $60 for the purpose of repairing and painting the front of the house of Protection Hose Company No. 3. Adopted. Alderman Wortham again moved to amend Sec. 1 by adding $3.50 to refund to Mrs Odom, pound fees erroneously collected. Carried. The caption and section one were then changed to read "$3,885.19" instead of "$3,821.69" and on motion the rules were suspended and the ordinance placed on its third reading and passed by the following vote: Yeas - Aldermen, Assmann, Boland, Campbell, DeGress,

291 Fisher, Haigler, Jones, Linn, Odell, Pillow, Platt, Townsend, Wilson, Wortham - 14. In accordance with a resolution recently adopt by the City Council, Alderman Wortham nominated Mayor Nalle for election as a delegate to go to Kansas City in the interest of securing the location of the proposed Printers' Home, near this City. On motion, he was unanimously elected. Alderman Fisher then nominated Alderman Pillow for the same purpose. Alderman Assmann nominated Aldermann DeGress, who declined. Alderman Campbell nominated Alderman Linn. On motion, Alderman Pillow and Linn were unanimously elected. Alderman Linn then called up an Ordinance appropriating money ($500) for graveling Water Street from Congress Avenue eastward to the City limits, and moved to suspend the rules and place the Ordinance on its second reading. Motion lost Yeas - Aldermen Assmann, Boland, Campbell, DeGress, Fisher, Haigler, Jones, Linn, Odell, Pillow, Schneider, Townsend, Wortham - 13. Nays - Aldermen Platt, Wilson - 2. Alderman Fisher then introduced "An Ordinance appropriating money ($800), for graveling Certain Streets leading to the drill grounds." It was read first time, after which a motion was made to suspend the rules and place it on its second reading. Lost. Yeas - Aldermen Assmann, Boland, Campbell, DeGress, Fisher, Haigler, Jones, Linn, Odell, Pillow, Platt, Schneider, Wortham - 13. Nays - Aldermen Townsend, Wilson - 2. On motion, the Council then adjourned Milton Morris City Clerk.
