422 Minutes of a regular meeting of the City Council Austin, Tex. December 03, 1888. Hon Joseph Nalle, Mayor, presiding. Roll Call. Present, Aldermen - Assman, Boland, Caldwell, Campbell, DeGress Roll Fisher, Graham, Haigler, Jones, Linn, Metz, Platt Schneider, Townsend, Wilson, Wortham - 16. Call. Absent, Aldermen - Phillips, Pillow - 2. Minutes. The minutes of the last meeting of the City Council were adopted as Printed. N.V. Ditlinger. The recorder of the fire department presented a report of the action of the board of fire Commissioners on an application of N.V. Ditlinger for permission to erect a building in the fire limits. It states that the permission was not granted. G. A. Brush. A communication was received from Mr. G. A. Brush in regard to his Vacating his seat in the Council. No action was taken on it. Sallie Haywood. The Mayor laid before the Council a communication Wm. Darnwell from Sallie Haywood, stating that Policeman Darnwell Owes her $10 borrowed money, and will not pay the same. Referred to the Police Committee with instructions to investigate and report to the Council at the next meeting. Mayors. The Mayor then presented the following message, message. Which was referred to the Committee on Printing to be printed in the Evening Dispatch and also in the Daily Statesman; provided a moderate rate be given. Marshals. Report of officers for the month of November, 1888: reports. City Marshals report: Total amount of fines and costs assessed in recorder’s Court $641.55 Collected in Cash $277.65 Worked out 223.35 Escaped 69.60 Granted new trial and acquitted 11.70 Carried forward 59.25 Total ~641.55 Back fines, etc, Collected $53.70 Total arrests made 63.

M. Pogue. Referred to Hospital Committee. The Street Committee presented a favorable report on petition of M. Pogue for permission to erect Scales in front of his stables on East Fourth Street. No action was taken on it. 6. Ward. The Same Committee also presented a favorable report on the petition of the Citizens' Committee of the Sixth Ward, asking that Some of the Streets in that Ward be worked, but state that there is no funds on hand for improvement of Streets. No action was taken on the report, The fire Committee asked for further time in which to prepare reports. Granted. Light. The Committee on water and gas presented a favorable report on the request of the board of fire Commissioners for a light to be placed in front of the house of Washington Fire Engine Co. The report recommends that a light be placed there as Soon as the finances of the City will

424 Light. Permit. No action was taken On it. The Same Committee introduced a favorable report On a petition of Citizens requesting that a light be placed at the northeast Corner of Fifth and Brazos Streets. The report advises that the light now On Seventh Street, between Congress Avenue and Brazos Street, be moved to that place. Report adopted. approved accts. Alderman Degress presented An Ordinance appropriating the Sum of $1399.42 for the purpose of paying approved accounts. It was read first time, after which motions were made to suspend the rules and place it On its Second and third readings, and that it do pass, all of which were adopted by the following Vote: Yeas, Aldermen- Assmann, Boland, Caldwell, Campbell, Degress, Fisher, Graham, Haigler, Jones, Linn, Metz, Platt, Schneider, Townsend, Wilson, Wortham- 16. $3,100 $ to pay roll Alderman Degress also offered An Ordinance appropriating the Sum of $3100 for the purpose of paying Officers and regular employees of the City. It was read first time, after which motions were made to Suspend the rules and place it On its Second and third readings and that it do pass, all of which were adopted by the following Vote: Yeas, Aldermen - Assmann, Boland, Caldwell, Campbell, Degress Fisher, Graham Haigler, Jones, Linn, Metz, Platt, Schneider, Townsend, Wilson, Wortham- 16. In transfer funds Alderman Degress introduced a resolution directing the City treasurer to transfer $586.23 in the Cemetery fund; $140.23 in the back debt fund and $25 in the interest fund to the general fund. Adopted. Jno. J. Allan Estate. The mayor presented a report from the City's agents for Judge Jno. J. Allan Estate, in which they State they are offered $2 per acre for a portion of the Evans Shoemaker Survey in Newton County, and advise that the offer be accepted. On motion the Mayor was authorized to accept the offer and make the deed. Alderman Linn moved that the Council

426 Minutes of an Adjourned Meeting of the City Council Austin Texas December 8, 1888. Hon. Joseph Nalle, Mayor, Presiding. Roll. Roll Call. Present, Aldermen Alderman, Boland, Campbell, Degress Fisher, Graham, Jones, Linn, Metz, Pillow Platt, Townsend, Wortham -13. Call. Absent, Aldermen Caldwell, Haigler, Phillips, Schneider, Wilson -5. Minutes. The Minutes of the last meeting of the City Council were adopted as printed. Sell Jno. J. Allan Alderman Fisher introduced the following resolution land. which was adopted: "Resolution authorizing the Sale of the interest of the City of Austin in 4428 acres of land in Newton County, Texas: Whereas, Alexander Gilmer of Orange County, Texas, has offered two dollars per acre for the interest of the City of Austin in and to 4428 acres of land in Newton County, Texas, granted to Evans Shoemaker, the interest of Said City being an undivided One-half, Said land being part of the estate of John J. Allan, deceased: and, Whereas, It is to the advantage of Said City that Said land Should be Sold; therefore be it Resolved, by the City Council of the City of Austin, That the Mayor be and he is hereby authorized in the name of the City of Austin to sell Said undivided One-half interest in Said 4428 acres of land to Said Gilmer for two dollars per acre Cash, and to execute a Conveyance of all right, title and interest of the City of Austin in and to Said land. Section Second This resolution Shall take effect from and after its passage." Police Comtee The Committee on Police, to whom was referred the report on Complaint of Sallie Haywood against police officer Darnwell- W. M. Darnwell, Charging him with owing her ten Haywood. dollars borrowed money, which he refused to pay, presented a report on the same, stating that

The evidence failed to sustain the Charge. The report was then unanimously adopted. Alderman Linn moved that the Mayor appoint tellers to Canvass the returns of the elections held December 3 1888, for the purpose of electing Aldermen. The motion was adopted, and the Chair appointed Aldermen Linn, Wortham and Pillow as tellers. After Canvassing the returns, the tellers Submitted the following report: First Ward C. S. Metz F. Alderman Schneider entered and answered to his name. Alderman Fisher moved that the report of the Committee be Confirmed, and that the City Clerk be instructed to Call the roll of the newly elected Aldermen, and that they be requested to Come forward and receive notice of their election, and take the oath of Office. The motion was adopted and the roll called, and the following persons came forward: J. W. Graham, F. E. Jones, J. R. Lawrence, C. S. Metz, F. G. Morris, A. H. Newton, J. B. Nitschke, W. F. North, R. Platt, A. W. Townsend, W. Ziller. The mayor then notified the following persons of their election as Aldermen of the City of Austin for the ensuing term of two years: J. W. Graham, F. E. Jones, C. S. Metz, F. G. Morris, A. H. Newton, J. B. Nitschke, W. F. North, R. Platt, A. W. Townsend, W. Ziller. The mayor then notified J. R. Lawrence of his election as alderman of the City of Austin to fill out the unexpired term of Geo. A. Brush. Oath. The oath of Office was then administered to them by the mayor. Alderman Fisher moved that the old Council stand adjourned. Adopted. New Council. The new Council was immediately Called to Order by the mayor. Roll Call: Present Aldermen -

Art. 377 Amended Alderman DeGress introduced an Ordinance amending article 377, title 17, Chapter 1, of the Revised Civil Ordinances of the City of Austin. The object of the amendment is to make the article Conform to the State law. The Ordinance was read first time after which motions were made to suspend the rules and place it on its second and third readings, and that it do pass all of which were adopted by the following vote, and duly complied with: Yeas, Aldermen Assmann, Boland,
DeGress, Graham, Jones, Lawrence, Linn, Metz, Morris, Newton, Nitschke, North, Pillow, Platt, Schneider, Townsend, Wortham, Ziller – 18. Art. 381. Alderman DeGress offered an Ordinance amending Article 381, title 17, Chapter 2, of the Revised Civil Ordinances. This amendment is also in Conformity to State law. The Ordinance was read first time, after which motions were made to suspend the rules and place it on its second and third readings, and that it do pass all of which were adopted by the following vote, and duly complied with: Yeas, Aldermen – Assmann, Boland, DeGress, Graham, Jones, Lawrence, Linn, Metz, Morris, Newton, Nitschke, North, Pillow, Platt,
Schneider, Townsend, Wortham, Ziller – 18. Arts. 454 & Alderman Jones presented an Ordinance amending 455. Article 454 and Article 455, Chapter 4, title 17, of the Revised Civil Ordinances of the City of Austin. These amendments are also in Conformity to the State law. 430 Schneider, Townsend, Wortham, Ziller -18. Alderman DeGress introduced an Ordinance appropriating $99 to pay Judges of election, and other expenses. It was read first time, after which motions were made to suspend the rules and place it on its second and third readings; both of which were adopted by the following Vote, and duly Complied with: Assmann, Baland, DeGress, Graham, Jones, Lawrence, Linn, Metz, Morris, Newton, Nitschke, North, Pillow, Platt, Schneider, Townsend, Wortham, Ziller -18. It was then read a third time and on motion passed. The mayor then announced the Standing Committees, as follows: Committees Standing Committees of the City Council, appointed Dec. 8, 1888. 431 Charity. F. G. Morris, R. P. Platt, H. A. Linn. Alderman Linn moved that the Council proceed to elect a president of the board of Aldermen. Adopted The mayor appointed Aldermen North, Morris, and Lawrence as tellers. Alderman Linn nominated Alderman W. B. Wortham, and Alderman Breland nominated Alderman DeGress. Alderman DeGress requested his name withdrawn, and it was done. He then moved that the election of Alderman Wortham be made unanimous. The motion was unanimously adopted, and the Chair declared Alderman Wortham elected president of the board of Aldermen for the ensuing term of one year. Alderman Linn moved that the Council proceed to elect a Sanitary inspector. Adopted. Alderman Wortham nominated J. W. Johnson, and there being no other nominations, he moved that the City Clerk be instructed to cast the vote of the Council for J. W. Johnson. The motion prevailed was complied with and J. W.
