Austin Infrastructure & Tax Plans from 1890

Street Improvements Approved: Council approved opening Red River Street and appropriated $100 for a brick culvert on Magnolia Avenue and San Antonio Streets, while rejecting a petition to open Comal Street. Citizens also petitioned for macadamizing (paving) East 6th Street.

Telephone & Utility Monopoly Restrictions: Council granted the Southwestern Telegraph and Telephone Company continued rights to erect poles and wires, but added strict amendments preventing them from interfering with other companies' electrical rights and reserving the city's own right to build competing systems.

Water & Transportation Issues: Council debated removal of a watering trough in Masontown (ultimately reversing an earlier decision to remove it) and approved a new trough on Mesquite Street near Congress Avenue.

Taxes & Salaries Enacted: Council passed a 1% ad valorem tax for city expenses and a special 1/3% tax for public schools, along with $3,200 in salary appropriations for city officers and employees.

Street Railway Amendment: Council approved an ordinance amending rights previously granted to M.M. Shipe for operating street railways throughout Austin.

663 The minutes of a regular meeting of the City Council. Austin, Tex, Aug. 4, 1890. Hon. John Mc Donald, mayor, presiding. Roll Roll Call. Present Aldermen Assmann, Graham, Hume, Jones, Morris, Newton, Nitschke, North, Platt, 9. Call. Absent. Aldermen - Anderson, Boland, Carleton, Jackson, Linn, Metz, Phillips, Schneider, Schuler, Townsend, Ziller - 11. Call- On motion a call of the Council was ordered. Call suspt. The Call was soon Suspended and the roll ordered Roll called again, which was done and resulted as follows: Present- Aldermen Assmann, Graham, Hume, Jones, Morris, Newton, Nitschke, North, Phillips, Platt, Schneider - 11. Call. Absent- Alderman - Anderson, Boland, Carleton, Jackson, Linn, Metz, Schuler, Townsend, Ziller-9. Minutes The minutes of the meeting of the City Council which was held on the 21st day of July, 1890, were adopted as recorded by the City Clerk. Nitschke Leave of absence for eight days was granted to W.L. W. L. Nitschke, City Sexton. 12th & Lavaca A protest from citizens against the Completion Sts. of the excavations now being made on 12th and Lavaca Streets was read and referred to the Street Committee. J. Andrewartha A letter and pamphlet on Sanitary matters Sanitary- were received from Mr. J. Andrewartha and referred to the Committee on Sanitation and Sewers. E. 6th Alderman Platt presented a petition from & citizens requesting the Council to finish macadamizing E. Ave. Sixth Street east of East Avenue and East Avenue between Fifth and Sixth Streets. Referred to the Street Committee. Water Alderman Jones presented a petition of citizens trough requesting that the watering trough in Masontown be not removed. Alderman Morris then entered a motion to reconsider the vote by which a Committee report --- Page break --- 664 Was adapted ordering the removal of Said trough, and that Said petition and motion be laid over until unfinished is reached. Carried. Reports of the following City officers for the month of July 1890 Were presented and referred to their respective Committees: City Marshal, City Sexton, City Clerk, City Physician. The report of the City treasurer from July 7. to Aug. 4, 1890, was presented and referred to the finance Committee, as was also the report of the City Assessor and Collector for the quarter ending July 31, 1890. Comal St. The Street Committee presented an unfavorable report on a petition of Citizens to have Comal Street opened, and the report was adopted. Red River The Street Committee Submitted a favorable report St. on a petition of Citizens to have Red River Street opened, and the same was adopted. Foot Bridge The Street Committee also presented a report on a at Board Trade resolution from the Board of Trade requesting the Council to place four iron bridges on Congress avenue at the intersection of South Street. The report recommends that the wagon bridges on the Crossing of Sixth Street and Congress avenue be lengthened and that the iron foot bridges there be used at the places named in the resolution. The report was adopted. Culvert. The Same Committee also offered a favorable report on an Ordinance appropriating $100 for a brick arched Culvert on Magnolia Avenue and San Antonio Streets. Adopted. J.C.Mueller. Alderman North, of the Committee on Claims and accounts, to whom was referred a petition from J.C. Mueller requesting the Council to remit Certain pound fees, Submitted an unfavorable report thereon. " Alderman Jones moved that the petition be granted. Alderman Morris moved as a substitute that the report of the Committee be adopted. " A motion was then made to lay the motion made by Alderman Morris on the table. Carried. " The motion made by Alderman Jones was then adopted. Unfinished Business. Drivers &c. " An Ordinance prohibiting drivers of hacks and --- Page break --- 665 other Vehicles and other persons from entering the depot grounds in the city of Austin for the purpose of receiving or discharging freight or passengers, except in the manner provided by this Ordinance", was taken up on its second reading with a committee report and read a second time and recommitted. (No. 4. "An Ordinance appropriating one hundred and fifty dollars for a brick arched Culvert on Magnolia Avenue and San Antonio Street", was taken up on its second reading and read and laid over. Refused Alderman Motz entered the Council and answered to his name. Water Alderman Morris called up his motion to reconsider trough the vote by which a Committee report was adopted directing the removal of the watering trough from Masontown, and it was adopted. The Committee report was then laid upon the table. " "An Ordinance providing for the placing of a watering trough on Mesquite Street near Congress Avenue", was called up from the Committee on Water and light, to whom it had been referred, and read a second time. Telephone "An Ordinance continuing to the Southwestern telegraph and telephone Company the right to erect telephone poles and wires, and granting said right, all on terms and conditions herein stated", was called up and read a second time. Alderman Morris then offered the following amendment: Amend Section 1 by adding the following after the word device: Conditioned that said right of way shall be forfeited if said Company shall by litigation attempt to interfere with the rights of way heretofore or which may hereafter be granted by the City Council to any other Company to operate electrical appliances in the City of Austin for the purpose of communication between or transportation of persons and the right is reserved on the part of the city to construct and operate any and all electrical appliances that the city may see proper to construct and operate whether the same might interfere with said Company's telephone System or not. Adopted. Alderman Morris also introduced the following --- Page break --- 666 Amendment: Substitute for Sec. 2. the following. The location of the poles and lines now in use shall be subject to such Changes as the City Council may hereafter direct. Adopted. The Mayor made a Verbal report to the Council to 1. Stating that Water works and electric light bonds Nos. 1 to 20, inclusive, being for $1,000 each, had been sold in accordance with the Ordinance of the City authorizing the dale of the same. Alderman Morris moved that the Sale of said bonds, as reported by the mayor, be ratified and Confirmed by the Council and the motion was unanimously adopted. Salaries. Alderman Hume introduced an Ordinance appropriating $3200 for the purpose of paying officers and regular employees of the city for the month of August 1890. It was read and laid over Subject to Call. appt accts. Alderman Hume also introduced an Ordinance appropriating the Sum of $1206.40 for the purpose of paying approved accounts. It was read and laid over Subject to Call. Ald. Townsend Alderman Townsend entered the Council and answered to his name. St. Car Alderman North introduced "An Ordinance amending right way. An Ordinance entitled 'An Ordinance amending Section 1 of an Ordinance granting the right of way to M. M. Shipe, his associates and assigns to Construct, maintain and operate Street Railways along certain Streets and avenues in the City of Austin, approved April 26, 1890." It was read and laid over Subject to Call. Ad V- tax Alderman Morris introduced " An Ordinance levying an ad valorem tax of One per Cent for the Year 1890, to be used for the Current expenses and general improvement of the City." It was read first time and laid over Subject to Call. School tax Alderman Morris also presented " An Ordinance levying a Special tax of one third of one per Cent for the maintenance of the public free Schools of the City of Austin for the year 1890." It was read and laid Subject to Call. Call Coun. Alderman Morris moved a Call of the Council Schuer ad. and that the Marshal be directed to bring Alderman --- Page break --- 667 Schuber into the Council. Carried. Id [illegible] Alderman Schuber entered the Council and answered to his name. The Call of the Council was then suspended. St [illegible] Alderman North moved that the Ordinance amendatory of the Street railway Ordinance be taken up- Carried. App [illegible] Alderman Jones moved that after the street railway Ordinance is disposed of the appropriation Ordinances be taken up. Carried. St. [illegible] An Ordinance amending an Ordinance entitled " " An Ordinance amending Section One of an Ordinance entitled An Ordinance granting the right of way to M. M. Shipe his associates and assigns to Construct, maintain and operate Street Railways along Certain Streets and Avenues in the City of Austin" Approved April 26, 1890," was Called up and motions were made to suspend the rules and place the Ordinance on its Second and third readings which were adopted by a two-thirds Vote of the whole Council. The Ordinance was accordingly read a second and third time and passed. Aug Salaries An Ordinance making an appropriation of $3200 for the purpose of paying Salaries of Officers and regular employees of the City of Austin for the month of August A. D. 1890", was Called up and motions were made to Suspend the rules and place the Ordinance on its Second and third readings and that it do pass, all of which were adopted by the following Vote - Yeas - Aldermen - Assmann, Graham, Hume, Jones, Metz, Morris, Newton, Nitschke, North, Phillipor, Platt, Schneider, Schuber, Townsend - 14. Apph. accts An Ordinance appropriating the Sum of $1206.40 for the purpose of paying approved accounts", was Called up and a motion was made to Suspend the rules and place it on its Second reading which was adopted by a two-thirds Vote of the whole Council. The Ordinance was then read a Second time, after which Alderman Jones moved [illegible] to amend Section one by adding $120 to pay [illegible] C. Mueller for amount of [illegible] his [illegible] [illegible] --- Page break --- 668 Carried. Alderman Hume moved to amend the same Section by inserting $100" to pay Wm. Tobin for gravel - Adopted yeas... Aldermen Assmann, Graham, Hume, Morris, Newlan, Nitschke, North, Phillips, Schneider, Schuler, Townsend - 11. Nays - Aldermen Jones, Metz, Platt - 3. Alderman Hume also moved to add $19.07 to pay S.J. Bryan & Co for stock feed furnished to the hospital in May 1890. Carried. The amount in the Caption and Section One were Changed to Conform the the Amendments - Viz "$1206.40" was Stricken Out and "$1467.47" inserted in each. Motions were then made to suspend the rules and place the Ordinance on its third reading, and that it do pass, both of which were adopted by the following - Vote - yeas - Aldermen - Assmann, Graham, Hume, Jones, Metz, Morris, Newton, Nitschke, North, Phillips, Platt, Schneider, Schuler, Townsend - 14. School Tax "An Ordinance levying a special tax of One-third of One per Cent for the maintenance of the Public Free Schools of the City of Austin for the year 1890" was Called up and a motion made to suspend the rules and place it on its third reading, which was lost by the following Voteyeas - Aldermen - Assmann, Graham, Hume, Jones, Metz, Morris, Newton, Nitschke, North, Phillips, Schneider, Schuler, Townsend - 13. Nay - Alderman Platt - 1. Ad. V. tax. "An Ordinance levying an advalorem tax of One per Cent for the year 1890, to be used for the Current expenses and general improvement of the City", was Called up and a motion was made to suspend the rules and place it on its second reading which was adopted by the following Vote - yeas - Aldermen Assmann, Graham, Hume, Jones, Metz, Morris, Newton, Nitschke, North, Phillips, Platt, Schneider, Schuler, Townsend - 14. The Ordinance was then read a second time after which a motion was made to suspend the rules --- Page break --- 669 and place it on its third reading which was adopted by the following vote- Yeas- AldermenAssmann, Graham, Hume, Jones, Metz, Morris, Newton, Nitschke, North, Phillips, Platt, Schneider, Schuler, Townsend - 14. The Ordinance was then read a third time after which a motion was made that the Ordinance do now pass, which prevailed by the following Vote - Yeas- Aldermen- Assmann, Graham, Hume, Jones, Metz, Morris, Newton, Nitschke, North, Phillips, Platt, Schneider, Schuler, Townsend, 14. School tax Alderman Platt moved to reconsider the Vote by which the Council refused to suspend the rules and place on its second reading "An Ordinance levying a special tax of One third of One per cent for the maintenance of the Public Free Schools of the City of Austin for the year 1890." And a motion was then made to suspend the rules and place the said School tax Ordinance on its second reading which was adopted by the following vote - Yeas- Aldermen - Assmann, Graham, Hume, Jones, Metz, Morris, Newton, Nitschke, North, Phillips, Platt, Schneider, Schuler, Townsend14. The Ordinance was then read a second time, after which a motion was made to suspend the rules and place the said School tax Ordinance on its third reading, which was adopted by the following Vote- Yeas- Aldermen - Assmann, Graham, Hume, Jones, Metz, Morris, Newton, Nitschke, North, Phillips, Platt, Schneider, Schuler, Townsend-14. The ordinance was then read a third time and on motion passed by the following Vote- YeasAldermen- Assmann, Graham, Hume, Jones, Metz, Morris, Newton, Nitschke, North, Phillips, Platt, Schneider, Schuler, Townsend-14.
