Absent Aldermen - DeBress, Graham, Haigler, Jones Lawrence, Metz, Morris, Newton, Kitschke North, Pillow, Schneider, Townsend, Wilson, Wartham, Ziller - 16. Alderman Linn moved that the Council stand adjourned until Wednesday night at 8 o'clock. Adopted. Milton J. Present- Assmann, Graham, Jones Lawrence, Linn, Morris, Platt, Schneider, Wilson, Wartham, Ziklon-11. Abs. Absent. Aldermen Boland, DeGress, Haigler, Motz, Newton, Nitschke, North, Pillow, Townsend-9. Alderman Linn moved a Call of the Council. Carried. Call Council. Suspen'd. Ald. Townsend. Minutes. The absentees having been sent for, the Call was on motion, Suspended. Alderman Townsend entered and answered to his name. Alderman Morris moved to Change the minutes of the last regular meeting of the Council by striking out "Morris" and inserting Lawrence as the name of the Alderman who introduced the ordinance relative to Cows running at large in the City. The change was agreed to, and the minutes as Changed were adopted. Jr. The report of the City treasurer from June 3, 1889, to July 1, 1889, was read and referred to the Finance Committee. Marshal. The City Marshal's report for the month of June 1889, was also read and referred to the Police Committee. Clerk. The City Clerk's report of warrants issued during the month of June 1889, was read and referred to the Finance Committee. City Phys. The City Physicians report for the month of June 1889, was read and referred to the Hospital Committee. Sextn. The City Sextons report for the month of June 1889, was next read and referred to the Cemetery Committee. City Atty. in R. L. Hood petition The City attorney presented an opinion on a petition from R. L. Hood, the same having been referred to him at the last regular meeting of the Council for an opinion as to whether lots 4 and 5 in block 94, with improvements, are exempt from taxation for the reason that said property was designed and is --- Page break --- 494 being used exclusively for School purposes. The opinion in the affirmative and was laid over without action. Ald Newton. Alderman Newton entered and answered to his name. Marshal's Alderman Graham presented reports from the police reports. Committee on the marshal's reports for the months of April and May, 1889, stating that said reports were examined and found correct. The reports of the Committee were adopted. Hospital. On motion the Hospital Committee was given further time in which to prepare reports. Alds Metz & Nitschke Aldermen Metz and Nitschke entered and answered to their names. Pet. R.L. Hood The petition of R.L. Hood, which is referred to in the opinion of the city attorney above cited, was taken up and on motion of Alderman Linn, laid upon the table by the following vote. Yeas- Aldermen- Assmann, Graham, Jones, Linn, Metz, Newton, Nitschke, Platt, Townsend, 9. Nays- Aldermen- Lawrence, Morris, Schneider, Wilson, Wortham, Ziller - 6. Board of A & Eq. The Mayor submitted the following names to constitute a board of appraisers and equalization for the city: On part of the board of Aldermen - Aldermen Graham, Platt, NewtonOn part of Citizens - Henry Hirschfield and William B. Brush. On motion, the nominations were Confirmed by acclamation. School Tax "An Ordinance fixing and levying an ad valorem tax of one third of one per Centum on all property real and personal within the City of Austin, made taxable for State and County purposes, for the year A.D. 1889, for the Support of the public free Schools of Said City", was taken up on its second reading and read, after which motions were made to suspend the rules and place the Ordinance on its third reading and final passage, both of which were adopted by the following vote. Yeas- Aldermen - Assmann, Graham, Jones, Lawrence, Linn, Metz, Morris, Newton, --- Page break --- 495 Nitschke, Platt, Schneider, Townsend, Wilson, Wortham, Ziller- 15. Firemen Alderman Ziller introduced an Ordinance Amending Uniform. Art. 277, Chapter 1, title VIII of the Revised Civil Ordinances It requires all firemen to wear some part of their uniform when attending a fire, and a failure to do so shall cause their expulsion by the firepolicemen from the burning premises. It was read first time, after which motions were made to suspend the rules and place the Ordinance on its second and third readings, both of which prevailed by a vote of two-thirds of the whole Council and on motion the Ordinance was then passed. Licenses. Alderman Wortham presented an Ordinance regulating licenses and occupation taxes in the City of Austin. Alderman Morris moved to suspend the reading of the Ordinance except Sections 45, 62 and 63. Motion Carried. A motion was then made to suspend the rules and place it on its second reading, which prevailed by a vote of two-thirds of the whole Council. Alderman Morris moved to strike out Section 62, which a license tax of $5 per month or fraction thereof on every itinerant vendor, and provides that the city-marshal shall designate the stands or places where they may do business. The motion was lost by the following vote: Yeas, Aldermen Lawrence, Morris, Wilson-3. Nays- Aldermen Assmann, Graham, Jones, Linn, Metz, Newton, Nitschke, Plath, Schneider, Townsend, Wortham, Ziller-12. A motion was then made to suspend the rules and place it on its third reading. Motion lostYeas, 12; Nays, 3. $3100 00 Alderman Wortham introduced An Ordinance appropriating the sum of $3100 00 for the purpose of paying officers and regular employes of the City for the month of July, 1889. It was read first time, after which motions were --- Page break --- 496 made to suspend the rules and place it on its second and third readings, and that it do pass, all of which were adopted by the following vote: Yeas, Aldermen- Assmann, Graham, Jones Lawrence, Linn, Metz, Morris, Newton, Nitschke, Platt, Schneider, Townsend, Wilson, Wortham, Ziller - 15. Appt. rects. Alderman Wortham presented An Ordinance appropriating the sum of $7,451.45 for the purpose of paying approved accounts. The Ordinance was read first time, after which a motion was made to suspend the rules and place it on its second reading, which was adopted by a two-thirds vote of the whole Council. Water Co... Alderman Ziller then moved to amend Section one by striking out $6,035 to pay the water Company hydrant rental and insert $3000.00 for that purpose. The motion was lost. Ald. Wortham moved to amend Section one by inserting $15 to pay Geo. S. Penderter, City Attorney, fee in case of Thetreau Vs. City, in district Court. Carried. The Caption and section one were then changed to read "$7,766.45" and motions were made to suspend the rules and place the Ordinance on its third reading and final passage, both of which were adopted by the following Vote: Yeas Aldermen- Assmann, Graham, Jones Lawrence, Linn, Metz, Morris, Newton, Nitschke, Platt, Schneider, Townsend, Wilson, Wortham- 14. Nay- Alderman Ziller. Spl. Comtee on Alderman Linn moved that the mayor Water rates appoint a special Committee of three aldermen to confer with the water Company with a view, if possible, to making a new Contract more advantageous to the City, and report to the next meeting of the City Council. Adopted. The mayor then appointed, Aldermen Linn, Ziller and Assmann as such Committee, but by request of Alderman Linn his name was --- Page break --- withdrawn. The mayor the appointed Alderman Morris instead. On motion the Council then adjourned Milton Morris City Clerk.
