400 The Minutes of a Regular meeting of the City Council Austin Tex., September 03, 1888. Hon. Joseph Nalle, Mayor, presiding. Roll Roll Call. Present Alderman: Boland, Brush, Caldwell, Campbell, DeGreer Fisher, Graham, Haigler, Jones, Linn, Metz, Phillips, Pillow, Platt, Townsend, Wilson, Wortham – 18. Call. Absent – Aldermen Odell and Schneider. Total – 2. Minutes. The minutes of the last meeting of the Council were adopted as printed. Mrs. M. A. C. Wilson Alderman Wortham presented a petition from Mrs M. A. C. Wilson requesting that certain property, donated by her for Church purposes, be relieved from taxation. Referred to the City attorney for his opinion, as to whether relief can be granted or not, and how. Tr. Peter Smith Alderman Phillips introduced a petition from Mr. Peter Smith, requesting the Council to relieve him from paying taxes of 1887 on four acres of block 4, division 3, which was by error duplicated and twice assessed. On motion the assessor and Collector was authorized to give Mr Smith credit for the taxes erroneously assessed. Ald Odell Alderman Odell entered and answered to his name. Marshals, Alderman Graham of the Police Committee, presented report. a report on the Marshals report of for the month of July, 1888, stating the report was examined and found correct. School fund The Ordinance Committee presented a favorable report on an Ordinance authorizing the City Assessor and Collector to pay to the treasurer of the board of School trustees all school taxes heretofore or hereafter Collected by him. The report was read and laid Over. Cem - J.S. Palm The Special Committee appointed to Consider the propositions of Mr. Jos. Palm to extend the City Cemetery, presented a favorable report on the proposition to give the City twenty four lotsthe City to remove the fences. " The Committee also, presented a resolution directing the Mayor and City attorney to obtain title to the said twenty four lots, and that the terms of the proposition be accepted and Complied

402 " with. Alderman Campbell moved the adopt and resolution. Ald. Schneider Alderman Schneider entered and answered to his name. Prest. Bd. a Alderman De Gress, president of the board of Aldermen, took the Chair. Previous quest Alderman Campbell moved the previous question, which ion - Cemetery. was ordered. " The main question was then submitted, and adopted by the following Vote: Yeas - Aldermen: Assmann Caldwell, Campbell, Graham, Haigler, Jones, Metz, Platt, Schneider, Wilson - 12. Nays - Aldermen: De Gress, Fisher, Linn, Odell Phillips, Pillow, Townsend, Wortham - 8. Mayor in Chair Mayor Nalle took the Chair. Cemetery - point Alderman Phillips made the point of order that the of order. Resolution had not been legally adopted inasmuch as Rule VI. of the Rules of Order of the City Council requires that "all Ordinances and resolutions of a general character, shall be read in Council on three several days, unless two-thirds of a full board shall vote a suspension of this rule", the resolution having been read but one time. The Chair decided Sustaining the ruling of the president of the board, after which Alderman Phillips appealed from the decision of the Chair, which resulted in Sustaining the ruling of the Chair. Light. Alderman Odell moved that the special Committee appointed to Consider the question of placing a light near the Swedish Church in the Seventh ward, be discharged, as an agreement Can not be reached. Adopted. Alderman De Gress then moved that the entire matter of the light above named be referred to the Mayor, with power to act. Carried. School fund. An Ordinance authorizing the City assessor and Collector to pay to the Treasurer of the board

of School Trustees all School Taxes heretofore Or hereafter Collected by him, was taken upon on its second reading, and an motion of Alderman Platt, laid upon the table by the following Vote: YeasAldermen Assmann, Boland, Brush, Caldwell, Degress, Haigler, Jones, Metz, Odell, Platt, Wilson --11. Nays- Aldermen: Campbell, Fisher, Graham, Linn, Phillips, Pillow, Schneider, Townsend, Wortham --9. Cme- J. S. Palm The Mayor introduced a Supplemental proposition from Mr J. S. Palm proposing in addition to his first proposal to enlarge the City Cemetery to give the City Sixty-full lots and twenty half lots along the drain and all the ground on the north side of the street and all ground on the east side of the Walk along the fence, provided the City will enclose and plat the eight acre tract adjoining the Cemetery. Alderman Linn moved to lay it on the table. Rejected: Yeas- Aldermen: Degress, Fisher, Graham, Linn, Odell, Phillips, Pillow, Townsend, Wortham - 9. Nays- Aldermen: Assmann, Boland, Brush Caldwell, Campbell, Haigler, Jones, Metz Platt, Schneider, Wilson --11. The Mayor then introduced a resolution authorizing the Mayor to Contract with J. S. Palm for enclosing land adjoining the City Cemeterynamely the land embraced in the last proposition. Alderman Jones, then moved to adopt it. Carried. Yeas- Aldermen: Assmann, Boland, Brush, Caldwell, Campbell, Haigler, Jones, Metz, Platt, Schneider, Wilson --11. Nays- Aldermen: Degress, Fisher, Graham, Linn, Odell, Phillips, Pillow, Townsend, Wortham -- 9. Alderman Graham, then gave notice that he would move a reconsideration of the vote by which the first resolution accepting Mr Palm's

404 " proposition was adopted, at the next meeting of the City Council. Alderman Campbell moved to reconsider the Vote by which the first resolution was adopted and to lay that motion on the table. The motion prevailed by the following vote: Yeas - Aldermen: Boland, Brush, Caldwell, Campbell Haigler, Jones, Metz, Platt, Schneider, Wilson-10. Nays - Aldermen: Assmann, DeGress, Fisher, Graham, Linn, Odell, Phillips, Pillow, Townsend, Wortham - 11. Mayor Voted "aye" The Mayor then voted "aye" making 11 votes in the affirmative. Cemetery: Alderman Campbell then moved to reconsider the Vote by which the second resolution accepting Mr Palm's offer was adopted and to lay that motion on the table. The motion was lost by the following vote: Yeas - Aldermen: Boland Brush, Caldwell, Campbell, Haigler, Jones, Metz, Platt, Wilson - 9. Nays - Aldermen: Assmann, DeGress, Fisher, Graham, Linn, Odell, Phillips, Pillow, Schneider, Townsend, Wortham - 11. Hospital. Alderman Wilson presented a resolution authorizing the hospital committee to advertise for bids for fifty cords of wood for the use of the hospital. Carried. Greenwood Cemetery Alderman Wortham offered an Ordinance authorizing burials in Greenwood Cemetery. It was read first time, after which Alderman Boland moved to lay it on the table, which was done by the following vote: Yeas Aldermen: Assmann, Boland, Brush, Caldwell, Campbell, DeGress, Haigler, Jones Metz, Phillips, Platt, Schneider, Wilson - 13. Nays - Aldermen: Fisher, Graham, Linn, Odell, Pillow, Townsend, Wortham - 7. approvd. accts. Alderman DeGress then presented an Ordinance appropriating the sum of $1,457.60 for the purpose

It was read first time after which motions were made to suspend the rules and place it on its second and third readings and that it do pass, all of which were adopted by the following Vote: Yeas - Aldermen: Assmann, Boland, Brush, Caldwell, Campbell, Dedress, Fisher, Graham, Haigler, Jones, Linn, Metz, Odell, Phillips, Pillow, Platt, Schneider, Townsend, Wilson, Wortham - 20. Alderman Dedress then introduced an Ordinance 3.100$ Sept. appropriating the Sum of $3,100 for the purpose of Salaries. paying officers and regular employes of the City for the month of September, 1888. It was read first time, after which motions were made to suspend the rules and place it on its second and third readings and that it do pass all of which were adopted by the following vote: Yeas - Aldermen Assmann, Boland, Brush, Caldwell, Campbell, Dedress, Fisher, Graham, Haigler, Jones, Linn, Metz, Odell, Phillips, Pillow, Platt, Schneider, Townsend, Wilson, Wortham - 20. Veto. The Mayor's veto of an Ordinance appropriating $800 for The purpose of purchasing a hose Carriage for East Austin Hose Co. No. 4, which was on the table subject to Call, was Called up. The mayor then asked unanimous consent of the Council to the withdrawal of the Same, which was given. The Council then adjourned. Milton Morris City Clerk.
