Roll Call: Present Aldermen - Assmann, Boland, DeGress, Jones, Lawrence, Linn, Morris, Nitschke, North, Pillow, Platt, Townsend, Wilson, Wortham, Zilger - 15. Absent, Aldermen - Graham, Haigler, Metz, Newton, Schneider - 5. The following Call was then read: Austin, February 16, 1889. To the Aldermen of the City of Austin: Gentlemen:- We, the undersigned aldermen, hereby Call a special meeting of the City Council of the City of Austin, to meet at the Council room in the City hall this evening, at 8.15 o'clock, to take such action as the Council may deem proper On An Ordinance pending entitled "An Ordinance Authorizing the mayor to draw warrants in favor of the treasurer of the board of School trustees, and making appropriation to meet the same"; and also to receive and act upon a Communication from the executors of the late Judge Allan. Alderman Linn then moved a call of the Council, which was agreed to. Ald. Graham Alderman Graham entered, and answered to his name. Alderman DeGress then moved to suspend the Call. Carried Allen- The mayor then introduced the following: Richardson [?] Austin Texas, February 11, 1889. To the Hon. City Council of the City of Austin: Gentlemen:- The undersigned executors of the will of the late John T. Allan, respectfully represent that nearly one year ago the presented a Communication to your honorable body, with a copy of the will of said John T. Allan, in which we asked you to accept the property and trust specified in said will. We have seen in the public newspapers that you

voted to accept the property, but we have received no official notice of your action. We are now ready to close our account of said estate, and have in our hands $7,087 in money which we are ready to pay over to the city. Before doing so, we respectfully ask that you accept the property and trust as specified in said will, and officially notify us of your action, so that we may file it in the record of the Case in the County Court of Travis County. Very Respectfully, J. F. Richardson, J. N. Goldbeck, Executors.
Alderman Morris moved to refer the Communication to the existing special Committee, to whom was referred the question of disposing of the Allen fund now in the City treasury. Alderman DeGress offered as a Substitute, a resolution providing "that the City of Austin does hereby accept the property and trust as specified in the will of the late John T. Allan, and that the executors of his will are hereby requested to turn over the money in their hands to the City assessor and Collector, taking his receipt for the same. That the mayor is directed to furnish the Hon. J. F. Richardson and Mr. L. N. Goldbeck, said executors, and the City assessor and Collector with a copy of these Resolutions." Ald. Schneider Aldermen Schneider and Metz entered and answered to their names. Platt, R. During the discussion, by Aldermen Platt and Linn, of the pending motion and Substitute Alderman Platt, laboring under a misunderstanding of a remark made by Alderman Linn, assaulted him. Alderman Platt apologized soon after the assault. Alderman Wortham then moved that the apology made by Alderman Platt be accepted and spread upon the minutes. Adopted. [illegible] The pending question, the adoption of the Substitute offered by Alderman DeGress for the motion made by Alderman Morris, was then voted on,

and the Substitute lost by the following vote: Yeas- Aldermen, Assmann, Boland, DeGress, Jones, Metz, Platt, Wilson, Ziller,-8. Nays- Aldermen- Graham, Lawrence, Linn, Morris, Nitschke, North, Pillow, Schneider, Townsend, Wortham-10. Alderman DeGress then moved to amend the motion made by Alderman Morris, by adding "and the Committee be instructed to report at the next regular meeting". The amendment was accepted and the motion as amended was adopted. School fund. An Ordinance authorizing the mayor to draw warrants in favor of the Treasurer of the board of trustees and making appropriations to meet the same, was taken upon its final passage and read for information. A motion was then made that the Ordinance do now pass, which was adopted by the following vote: Yeas- Aldermen: Graham, Lawrence, Linn, Morris, Nitschke, North, Pillow, Schneider, Townsend, Wortham, Ziller-11. Nays- Aldermen: Assmann, Boland, DeGress, Jones, Metz, Platt, Wilson-7. On motion the Council then adjourned Milton Morris, City Clerk.
