Austin Plans December Election, Approves Fire Department Funds

Monday, November 4, 1889 regular

521 The Minutes of a regular meeting of the City Council. Austin, Texas, November 04, 1889. Hon Joseph Nalle, Mayor, presiding. Roll Roll Call. Present, Aldermen. Assmann, Baland, DeDress, Jones, Lawrence, Linn, Metz, Morris, Newton, Nitschke, North, Platt, Schneider, Townsend, Wilson, Wortham, Ziller - 17. Call. Absent, Aldermen - Graham, Haigler, Pillow - 3. Minutes The minutes of the meetings of the City Council which were held on the 7th 11th and 14th days of October, 1889, were adopted as printed. R.J. Hill A petition was presented from R. J. Hill, asking permission to construct a culvert - subject to the approval of the street Commissioner - to gain access to his stable on Trinity street. Granted. Sylvester Watts. A Communication was received from Sylvester Watts, stating that he had accepted the privileges granted to him, to erect, operate and maintain gas works in the City of Austin, as contained in an Ordinance which was passed by the City Council of the City of Austin, on the 7th day of October, A.D. 1889, and approved by the Mayor of said City on the 11th day of October, 1889. The Communication was filed without being read. Protection H.Co Alderman Linn presented a petition from Protection nozzles. Hose Company No.3 for an appropriation of $50, with which to purchase nozzles for the Company, the old nozzles being useless. Granted. C.W. Barnes Alderman Assmann presented a petition from Charles W. Water & Light Barnes, asking that the hydrant in the alley in the rear of McNamara's Store, 1000 East 11th Street, be removed to the Corner of 12th and San Bernard Streets, as the present location is inconvenient. Also that an electric light be erected on the same Corner. Alderman Morris moved to refer it to the water and gas Committee. Alderman DeBress moved, as a substitute, that the water Company be directed to move the hydrant to the Corner of 12th and Curve Streets. The substitute was lost by the following vote: Ayes - Aldermen - Assmann, Boland --- Page break --- 522 DeHress, Metz, Newton, Platt, Wilson 7. Nays- Aldermen Jones, Lawrence, Linn, Morris, Nitschke; North, Schneider, Townsend, Wortham, Ziller - 10. Alderman Nitschke then moved to amend the motion made by alderman Morris by requiring the water and gas Committee to ascertain cost of removing electric light. The amendment was accepted and the motion as amended, adopted. Mrs J.E.Albright Alderman Wilson introduced a petition from Mrs. J.E. Albright, asking that pound fees to the amount of $3, paid on account of her horse being impounded, be refunded. Granted. Officers Reports. Tr. report. Report of the City Treasurer from October 7th to November 4th 1889. Referred to the Police Committee. --- Page break --- 523 City Clerk. Report by City Clerk of Warrants issued during the month of October 1889, places the amount at $5,08672. Referred to Finance Committee. Sexton. The Sextons report for the month of October, 1889, was read and referred to the Cemetery Committee. J. Raatz & The Street Committee and City attorney at the request J. Schuber to of J. Schuber and J. Raatz, recommended that they open alley in be given until the first day of January, 1890, to remove 175. Obstructions from the alley in block 175. The recommendation was agreed to. Police Comte The Police Committee presented reports on the marshals reports for the month of August and September, 1889, stating that the report had been examined and found Correct. The Committees reports were adopted. Light. The water and gas Committee was given further time in which to present a report on a petition for a light to be placed at the Corner of Colorado and West Tenth streets near the Baptist Church. Fire Engs. An Ordinance on its third reading entitled " An Ordinance to provide for repairing the fire engines owned by the City of Austin and to make appropriation therefor," was taken up and read, and on motion, laid on the table subject to Call. Sabine St. A resolution on its second reading entitled "A resolution providing for the grading of a portion of Sabine Street" was taken up and read, and a motion made by Alderman Nitschke which to suspend the rules and place it on its third reading was lost by the following vote. Yeas - Aldermen - Assmann, Beland, Jones, Lawrence, Linn, Morris, Nitschke, North, Schneider, Townsend, Wortham, Ziller-12. Nays- Aldermen- DeGress, Motz, Newton, Platt, Wilson - 5. Fire Hose mes The Mayor asked unanimous Consent of the Council withdrawn. to the withdrawal of his message Vetoing an Ordinance Appropriating $2000 to purchase fire hose for the use of the fire department. Alderman Linn moved that unanimous consent be granted. --- Page break --- 524 " Alderman Morris made the point of Order that as the Veto had been presented and acted upon to the extent of reconsidering - the Vote by which the Ordinance was passed it is now too late to withdraw it. The Chair overruled the objection and an appeal was taken resulting in the Chair being Sustained. The motion made by Alderman Linn was then adopted. Amm. Hort. Society. The Mayor presented a letter from S. V. Mason, Vice president American Horticultural Society stating the Society contemplated holding its next biennial meeting in Texas. On motion of Alderman Wortham, the mayor was requested to extend to the Society an invitation to hold the meeting in this city. 2000$ for Hose. The Ordinance above refured to appropriating $2000 for the purpose of purchasing hose for the use of the fire department was Called up, - it being on the table on its third reading Subject to Call - and on motion passed by the following Vote: (Yeas, Aldermen - Assmann, Boland, DeBress, Jones, Lawrence, Linn, Metz, Morris, Newton, Nitschke, North, Platt, Schneider, Townsend, Wilson, Wortham, Ziller - 17. Bridge. Alderman Jones introduced an Ordinance appropriating $75 to build a foot bridge over Waller Creek on Sabine Street. It was read first time after which a motion was made to suspend the rules and place it on its second and third readings, both of which were adopted by a two-thirds vote of the whole board, and on motion the Ordinance passed. Nov. pay roll. Alderman DeBress offered an Ordinance appropriating the sum of $3,100 for the purpose of paying officers and regular employes of the City of Austin for the month of November, 1889. It was read first time after which motions were made to suspend the rules and place it on its second and third readings, and that it do pass all of which were adopted by the following Vote: Yeas, Aldermen - Assmann, Boland, DeBress, Jones, --- Page break --- 525 Lawrence, Linn, Metz, Morris, Newton, Nitschke, North, Platt, Schneider, Townsend, Wilson, Wortham, Ziller - 17. Approt. accts. Alderman DeGress presented an ordinance appropriating the sum of $2014.33 for the purpose of paying approved accounts. It was read first time after which a motion was made to suspend the rules and place it on its second reading which was adopted by a two-thirds vote of the whole board. Nozzles. Alderman Linn then moved to amend section one by inserting $50 for the purchase of nozzles for Protection Hose Co. No. 3. Adopted. Mrs Aldright Alderman DeGress also moved to amend section one by inserting $3 pound fees refunded to Mrs J.E. Oldright. Carried. Section one and the caption were then changed to read "$2067.33" instead of $2014.33. Motions were then made to suspend the rules and place the Ordinance on its third reading and that it pass, both of which were adopted by the following vote. Election Alderman Morris introduced a resolution entitled "A resolution ordering a general election in the City of Austin on Monday, December 2, 1889". It was read the first time, after which a motion was made to suspend the rules and place it on its second reading, which was adopted by a two-thirds vote of the whole board. Alderman DeGress then moved that it be read by sections, for amendments. Carried. Alderman Boland moved to strike out "Joseph Nalle," and insert instead "the present mayor." Accepted. Alderman Metz moved to insert "Walsh's lime house" as the place of holding the election in the first ward. Accepted. Alderman Schneider entered and answered to his name. Alderman DeGress moved to pass for the present the first ward as to the naming of the Judges of election. No objection was raised. Alderman Newton moved to strike out the name of A. Deffenbaugh and insert the name of T. H. Edwards as Judge of election in the eighth ward. Lost. Yeas, Aldermen - Assmann, Boland, DeGress, Metz, Newton, Platt, Schneider - 7. Nays - Aldermen - Graham, Linn, Morris, Nitschke, North, Pillow, Townsend, Wortham, Ziller - 9. Alderman Wilson entered and answered and answered to his name. Alderman DeGress moved a reconsideration of the vote by which the name of T. H. Edwards failed to be --- Page break --- 527 substituted for that of A. Hoffenbaugh. Alderman Linn made the point of order that as Aldermen DeGress had voted with the minority he could not move a reconsideration of the vote. The point of Order was sus- tained by the Chair. Alderman Boland moved to strike out the name of R. R. Gilbert, and insert that of W.F. Bacon as a Judge of Election for the Ninth Ward. The motion was rejected. Yeas-Aldermen - Assmann, Boland, DeGress, Mitz, Newton, Platt, Schneider, Wilson - 8. Nays-Aldermen - Graham, Linn, Morris, Nitschke, North, Pillow, Townsend, Wortham, Ziller - 9. Alderman Schneider moved to strike out the name of P.L. Meyer and insert that of Ben Marshall as a Judge of election for the first ward. Adopted. Yeas-Aldermen - Boland, Graham, Linn, Morris, Newton, Nitschke, North, Pillow, Schneider, Townsend, Wortham, Ziller - 12. Nays-Aldermen - Assmann, DeGress, Metz, PlattA motion was then made to suspend the rules and place the resolution on its third reading, which was lost by the following vote.
