Aldermen Assmann, Boland, Brush Degress, Fisher, Graham, Haigler, Jones, Linn, Metz, Odell, Phillips, Pillow, Platt, Schneider, Townsend, Wilson – 17. 412 The minutes of an adjourned Meeting of the City Council. Austin Tex. Nov. 7, 1888. Hon. Joseph Nalle, Mayor, presiding. Roll Call. Present Aldermen - Assmann, Boland, Brush, Caldwell, Campbell, Degress, Fisher, Graham, Jones, Phillips, Platt. 11. Call. Absent Aldermen - Haigler, Linn, Metz, Odell, Pillow, Schneider, Townsend, Wilson. Northam -9. Minutes. The minutes of the last meeting of the City Council were adopted as printed. W. Moses Alderman Phillips presented a petition from W. Moses, proposing a Compromise of back taxes due on N 1/2 of Lot 5 and E 1/2 of lot 6, in block 73. Referred to the City Attorney and Assessor and Collector, with power to act as they may deem proper. A. Messer. Alderman Campbell presented a petition from A. Messer proposing to Compromise taxes due on lot 8, block 107. Referred to City attorney and assessor and Collector, with power to act. Fred Sterzing The Mayor presented a petition from Fred Sterzing, assessor and Collector requesting leave of absence for two or three weeks. Granted. A. Rypinski Alderman Boland introduced a petition from Amelia Rypinski, stating that Lot 11, in block 4, of a subdivision of Outlot No. One, in division A was Sold for taxes and bid in by the City, and that interest is now due on Said back taxes. She asks that She be released from paying interest on back taxes inasmuch as She will redeem said property and pay all taxes and Costs due thereon. On motion the interest was remitted. 6th Ward Streets Alderman Graham presented a memorial from the Committee of Citizens of the Sixth Ward, Calling attention to the deplorable and almost impassable Condition of the streets of that ward, and

especially to those around the School building and requesting that speedy relief may be given. Referred to the Street Committee. N.V. Dithlinger Alderman Degress offered a petition from N.V. Dithlinger, requesting permission to erect an iron shed, to be supported by wooden posts, in rear of lots 7 and 8, in block 68, on San Jacinto Street, in the fire limits. Referred to the fire commissioners. M. Pague The City attorney was excused. Alderman Jones presented a petition from M. Pague, requesting permission to erect Scales in front of his stables on East Fourth Street. Referred to the Street Committee with power to act. Jno. Odell. Alderman Odell, of the Seventh Ward having removed out of that Ward, presented his resignation, which was accepted. Bills. The Mayor presented bills which he Contracted on account of entertaining Certain distinguished Visitors to the City. They were referred to the finance Committee with Instructions to approve them. City atty. The Mayor presented, and had read a letter which Judge Hancock he had received from the City attorney, Concerning Counsel to assist him in the Case of Jas. H. Raymond V. the City of Austin. The letter States that Judge Hancock will assist the City attorney in the Case for $500. On motion the Mayor was authorized to employ Judge Hancock as above indicated. Marshals & Rpt. The Police Committee presented a report on report. the Marshal's report for the month of September, Stating they had examined the Same and found it Correct. Watering The Water and gas Committee presented a trough. report on a petition of Citizens, requesting that a watering trough be placed at the north west Corner of the Intersection of East Pecan and Comal Streets, recommending that the petition be granted as soon as the funds of the City will admit of it. 414 "Hands". Laid on the table Subject to Call. Alderman Phillips introduced an Ordinance amending Article 72, of Chapter 10, penal Code. The intent of the amendment is to regulate and control the "Standing" on the streets to express and other wagons for hire Referred to the Ordinance Committee. Absent, Aldermen – Assmann, Jones, Pillow, Townsend 4. Light. Alderman Platt presented a petition from Citizens, requesting that a light be placed at the northeast corner of Fifth and Brazos Streets. Referred to Committee on Water and Gas. Mrs. J. J. Houston. Alderman Wortham, by request, introduced a petition from Mrs. J. J. Houston, asking that the Council refund money paid to the City by her at tax sale for one half of lots 6 and 7 in block A. of 420 division B., and also lot 12 block 3 of 420 B and part of 140 by 120 feet subdivision block No. 2, in blocks No. 2 and 136. Alderman Platt moved to lay it on the table. Lost. It was Then referred to the City Assessor and Collector. a + c. Reports of Officers. 416 The health of the City still continues exceptionally good for this season of the year. Referred to hospital Committee. Alderman Pillow entered, and answered to his name. City Cllk. Report of City Clerk for the month of October, 1888: Total amount of warrants issued $4340.22 Referred to finance Committee. Sexton Report of City Sexton for the month of October, 1888: Total number of deaths 26 White 23 Colored 7 Referred to Cemetery Committee. The recorder of the fire department presented a copy of a resolution adopted by the board of fire Commissioners, requesting that a Twenty five Candle power electric light be placed in front of the engine house of Washington S. 417 Violated and forfeited. He states that he has been unable to see a copy of the lease, but believes that he has received reliable information Regarding the Conditions of the same, and that the lease is forfeited. Mrs Jones Alderman DeGress moved that the City Clerk be instructed to notify Mrs Jones that as the Condition of the lease has not been complied with, the same is abrogated. Adopted.
Fire Alarm. The following named Ordinance was taken up on its second reading; An Ordinance repealing an Ordinance entitled "An Ordinance authorizing the Mayor and fire Commissioners to enter into a Contract with the Union Fire Alarm Company of New York, for the rent of a fire alarm, to be used in the City of Austin, for a period of one year", passed January 16th 1888, and Annulling the Contract made under and by Virtue of said Ordinance. The Ordinance was then read a second time after which motions were made to suspend the rules. and place it on its third Reading and that it do pass, both of which were adopted by the following Vote: Yeas, Aldermen- Boland, Brush, Caldwell, Campbell, DeGress, Fisher, Graham, Haigler, Linn, Metz, Phillips, Pillow, Platt, Schneider, Wilson, Wortham - 16.
School Fund. Alderman Caldwell introduced an Ordinance authorizing the mayor to draw warrants in favor of the treasurer of the Board of School Trustees, and making appropriation to meet the same. It was then read first time, after which motions were made to suspend the rules and place it on its second and third readings and that it do pass, all of which were adopted by the following Vote: Yeas - AldermenBoland, Brush, Caldwell, Campbell, DeGress, Fisher, Graham, Haigler, Linn, Metz, Phillips, Pillow, Platt, Schneider, Wilson, Wortham - 16.

418 Amd'g art. 195. title 5 Alderman Pillow was then excused. Alderman Degress offered an Ordinance amending Article 195, title 5, Chapter 3, of the Revised Penal Ordinances. The amendment relates to the erection of buildings in the fire limits. It was referred to the Fire Committee. Alderman Degress introduced an Ordinance "n " 201 " 5" repealing article 201, title 5, Chapter 3 of the Revised Penal Ordinances. It relates to the manner of obtaining permission to erect Certain kinds of buildings in the fire limits of the City. Alderman Fisher moved to refer it to the Fire Committee, with instructions to report at the next meeting of the Council. Alderman Degress moved to table the motion. Carried. Yeas, Aldermen – Boland, Caldwell, Degress, Haigler, Metz, Phillips, Platt, Wilson - 8. Nays – Aldermen - Brush, Campbell, Fisher, Graham, Linn, Schneider, Wortham - 7. Alderman Phillips moved to refer it to the Ordinance Committee. Carried. Jones & Glass. Alderman Fisher introduced, by request, An Ordinance, repealing an Ordinance entitled, An Ordinance authorizing the Mayor of the City of Austin to enter into an agreement and make a lease with Jones & Glass for the City mill property, approved July 7, 1879. It was read first time, after which motions were made to suspend the rules and place it on its Second reading, which were adopted by the following vote: Yeas - Aldermen Boland, Brush, Caldwell, Campbell, Degress, Fisher, Graham Haigler, Linn, Metz, Phillips, Platt, Schneider, Wilson, Wortham – 15. It was then passed. Lone Star D.Co. Alderman Fisher presented, by request, An Ordinance authorizing the mayor to lease the City mill property to the Lone Star Ice Company for a period of twenty five years. 419 motion was made to suspend the rules and place it on its second reading, which was adopted by the following Vote: Yeas- Aldermen Boland, Brush, Caldwell, Campbell, DeGress, Fisher, Graham, Haigler, Linn, Metz, Phillips, Platt, Schneider, Wilson, Wortham - 15. The Ordinance was read a second time after which Alderman Linn moved to amend by striking out twenty five years, and inserting in lieu thereof ten years as the length of the lease. The amendment was lost. A motion was then made to suspend the rules and place the Ordinance on its third reading, which prevailed by the following Vote: Yeas- Aldermen Boland, Brush, Caldwell, Campbell, DeGress, Fisher, Graham, Haigler, Linn, Metz, Phillips, Platt, Schneider, Wilson, Wortham - 15. The Ordinance was then read a third time, and on motion passed. Cypress st. Alderman Caldwell presented an Ordinance abolishing and vacating as a public Street that portion of Cypress street between Congress Avenue and Colorado Street. It was read first time, after which motions were made to suspend the rules and place it on its second and third readings, which were adopted by the following Vote: Yeas - Aldermen Boland, Brush, Caldwell, Campbell, DeGress, Fisher, Graham, Haigler, Linn, Metz, Phillips, Schneider, Wilson, Wortham - 14. Nay - Alderman Platt. The Ordinance was then read a third time and on motion passed. Election. Alderman Caldwell presented a resolution Ordering an election in the City of Austin on Monday, December 3, 1888. First Ward - Election at Walsh's lime house. Judges: Patrick Scott, JW Howard, Fritz Meincher. Second Ward - Election at Kingsbury's Stable. Judges: Ben Henricks, J.W. Kyle, S.S. Kingsbury. Third Ward - Election at City Hall. Judges: J. Harrell Jr., E.C. Bartholomew, R.A. Harrison. Fourth Ward - Election at Goodman's brick building. Judges: A.C. Hunter, W.S. Bowles J. Schuber. Fifth Ward - Election at Protection Fire Co's. Hall. Judges: Geo. Warren, Chas. Huppertz, W. Jacoby. Sixth Ward - Election at Dabney building. Judges L. Manasse, A. Wellbacher, A.P. Foster. Seventh Ward - Election at Wellmer's Mill. Judges: Ed. Huppertz, J.B. Rogers, H.L. Moffitt. Eighth Ward - Election at County Court House. Judges: A. Deffenbaugh, Joseph Lee, M. McCarty. A motion was made to suspend the rules and place it on its third reading, which was adopted by the following Vote: Yeas - Aldermen - Boland, Brush, Caldwell, Campbell, Degress, Fisher, Graham, Haigler, Linn, Metz, Phillips, Platt, Schneider, Wilson, Wortham - 15. The resolution was then read a third time and on motion adopted. Approved a/cs. Alderman Degress introduced an Ordinance Appropriating the sum of $2933.73 for the purpose of paying approved accounts. Alderman Phillips moved that the account of Morley Bros, for $539.24, and the account of Shumate & Co. D. J. Shumate & Co. for $53, Stand approved, and that they be paid. Carried. Alderman De Gress then moved that the sums named be added to the Ordinance. Adopted. The Caption and Section 1 of the Ordinance were then Changed to read "$3,525.97" instead of "$2,933.73," and motions were made to suspend the rules and place it on its third reading, and that it do pass, both of which were adopted by the following vote: Yeas, Aldermen - Boland, Brush, Caldwell Campbell, De Gress, Fisher, Graham, Haigler, Linn, Metz, Phillips, Platt, Schneider, Northam - 14.
Nov. Pay roll. Alderman De Gress presented An Ordinance appropriating the Sum of $3100 for the purpose of paying officers and regular employes of the City for the month of November, 1888. It was read first time after which motions were made to suspend the rules and place it on its Second and third readings, and that it do pass, all of which were adopted by the following vote: Yeas - Aldermen Boland, Brush, Caldwell, Campbell, De Gress, Fisher, Graham, Haigler, Linn, Metz, Phillips, Platt, Schneider, Northam - 14.
