Austin Voters Approve $1.4M Water & Light Bond

Massive Bond Approval: Voters overwhelmingly approved expanding the city's debt by $1.4 million (1,354 votes for, 50 against) to fund water works and electric lighting infrastructure for Austin.

Fast-Tracked Election: The city held the election on May 5, 1890, after passing an ordinance on March 31st, with the mayor issuing a 30-day notice allowing all property-owning taxpayers to vote across 10 ward locations.

627 The minutes of a Regular meeting of the City Council. Hon. John M. Oswald, Mayor, presiding. Roll Call Roll Call Present Aldermen - Jones, Morris, North - 3. Absent. Aldermen - Anderson, Assmann, Boland, Carleton, Graham, Hume, Jackson, Linn, Metz, Newton, Nitschke, Phillips, Plath, Schneider, Schuler, Townsend, Zeller - 17. A Call of the Council was duly ordered and Shortly afterwards suspended. Roll The roll was again called and showed the following result: Present- Aldermen - Anderson, Assmann, Carleton, Jones, Metz, Morris, Newton, Nitschke, North, Phillips, Plath, Zeller - 12. Call. Absent - Aldermen - Boland, Graham, Hume, Jackson, Linn, Schneider, Schuler, Townsend - 8. Election Alderman North moved that the regular order Bonds. of business be suspended and that the returns of todays election be now canvassed and that the mayor appoint three tellers for that purpose. Adopted, and the mayor appointed Aldermen North, Anderson, and morris tellers. Aldermen Townsend, Linn and Schneider entered the Council and answered to their names. North, C. E. Anderson, F. S. Morris. Austin May 5th 1890. Result declared. Alderman J. Carleton introduced the following Resolution: " Be it resolved by the City Council " of the City of Austin, That Whereas on the " 31st day of March 1890. the Said Council enacted " an Ordinance as follows: " An Ordinance ordering an " Election to obtain the Consent of the property-tax-paying " qualified voters of the City of Austin to the Extension by the " City Council of the Bonded Indebtedness of the City of Austin " for the purpose of Constructing a system of Water Works " and furnishing Lights for the City of Austin. " Section 1. Be it Ordained by the City Council of the " City of Austin, That an election be and the same " is hereby ordered and directed to be held in the City of " Austin on Monday, the 5th day of May A.D. 1890, " from 9 o'clock a.m. until sunset, for the purpose " of obtaining the Consent of two-thirds of the qualified " voters of the City of Austin who pay taxes on prop --- Page break --- 629 in said City to an extension of the bonded debt of the City in the sum of One million and Four Hundred Thousand Dollars beyond the Existing bonded indebtedness of One hundred and twenty-five thousand dollars, for the purpose of Constructing a system of water works, and to furnish light for the City and the Citizens thereof. Sec. 2. That the mayor shall issue his proclamation giving notice of said election and of the object thereof and of the time and place of holding the Same for at least thirty days before the day of Said election. Sec. 3. That all qualified voters of the City of Austin who pay taxes on property in said City, shall be entitled to vote at Said election. Sec. 4. The polls of said election shall be open in the several wards of the City at the following named places and the following named persons are hereby appointed Judges of said election for their respective wards: For the First Ward:- C. Archer, R. C. Shelley, F. L. meyer. For the Second Ward:- B. S. Pillow, S. G. Kingsbury, T. M. Maddox. For the Third Ward:- Jo & Harrell, Sr, E. C. Bartholomew and Henry Hirshfeld. For the Four Ward:- F. L. Wren, Clarence Hunter, Charles Caldwell. For the Fifth Ward:- Geo. Warren, Max Maas, D. J. Cordova. For the Sixth Ward:- J. P. Crain, Louis Marcuse, A. C. Hill. For the Seventh Ward:- H. L. Spain, Jos. B. Rogers, W. W. Archer. For the Eighth Ward:- A. Jeffenbaugh, Jos. Lee, Jos. Costa. For the Ninth Ward:- Horace Holley, R. m. Castleman, S. H. Weaven. That the ballots to be used at said election shall be printed and furnished by the City of Austin as is now provided by Ordinance; and each ballot shall have printed thereon the following, towit: "In favor of Extending the bonded debt of the City of Austin in the Sum of One million and Four Hundred Thousand Dollars for the purpose of building water works and furnishing light for the City." "Against the proposed extension of the bonded debt of the City." The voter shall prepare his ballot by marking across with pencil one or the other of the foregoing --- Page break --- 630 expressing and leaving the other as expressing their vote. Sec. 6. That the said election shall be held in the following places. In the First Ward, at Glass’ Building. In the Second Ward, at Kingsbury’s block. In the Third Ward, at the City Hall. In the Fourth Ward, at Woodman’s Store. In the Fifth Ward, at house of Hose Protection Fire Company No. 3. In the Sixth Ward, at Salway’s Building. In the Seventh Ward, at Hillerman’s Mill. In the Eighth Ward, at the County Court House. In the Ninth Ward, at S. H. Weam’s stable. In the Tenth Ward, at Hopheintz’s Store. Passed, March 31st 1890. Approved April 1st 1890. John McDonald, Mayor. And Whereas pursuant to Said Ordinance which was duly approved on April 1st 1890 by Hon. John McDonald Mayor of Said City, and pursuant to a proclamation issued by Said Mayor thirty days prior thereto, an Election was duly held on the 5th day of May 1890, at which election it appears from the returns made and Counted and duly returned in accordance with law, 1354 duly qualified electors Voted in favor of Said proposition and fifty duly qualified electors Voted against it now therefore, Be it resolved by the City Council of the City of Austin and it is hereby declared and ordained that more than two-thirds of the qualified Voters of the City of Austin who pay taxes on property, having property in Said City, having Voted in favor of an Extension of the bonded debt of Said City in the sum of One Million & four hundred thousand dollars beyond the existing bonded indebtedness of One hundred and twenty five thousand dollars for the purpose of Constructing a system of Water works and to furnish light for the City and the Citizens thereof, and that this power, the power to extend the bonded debt of Said City beyond the sum of One hundred and twenty five thousand --- Page break --- 631 dollars, has been duly conferred upon the City Council in the manner provided by law." It was read first time and a motion was made to suspend the rules and place the resolution on its second reading, which was adopted by the following Vote - Yeas- Aldermen- Anderson, Assmann, Carleton, Jones, Linn, Motz, Morris, Newton, Nitschke, North, Phillips, Platt, Schneider, Townsend, Zillon - 15. Nays - None. The resolution was then read a second time and a motion was made to suspend the rules and place it on its third reading which was adopted by the following Vote - Yeas. Aldermen- Anderson, Assmann, Carleton, Jones, Linn, Motz, Morris, Newton, Nitschke, North, Phillips, Platt, Schneider, Townsend, Zillon - 15. Nays - None. The resolution was then read a third time and then duly adopted. Bond Alderman North moved that the mayor Comtee appoint a special Committee of three aldermen, and that the city attorney be added, to draft and report an Ordinance to the next meeting of the Council providing for the issuance of the bonds. Adopted. The chair appointed as such Committee, Aldermen North, Morris and Carleton. The Council then adjourned until next Thursday night at 8 oclock. L. Alderman North presented a favorable report from the Committee on Claims and accounts on a petition from Ben Walker requesting that pound fees which he had paid to the City be refunded for certain reasons. Action on the report was postponed until the next regular meeting of the Council. J. Donahue. Alderman Phillips, by request, presented a petition from John Donahue asking the Council to remit Certain pound fees which he had paid to the City (Referred to the Committee on Claims and accounts. Prest. Linn The mayor retired and Alderman Linn, prest. of the Board of Aldermen, took the Chair. Alderman Nitschke entered the Council and answered to his name. Sand - Alderman North, from the special Committee to Musebeck. whom was referred the petition of O. C. Mousebeck to lease the sand pit for a period of ten years, presented an unfavorable report on the same, which states that the "Committee believe it to be inexpedient and impolitic to grant exclusie privileges to any person". The report was adopted. By unanimous Consent the regular order of business was suspended for the purpose of Considering appropriation Ordinances. may Salaries Alderman Stume introduced "An Ordinance appropriating the sum of $3,200 to pay officers and regular employes of the City for the month of 'may 1890'. Fast riding - The Council, by unanimous Consent, took up a Animals unhitched resolution which was introduced by Alderman Carleton, instructing the City Marshal and the force under him to strictly enforce all ordinances relating to fast driving and leaving teams unhitched on the streets, and adopted the same. Alderman Newton entered and answered to his name. 800# East A. "An Ordinance appropriating the sum of $800.00 for the cost of plans and building addition to fire hall, East Austin Hose Company, No. 4," was taken up on its third reading and read and passed by the following Vote. Yeas - Aldermen - Anderson, Assmann, Carleton, Graham, Hume, Linn, Morris, Newton, Nitschke, North, Phillips, Schneider, Townsend. 13. Alderman Phillips was excused. Scheuermeyer - "An Ordinance leasing a portion of River River Walk Walk to C. Scheuermeyer" was taken up on its second reading and read and on motion of Alderman Carleton referred to a special Committee of three. The Chair appointed Aldermen Carleton, Anderson, and Assmann as such Committee. Alderman Nitschke moved to adjourn - Lost. Hospital Alderman Anderson introduced a resolution, which was adopted, instructing the City Engineer to report to the Council at its next meeting the cost of a sewer from the City hospital to the Pub --- Page break --- 635 Sewer. "Cow" "An Ordinance to be entitled an Ordinance to amend article 127 of the Revised Penal Ordinances of the City of Austin," was taken up " on its second reading and read. Alderman Morris moved to amend it by adding "provided, that the portion of the City lying North of Pecan or Sixth Street and West of Shoal Creek be and the same is hereby excepted from the provisions of this Ordinance in so far as it prohibits the running at large of milch Cows in the day time". The amendment was adopted and a motion was made to suspend the rules and place the ordinance on its third reading, but failed by the following Vote - YeasAldermen- Anderson, Asmann, Carleton, Graham, Hume, Linn, Morris, Kitschke, North, Schneider, Townsend - 11. Nay - Alderman Newton. Sand- Alderman North offered an "Ordinance regulating the digging up and removal of sand and gravel from the river Wash and other public places and Commons within the limits and Jurisdiction of the City of Austin". Fire Hall On motion of Alderman Morris the Ordinance Wall -> was referred to the Committee on Ordinances. Alderman Morris introduced an Ordinance to appropriate $125 to add to the wall on the west side of Fireman's Hall in the Third Ward and to paint the tower on the building. Read first time. Board P.W. Alderman Morris also introduced "An Ordinance to amend section 2 of an Ordinance entitled "An Ordinance to create a Board of Public Works of the City of Austin and to prescribe the powers and duties thereof" approved April 3, 1890." It was read first time, after which the Council adjourned until 6 o'clock p. m. Friday, May 9, 1890.
